HomeMy Public PortalAboutResolution 60-045RESOLUTION N0. 60 -45 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, GIVING NOTICE OF PROPOSED ANNEXATION DESIGNATED AS "ANNEXATION N0. 1 -A, EAST TEMPLE CITY UNINHABITED ". WHEREAS, the boundary lines of the City of Arcadia were chang- ed in 1959 by the completion of the annexation to the City of Arcadia of the territory designated as "Annexation No. 17 -A, Southwest Arcadia Inhabited," which annexation was completed pursuant to Section 35144 of the Government Code by the filing with the Secretary of State of California.on May 13, 1959, of a certified copy of Ordinance No. 1053, entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING THE ANNEXATION TO THE CITY OF ARCADIA OF CERTAIN INHABITED TERRITORY CONTIGUOUS TO THE CITY OF ARCADIA AND DESIGNATED AS' "ANNEXATION NO. 17 -A, SOUTHWEST ARCADIA INHABITED," ADOPTED APRIL 7, 1959; and WHEREAS, the First Baptist Church of Temple City is the owner of the following described property in the County of Los Angeles, State of California, to wit: ■ Those portions of Lots 7 and 8, Tract No. 6561 per map recorded in Book 72, pages 34 and 35, of Maps, in the office of the County Recorder of said County, described as follows: Beginning at the northwest corner of Lot 7, tract No. 6561, per map recorded In Book 72, pages 34 and 35, of Maps, in the office of the Recorder of Los Angeles County; thence easterly along the northerly line of said Lot 7 to a point 37.00 feet westerly of the northeast corner of said lot; thence southeasterly in a direct line to a point in the westerly line of Baldwin Avenue 75, feet wide, said point lying 17.00 feet southerly of the previously mentioned northerly line; thence southerly along said westerly line of Baldwin Avenue to a point in the southerly line of Lot 8 of said Tract No. 6561; thence westerly along said southerly line to the southwest corner of said Lot 8; thence northerly along the westerly lines of Lots 7 and 8 to the point of beginning, which said property became a part of the City of Arcadia by reason of aforesaid Annexation No 17 -A, Southwest Arcadia, Inhabited; and, WHEREAS, for valid reasons the First Baptist Church of Temple City is desirous of annexing all of its property in the City of Arcadia, as described above, to Temple City; and WHEREAS, the City of Temple City has received a written . petition requesting.annexation, containing a description of the terri- tory sought to be included in the City of Temple City, described as above, and which written petition is signed by . the owners of all of the land in the territory by area, and by the assessed value as'shown on the last equalized assessment roll of the county in which the territory is situated, all in compliance with Section 35305 of the Government Code, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the First Baptist Church of Temple City has duly petitioned the City of Temple City requesting annexation pursuant to the "Annexation of Uninhabited Territory Act of 1939 ", Section 35305 of the Government Code. 49 Resolution No. 60 -45 page 2 SECTION 2. The legal description of the territory sought to be included in Temple City is as follows: Those portions of Lots 7 and 8, Tract No. 6561, per map recorded in Book 72, pages 34 and 35, of Maps, in the office of the County Recorder of said County, described as follows: Beginning at the northwest corner of Lot 7 Tract 6561, per map recorded in Book 72, pages 34 and 35, of Maps, in the office of the Recorder of Los Angeles County; thence easterly along the northerly line of said Lot 7 to a point 37.00 feet westerly of the northeast corner of said lot; thence southeasterly in a direct line to a point in the westerly line of Baldwin Avenue 75 feet wide, said point lying 17.00 feet southerly of the previously mentioned northerly line; thence southerly along said westerly line of Baldwin Avenue to a point in the southerly line of Lot 8 of said Tract No. 6561; thence westerly along said southerly line to the southwest corner of said Lot 8; thence northerly along the westerly lines of Lots 7 and 8 to the point of beginning. SECTION 3. That the Temple City Baptist Church owns all of the real property described in SECTION 2 above and hence the petition is signed by the owners of not less than one - fourth of the land in the territory by area and by assessed value as shown on the last equalized assessment roll of Los Angeles County, in which county the subject land is located, all in full and complete compliance with Section 35305 of the Government Code of the State of California. SECTION 4. That the subject real property is contiguous to the City of Temple City; and that said territory is presently includ- ed within another city, to wit, the City of Arcadia; that pursuant to Section 35305 of the Government Code of the State of California, the City of Arcadia has by resolution consented to the detachment from the City of Arcadia and its annexation to the City of Temple City. SECTION 5. That pursuant to the "Annexation of Uninhabited Territory Act of 1939," as amended, the City Council of the City of Temple City does hereby give notice of said proposed annexation; the said territory shall be and the same is hereby designated for identi- fication purposes as "East Temple City Annexation No. 1- A- Uninhabited," and is particularly described as set forth in SECTION 2 above. SECTION 6. That the City of Temple City hereby gives notice of and fixes July 25, 1960, at the hour of 8 :00 o'clock P. M. in the Council Chambers in the City Hall, 9664 East Las Tunas Blvd., Temple City, California, as the day, hour and place,-when and where any per- son owning real property within such territory so proposed to be an- nexed and having any objections to the proposed annexation may appear before the City Council of the City of Temple City and show cause why territory shall not be annexed. SECTION 7. The City Clerk of the City of Temple City shall certify to the adoption of this Resolution, and shall cause a copy hereof to be published at least twice, but not oftener than once a week in the Temple City Times, a newspaper of general circulation pub- lished in the City of Temple City, and also in a newspaper of general circulation published outside of the City of Temple City but in the County of Los Angeles, to wit, the Arcadia Tribune, said publication to be complete at least twenty days prior to the date set for the hear- ing aforesaid; and the City Clerk shall cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized 50 Resolution No. 60 -45 page 3 county assessment roll available on the date the proceedings were in- itiated, at the address shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of the land in which he has any interest, either legal or equitable, with said City Clerk, such notice to be given not less than twenty days before the first public hearing on the proposed annexation.
