Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, Thomas Crosby, William Reiser, Anne Heideman; Clerk -Treasurer, Donna Roehl; Planning and Zoning Admin- istrator, JoEllen Hurr; Police Chief, Michael Sankey; Public Works Director, James Dillman; Attorney, Richard Schaeffer 1. ADDITIONAL AGENDA ITEMS Moved by Anne Heideman, seconded by Scherer to discuss the following additional agenda items: Road Maintenance Material Bids; Community Development Block Grant Fund application; Employment of Jean Erickson; Motion declared carried 2. MINUTES OF MARCH 27, 1984 Anne Heideman asked that Item 25, Page 41 be changed to read "concerns" rather than "inaccuracies". Richard Schieffer stated that Item 4, page 37 should state "preliminary report" rather than "plans and specifications." Moved by Heideman, seconded by crosby to approve minutes of March 27, 1984, as amended. Motion declared cadried 3. POLICE DEPARTMENT McRae Seminar Moved by Reiser, seconded by Scherer to authorize Jill McRae to atten a "Police Use Of Deadly Force" seminar, April 16-17 at a fee of $90.00. Motion declared carried Holy Name Dr. Speed Limit Michael Sankey stated that he had calculated the number of houses and the length of Holy Name Dr. and could not meet the requirements to declare it an urban district so that the speed limit could be lowered. Citizen Commendation Moved by Heideman, seconded by Scherer to present a letter of commendation to Kevin Carroll and Michael Kuhn, employees of the Pizza Factory, who had saved the lives of two people in an automobile fire on Hwy. 55. Motion declared carried Police Chiefs Convention Prizes Michael Sankey stated that he had won a police car light bar and a deer rifle at the Police Chiefs convention; that he would be keeping the rifle as it could not be used for police purposes and that he would be turning the light bar over to the city but would be asking the City Clerk to sign a release so that he could use the release for tax purposes. 4. PUBLIC WORKS DEPARTMENT Hamel Sewer James Dillman reported that the Hamel sewer pumps had been pumping continuously at over lmgpd and that the capacity of the planned interceptor is 1.05 mgpd. Thomas Anderson stated that he would like to use Community Development Block Grant funds toward correcting the infiltration problems and he asked that Jim Dillman and the City Engineer prepare a plan and cost estimate to repair the system, so that a public hearing could be scheduled. Safety Program James Dillman reported that Medina's Worker's Compensation Carrier had gone over the "Right to Know" law with himself and the Chief of Police and he explained that he would like Council approval to set up a safety program and to purchase the necessary safety equipment, at an approximate cost of $4000. Michael Sankey stated that Medina may be required to supply a fact sheet to employees for many products included on the hazardous materials list, including such things as 0JUU40 cleansers and paint. Thomas Anderson stated that Jim Dillman should prepare a list of costs for the safety equip- ment and to wait before beginning a project to supply information on all hazardous materials. She also presented a list of low bidders in each category. PLANNING AND ZONING DEPARTMENT John Spaeth, Variance JoEllen Hurr reviewed variance application and Planning Commission recommendations regard- ing construction of decks on residences located on Lots 4,5,6 & 7, Dockside owned by John Spaeth. Attorney, Eileen Roberts, representing Mr. Spaeth, stated that other owners in the Lake Independence area had been granted variances to build decks and that the city had recog- nized the size and shape of this property when prior variances had been granted. Thomas Crosby asked if Ms. Roberts believed that Lots 4 and 5 were entitled to permits. Ms. Roberts stated that she believed that they were and that she could find no basis for not allowing decks to be built, in any city ordinance. JoEllen HUrr stated that she believed that all variances that were to be granted were given at time agreements were prepared and signed by the city and Mr. Spaeth. Thomas Crosby asked what they intended in their letter of March 30th, regarding right to challenge bill that had been presented by the city. Ms. Roberts stated that the letter referred to charges in connection with Mr. Spaeth's earlier approval. Mr. Crosby asked how they related the leeter to the statement which was signed by Mr. Spaeth on February 13th agreeing to pay expenses incurred by the city in connection with processing his application. Ms. Roberts stated that Mr. Spaeth had been required to sign the statement before he was allowed to appear before the Planning Commission regarding his