HomeMy Public PortalAboutResolution 60-044RESOLUTION NO. 60 -44 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING AND AUTHOR- IZING THE DEPARTMENT OF CALIFORNIA HIGHWAY PATROL TO PROVIDE CROSSING GUARD SERVICES FOR THE 1960 -1961 SCHOOL YEAR AND AUTHORIZ- ING BILLING OF EXPENSE THEREOF TO THE CITY OF TEMPLE CITY THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: WHEREAS, the City Council has been advised and it finds that it is necessary and desirable that adequate protection be provided for public school pupils who are required to cross heavily travelled high- ways in the incorporated city of Temple City, in the County of Los Angeles, State of California; and WHEREAS, the City Council has been advised, and it finds that it is necessary and desirable to provide such protection, by means of crossing guards at such locations as may be designated by the City Cour cil in the City of Temple City, County of Los Angeles, State of Calif- ornia; and WHEREAS, the City Council desires to pay to the Department of California Highway Patrol for services to be furnished in accordance with the request by the City Council for Temple City crossing guards on a quarterly basis, providing said arrangement is agreeable with the Department of California Highway Patrol; and WHEREAS, if for any reason the City of Temple City cannot enter into an agreement with the Department of California Highway Pat- rol to pay for crossing guards as above stated, then pursuant to Sec- tion 11005 of the Revenue and Taxation Code of the State of California the City Council of the City of Temple City desires that the controller deduct from the apportionment to the City of Temple City from the Motor Vehicle License Fund such amount as shall be required to pay the amount to Department of California Highway Patrol for services rendered in accordance with such request as may be made by the City of Temple City for crossing guards: NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE, DETERMINE AND DECLARE AS FOLLOWS: SECTION 1. The City Council of the City of Temple City does hereby request and authorize the Department of California Highway Patrc of the State of California to provide the services of crossing guards for the 1960 -1961 fiscal year at such locations as may be designated by the City Council in the City of Temple City, County of Los Angeles, State of California, so that adequate protection may be afforded to public school pupili.who are required to cross heavily travelled high- ways, and which are located in the incorporated city of Temple City in the County of Los Angeles, State of California, SECTION 2. That the Department of California Highway Patrol of the State of California is specifically requested to provide the services of crossing guards for the 1560 -1961 fiscal year at the follow ing locations and to employ, if possible, the following named persons and to provide the crossing guards for the hours as designated below: Name & Address School Location Time Harold N. The City Clerk is directed, with the advice of the City Attorney to inquire of the Department of California Highway Patrol if the Department of California Highway Patrol will bill the City of Temple City for crossing guard services on a quarterly basis, and if such arrangement can be entered into, the City Clerk is author- ized and directed to enter into an agreement wherein and whereby, the City of Temple City pays the Department of Highway Patrol quarterly for crossing guard services. SECTION 4. In the event the City Clerk for any reason or th( Department of Highway Patrol for any reason cannot enter into an agree- ment pursuant to Section 3 above, then the Controller of the State of California be and he is hereby authorized to deduct the amount expend•: ed by the Department of California HighwayPPatrol for salaries and wages of said crossing guards in an amount not to exceed 16.5 of said salaries and wages for general administrative expenses of the Calif- ornia Highway Patrol of the State of California from any apportionment: made or to be made to the City of Temple City from the Motor Vehicle License Fee Fund, and to transfer the same to said Department of High- way Patrol of California. The State Controller be and he is hereby authorized to deduct the employer's share of retirement contributions. if any, from said apportionments, not to exceed 8.18% of member's com- pensation. The State Controller may deduct $2.50 per member per year for the cost of administration of the retirement system. SECTION 5. Copies of this Resolution shall be sent to the State Controller of the State of California, and to the Department of Highway Patrol of the State of California. SECTION 6. The Department of California Highway Patrol of the State of California is requested to have available adequate addi- tional persons to act as relief crossing guards in addition to the re- gular crossing guards, to take the place of the regular employed cross. ing guards when they are off duty due to illness, or for any other reason. SECTION 7. The City Clerk shall certify to the adoption of this Resolution.
