HomeMy Public PortalAbout1991_12_18SPECIAL MEETING MINUTES OF THE LEESBURG TOWN COUNCIL DECEMBER 18, 1991 A special meeting of the Leesburg Town Council was held on December 18, 1991, at 5:30 p.m., in the first floor, Executive Conference room, 25 West Market Street~ Leesburg, Virginia, pursuant to notice having been delivered to all councilmembers prior thereto. The meeting was called to order by the Mayor. ROLL CALL COUNCILMEMBERS PRESENT Georgia W. Bange James E. Clem Christine M. Forester Donald A. Kimball Claxton E. Lovin William F. Webb Mayor Robert E. Sevila MOTION Mrs. Forester made the following motion: Pursuant to Section 2.1-344 of the 1950 Code of Virginia, as amended, I move that the Town Council of the Town of Leesburg convene in Executive Session. The authority for this Executive Session is found in Section 2.1-344(a), Subsection (1), of the 1950 Code of Virginia, as amended. The purpose for this Executive Session is: To discuss the town's health insurance benefits for specific retiring town employees. To conduct interviews for appointments to the Town Plan Citizens Advisory Committee. To conduct interviews for appointment to the Environmental Advisory Commission. The motion was seconded by Mr. Lovin. VOTE Aye: Councilmembers Bange, Clem, Forester, Kimball, Lovin, Webb and Mayor Sevila Nay: None MOTION Mr. Lovin made the following motion: I move that the Executive Session be adjourned, that the Town Council of the Town of Leesburg reconvene its public meeting and that the minutes of the public meeting reflect that no formal action was taken in the Executive Session. The motion was seconded by Mrs. Forester. VOTE Aye: Councilmembers Clem, Forester, Kimball, Lovin, Webb and Mayor Sevila Nay: None Absent: Bange MOTION On motion of Mr. Lovin, seconded by Mr. Clem, the following resolution was proposed and unanimously adopted. 91-281 - RESOLUTION - CERTIFYING EXECUTIVE SESSION OF DECEMBER 18, 1991 WHEREAS, the Town Council of the Town of Leesburg has this day convened in Executive Session in accordance with an affirmative recorded vote of the Town Council of the Town of Leesburg and in accordance with the provisions of the Virginia Freedom of Information Act: NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Leesburg does hereby certify that to the best of each member's knowledge, 1) only public business matters lawfully exempted from open meeting requirements under the Freedom of Information Act were discussed in the Executive Session to which this certification applies; and 2) only such public business matters as were identified in the Motion by which the said Executive Session was convened were heard, discussed or considered by the Town Council of the Town of Leesburg. Special meeting minutes of December 18, 1991 VOTE Aye: Councilmembers Clem, Forester, Kimball, Lovin, Webb and Mayor Sevila Nay: None Absent: Bange MOTION On motion of Mr. Lovin, seconded by Mr. Webb, the following ordinance was proposed and unanimously adopted. 91-0-59 - ORDINANCE - AMENDING SECTION 12.1-47 OF THE TOWN CODE TO ADD HEALTH INSURANCE BENEFITS FOR RETIRING TOWN EMPLOYEES UNDER THE AGE OF 65 WITH FIFTEEN OR MORE YEARS OF SERVICE WHEREAS, town employees who retire before the age of 65 are currently not eligible for the town's group health insurance; and WHEREAS, because of the high cost of health insurance, town employees eligible to retire are discouraged from retiring until they reach age 65; and WHEREAS, the cost of keeping eligible retirees on the town's group health insurance plan would be offset by lower payroll costs; and WHEREAS, retirees aged 65 and over are eligible for medicare benefits which substantially lower the out-of-pocket expense for health insurance. THEREFORE, ORDAINED by the Town Council of the Town of Leesburg in Virginia as follows: SECTION I. Section 12.1-47. Hospitalization and Insurance of the Town Code and Personnel Manual is hereby amended to read as follows: Section 12.1-47 Hospitalization and Insurance. (a) All employees of the town, unless provided otherwise by these rules, are required to participate in group life, basic hospital/surgical-medical, major medical and disability income programs as approved by the Town Council. The town shall pay all of the total monthly individual premiums for said coverage described above. The individual employee shall pay the additional hospitalization premiums for the spouse, family or other dependent coverage when a coverage is requested by the employee. (b) Employees retiring from the town prior to December 31, 1992, with 15 years of town service shall be eligible to participate in the town's group health insurance until age 65 at which time they shall be dropped from coverage. Retired employees participating in the plan shall be required to pay one-half of the monthly individual health insurance premium and all of the additional premium for spouse, family or other dependent coverage as requested by the retiree. The town contribution shall not exceed $200.00/month per retiree. SECTION II. This ordinance amendment shall be effective upon passage. VOTE Aye: Councilmembers Clem, Forester, Kimball, Lovin, Webb and Mayor Sevila Nay: None Absent: Bange MOTION On motion of Mrs. Forester, seconded by Mr. Lovin, the following resolution was proposed and unanimously adopted. 91-282 - RESOLUTION - MAKING APPOINTMENTS TO THE TOWN PLAN AMENDMENT CITIZENS ADVISORY COMMITTEE WHEREAS, on October 22, 1991 the Town Council adopted Resolution No. 91-236 which initiates review and amendment of the 1986 Town Plan; and WHEREAS, the review process includes the participation of a Town Plan Amendment Citizens Advisory Committee; and WHE~, an advertisement was placed in the Loudoun Times-Mirror to solicit citizens/individuals, from the business community, development/engineering community and legal community, interested in serving on this committee; and Special meeting minutes of December 18, 1991 WHEREAS, it is the Council's desire to also appoint two members of the Leesburg Planning Commission and two members of the Town Council: THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: The following individuals are appointed to the Town Plan Amendment Citizens Advisory Committee: Robert Altland Barbara Anderson Stephen Axeman Michael Banzhaf - John Harris Karen Jewell Chuck Jones Klm Jordan Eric Mullis Joseph Paciulli William F. Webb Rocky Westfall (1) EDAC member to be designated by the EDAC. VOTE Aye: Councilmembers Clem, Forester, Kimball, Lovin, Webb and Mayor Sevila Nay: None Absent: Bange MOTION On motion of Mrs. Forester, Seconded by Mr. Kimball, the following resolution was proposed and unanimously adopted. 91-283 - RESOLUTION - MAKING AN APPOINTMENT TO THE ENVIRONMENTAL ADVISORY COMMISSION WHEREAS, a vacancy exists on the Environmental Advisory Commission (EAC) due to the resignation of Donald Devine; and WHEREAS, the vacancy on the EAC was advertised in the Loudoun Times-Mirror. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: Peter Gillwald is appointed to the Environmental Advisory Commission to fill the unexpired term of Don Devine. The term of office to expire on April 30, 1992.