application for variances. She also stated that an itemized bill had not been sent. Ms. Hurr stated that she had verbally gone over the entire bill with Mr. Spaeth. Moved by Crosby, seconded by Heideman to request the city attorney to advise Council, for the April 17th meeting, as to whether or not the Council has the ability to deny Mr. Spaeths application based on the posistion taken by Ms. Roberts that Lots 4 and 5 meet requirements for setbacks and that Lots 6 and 7 were included in the original agreements with Mr. Spaeth. Motion declared carried Larry Herrboldt, Subdivision JoEllen Hurr explained Mr. Herrboldt's application to subdivide 14.53 acres on Hwy. 12 into two, 2 acre lots and two Outlots. Outlot A for future subdivision and Outlot B, a 60 ft. driveway for access to Outlot A. She reported that the Planning Commission had recommended approval of the subdivision upon payment of a park dedication fee and receipt of a letter from the State Highway Department approving of the entrance. Moved by Heideman, seconded by Scherer to grant preliminary approval to the Herrboldt sub- division pending receipt of a park dedication fee on each of the two acre parcels and receipt of a letter from the State Highway Department approving of the entrance to the property. Motion declared carried Gary Hertzfeldt, Conditional Use Permit Moved by Heideman, seconded by Scherer to table the Hertzfeldt matter until April 17th due to the fact that Mr. Hertzfeldt has not submitted final plans. Motion declared carried u00043 Bernard Roskop, Subdivision and Variance JoEllen Hurr presented information regarding Mr. acres from his property at 3082 Hwy. 55. She stated that the property is zoned Commercial septic system soil with no possibility of adding soils are not acceptable for septic systems. She stated that the Planning Commission had recommended approval upon payment of a park dedication fee and combination of the easterly lot with the remainder of this parcel. Moved by Scherer, seconded by Reiser to grant subdivision approval to Bernard Roskop to subdivide 6.76 acres from additional acreage at 3082 Hwy. 55 subject to receipt of a park dedication fee, combining the easterly lot with the remainder of the property and securing a 30 ft. right of way on Rolling Hills Rd. Hardship for variance being the shape of the lot. Motion declared carried Roskop's application to subdivide 6.76 and that there is 3.31 acres of innovative additional acreage to the parcel as other Ben Leuer/Fritz Gullickson Subdivision JoEllen Hurr explained that the Leuer's propose to subdivide 50+ acres into three lots plus the homestead. She stated that they wish the parcel south of Medina Rd. remain with the homestead north of the road. Richard Schieffer stated that the city takes an easement for road purposes and an owner retains ownership of the property under a street. One condition of approval should be the fact that property to the south cannot be subdivided unless it meets city ordiances as separation by a road easement cannot be justification for subdivision. Tim Shields, Attorney representing Ben Leuer, stated that hsi client would have no problem having a reviewal when they wished to sell the parcel to the south. Thomas Crosby related what the city assessor had explained regarding Green Acres classifi- cation on separate parcels and the tax structure on. subdivided property. Richard Schieffer stated that the road easement would need to be surveyed. Moved by Crosby, seconded by Heideman to grant preliminary subdivision approval for the Ben Leuer property, 242 Medina Rd., for three lots plus the homestead; that the 5 acres north and 8 acres south of Medina Rd. be considered one lot but that in the future the existance of the 60 ft. road easement shall not be used as a hardship for subdivision; also the right-of-way on all roads should be secured. Motion declared carried Raskob Brothers Septic System Patricia Raskob stated that their engineer had provided them with a design for a conventional septic system on Tract D, Registered Land Survey 239 but that if the cities septic ordinance is changed they would then construct a mound system on Tract E. Landfill Zoning Change JoEllen Hurr explained that the ordinance change had been approved by Woodlake and that the Planning Commission had asked that 12 years from date ordinance is adopted be the time limitation. Moved by Reiser, seconded by Crosby to adopt Ordinance No. 209, amending the zoning ordin- ance regarding landfills with language regarding time limit of 12 years versus the date to be decided by the city attorney. Motion declared carried Alpana Aluminum Joellen Hurr reported that some changes in the legal description was needed as