ORDINANCE 2007 -7
® AN ORDINANCE AMENDING SECTIONS 9 -21, 9 -27, AND 6 -99, OF THE
GREENCASTLE CITY CODE REGARDING UNCLAIMED UTILITY DEPOSITS
WHEREAS, the City of Greencastle collects deposits for customers obtaining water, sewer
and trash utility accounts.
WHEREAS, utility deposits are provided for in the following sections of the Greencastle City
e in
Water Section 9 -21
Sewer Section 9 -27
Trash Section 6 -99
WHEREAS, the City does not have a written policy for deposits that are unclaimed after a
customer's service is terminated.
NOW THEREFORE be it ordained by the Common Council of the City of Greencastle that it
hereby amends Sections 9 -21, 9 -27 and 6 -99 of the Greencastle City Code by adding the following
subsection to each of the above sections:
Section 9 -21 d.
o A deposit made that has remained unclaimed by the customer for more than sixty (60) days
after the termination of the customer's water service shall b ecome t he p roperty o f t he
municipality. If a customer comes back to the utility office at a later date, and can prove that
he /she is owed the deposit, the utility office will return the deposit to the customer.
Section 9 -27 d.
A deposit made that has remained unclaimed by the customer for more than seven (7) years
after t he t ermination o f t he c ustomer's s ewer s ervice s hall b ecome t he property of the
municipality. If a customer comes back to the utility office at a later date, and can prove that
he /she is owed the deposit, the utility office will return the deposit to the customer.
Section 6 -99 d.
A deposit made that has remained unclaimed by the customer for more than sixty (60) days
after the termination of the customer's trash service shall become the property of the
municipality. If a customercomes back to the utility office at a later date, and can prove that
he /she is owed the deposit, the utility office will return the deposit to the customer.
This Ordinance shall have full force and effect upon passage of the Greencastle Common
Council and its approval by the Mayor.
