APPROVING WORKERS' COMPENSATION SETTLEMENT-CLAIM
PETITION #2003-9808 ·
WHEREAS, Susan Godecki ("Petitioner") has filed a .workers' compensation
permanency claim against the Borough under Claim Petition #2003-9808; and
WHEREAS, the Borough and Petitioner have entered into settlement negotiations
with regard to the above-referenced matter which have resulted in a proposed
settlement; and
WHEREAS, the governing body has reviewed the terms of the proposed settlement
with legal counsel and have deemed it advisable and in the public interest to settle
the claim pursuant to the said terms without incurring the cost and expense of a trial
on the matter.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council o? the Borough
of Carteret, County of Middlesex, State of New Jersey as follows:
1. That legal counsel for the Borough is hereby authorized to take
the necessary action before the Workers' Compensation Court,
Middlesex County to settle Claim Petition #2003-9808, filed
by Susan Godecki, for approximately 15.5% 0f partial total
disability at the 2002 rates, plus costs and expens6s as set by
the compensation judge.
2. That a certified copy of this Resolution be forwarded to Allied
Risk, the Borough's workers' compensation administrator,
Peter J. Barnes III, Esq., the Borough's special counsel, in this
matter, and the Borough's Finance Department lo take any
required action to implement the terms hereof.