it relates to a cartway on the property and that the city might be able to secure a 60 ft. x 60 ft. area along Hwy. 55 that will be used for stop sign installation purposes. Moved by Scherer, seconded by Heideman to table action on the Alpana Aluminum subdivision. Motion declared carried Seminar Moved by Reiser, seconded by Heideman to authorize JoEllen Hurr to attend a Groundwater and Waste disposal seminar on April 25th at a fee of $40.00. Motion declared carried 6. LAKESHORE MANAGEMENT SEMINAR Anne Theis thanked Council for allowing her to attend the Lakeshore Management Seminar and stated that they had an excellant slide presentation on the Elm Creek Watershed Commission and how they work with projects brought before them. She suggested that the city might be able to secure copies of the slides for city use. U09Ui9 7. LAKE INDEPENDENCE DRAINAGE PROBLEMS Anne Thies asked what had happended with the HRA and correcting drainage problems on lots that she owns and abut hers at Independence Beach. She stated that she had been told that the assessments could not be removed and that one half of them have already been paid and she could not use the property because it is under water. She stated that the assessor and building inspector had inspected the property and told her that if the area could be dug out and refilled perhaps it could be built upon with the use of stress footings but that the drainage problems of the entire area would need to be corrected. Thomas Anderson asked that Glen Cook submit a report for the A ril 17th meeting. Richard Schieffer suggested that the drainage problem be ea " ` so that a determination could be made regarding whether or not lots in the area could be built upon. Council asked that the item be put on the April 17th agenda. 8. WORKER'S COMPENSATION INSURANCE Moved by Reiser, seconded by Heideman to adopt Resolution 84-8, inclusion of the City Coun- cil under the cities Worker's Compensation Insurance program. Motion declared carried. Voting No -Anderson 9. HERITAGE PRESERVATION ORDINANCE Wilfred Scherer stated that at the present time there are no buildings being suggested for preservation but that some time in the future something may arise that the city might wish to have preserved. Richard Schieffer stated that the city would need to purchase a property if an owner re- fused to preserve a building that the city wished to have preserved. Moved by Heideman, seconded by crosby to adopt Ordinance No. 210, Heritage Preservation. Motion declared carried 10. ORLO EISINGER, PERA Council discussed memo prepared by Attorney Dayle Nolan advising that the city not pay int- erest on Orlo Eisinger's PERA because she interprets a statute of limitations clause in State Statute 353.27, sub. 12 applies in this case Donna Roehl stated that she believed the city was obligated to pay because he had some rights because of prior payment by the city. Moved by Scherer, seconded by Reiser to deny payment of the Orlo Eisinger PERA in accord- ance with City Attorneys opinion and to forward a copy of the opinion to PERA. Motion declared carried 11. WASTE ADVISORY COMMITTEE Thomas Anderson asked that Clerk contact Leonard Leuer to find out if he would be interested in serving on the Hennepin County Waste Advisory Committee. 12. BILLS Thomas Crosby explained that the bill in the amount of $1740 to Briggs and Morgan was the balance remaining in city funds that had been collected from the Concerned Citizens. He stated that Dick Nowlin had told him that BFI might possibly make a contribution toward the fund but that he personally would talk with BFI regarding the remainder of the bill. Moved by Heideman, seconded by Reiser to pay the bills; Order Checks # 2801-2860 in the amount of $76,243.25 and Payroll Checks #7609-7632 in the amount of $11,490.32. Motion declared carried o00050 13. COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION Thomas Anderson stated that he believed that the Hamel sewer infiltration could be con- sidered an emergency situation for application purposes as the Hamel area is the only area in the city that might support low and moderate income housing and would need sewer to do so. He suggested that the following amounts be included in the cities application for Year K funding: Base City Mapping--$1000; Rehab--$4000; Adminstration--$3000; Hamel Sewer Repair--$10,070. Moved by Crosby, seconded by Reiser to make application for Community Development Block Grant Funds according to Mayor Anderson's suggestions. Motion declared carried Moved by Heideman, seconded by Scherer to hold a public hearing on May 1, 1984 to con- sider reprogramming remaining funds from Year VIII Community Development Block Grant program.
