1998 -03 -26 City Council Minutes
Mayor Pro Tem Donald E. Anderson, Jr. called the March 26, 1998 meeting to order at
7:30 P.M. with the following members of Council present: Ed Merves, Jack Youmans, Anne P.
Monaghan, Michael A. Hosti, and Mallory Pearce. Mayor Walter Parker was in Washington with
the Savannah Area Chamber of Commerce. City Attorney Edward Hughes was present to guide
the Council on legal issues.
Councilmember Merves gave the invocation, followed by the Pledge of Allegiance.
Mr.Tom Smith who requested to be placed on the agenda as a visitor was not present.
Rachel Perkins addressed Council concerning the City selling and swapping land without
a public notice to the citizens. Youmans said that the old Charter stated that Council was
empowered to buy and sell property of no value to the City. Perkins said that she believes that the
property is of tremendous future value to the City. Youmans stated that there was no access to the
property. Perkins said that she had done a study of areas of critical concern for the grant from the
Ecology Committee of the Savannah Presbytery Monaghan asked the name of the study. Perkins
said that the study is in City Hall and it is named Public Education in Ecology - Areas of Critical
Concern. City Attorney Hughes said that nothing concrete has been done - nothing swapped or
sold yet.
Mayor Pro Tem Anderson opened the meeting for business legally presented.
Pearce moved to pay the February bills. Monaghan seconded. Vote by Council was
unanimous. Pearce moved to adopt the minutes as written. Monaghan seconded. Vote by Council
was unanimous.
Pearce stated that he is concerned about the memo from Zoning Administrator Byers
about North Waves subdivision and the wording that is to be written on the recorded plat. Pearce
moved that Ms.Byers appear before council to clarify this concern. Monaghan seconded. Vote by
Council was 4 in favor (Merves, Monaghan, Hosti, Pearce); 1 opposed (Youmans).
Youmans gave a summary of the beach renourishment concerning the crossovers placed
over the dunes for protection. Since we have crossovers we need to have parking for tourists and
residents. There is a 60 X 90 foot area that was designated for parking. Youmans said he spoke
with City Manager Farmer and there is a memo dated March 26, 1998 that he moves for adoption.
Hosti seconded. Vote by Council was unanimous. Youmans asked that Farmer get started on this
immediately. Merves asked about the paving of the Museum. Fanner said that if DOT modifies
the specifications the contractor said thy could pave the following week.
Youmans moved that Council table the Memo of Agreement with the Corps of Engineers
for the Fast Track Schedule for Beach Renourishment. Hosti seconded. Youmans stated that
Farmer and Parker are working on this and he would like to see the groins in place before any
sand is pumped. Vote By Council was unanimous.
Farmer said that Chief Jim Price is trying to locate a traffic engineer to help with the
traffic study of the entire island, speed limits, stop signs and traffic flow. Farmer said that the 25
MPH speed signs have been ordered for Jones Avenue and that Price has received approval for the
City to use radar on Jones Avenue. Youmans said that he had read a memo from Farmer about
Superintendent William Pye getting bids for the stripping of the double yellow lines on Jones.
Farmer said that No Passing Signs will be placed under the speed limit signs.
Hosti asked Farmer if this new wage scale and classification information is the same one
from January and does it just reflect the COLA for the employees? Farmer said it reflects one new
job description in parking and the COLA and several changes from the one from a year ago.

Youmans moved for adoption and Pearce seconded. Merves asked if there are any hidden costs.
Farmer explained about the changes in the classifications of some jobs by separating them into
two. Youmans asked if there are any raises in the scale other than the COLA raise in January.
Farmer said no. Vote by Council was unanimous.
Pearce moved to adopt Section 6 -1 -10 Tapping/Stubbing fees, meters on its second
reading. Monaghan seconded. Vote by Council was 4 in favor (Merves, Monaghan, Hosti,
Pearce); 1 opposed (Youmans).
Farmer said that the statistical reports from the different departments are in your packet
for information only. Merves said that he has a question about the 8 and under ball team. Farmer
said that each councihnember has new information that was placed in their box late this afternoon.
Farmer said that the City will purchase the uniforms for the Tybee sponsored teams.
Youmans moved to adopt Section 5 -2 -23 (A) & (D) on its first reading with one change
that would be to remove the sentence "Multiple dwelling complexes may be supplied with fewer
than one rollout container per unit, as determined by the City Manager." under paragraph (A).
Merves seconded. Farmer said that we are losing money on each billing if they do not need the
extra carts. Merves withdrew his second. Hughes said that this is on the first reading. Vote by
Council was 2 in favor (Youmans, Hosti); 3 opposed (Merves, Monaghan, Pearce). Pearce moved
to adopt as written. Monaghan seconded. Vote by Council was 3 in favor (Merves, Monaghan,
Pearce); 3 opposed (Youmans, Anderson, Hosti). City Attorney Hughes said that no action is
taken on this ordinance.
Pearce moved to approve Section 6 -1 -11 (g) meters on its first reading Monaghan
seconded. Farmer stated that this paragraph is designed to get around people selling units without
getting a Certificate of Occupancy. Vote by Council was unanimous.
Hughes read Section 7 -2 -1 City Facility Use for its first reading. Hosti stated that he
thinks Council made a mistake by asking Tybee residents to pay a booking fee - maybe a $50.00
deposit. Monaghan said that this ordinance is very difficult to read. Monaghan said that a group of
residents have renovated the Community House stating that it needs to be spelled out who is going
to inspect the buildings. Monaghan said that a very responsible person with a check list should do
this job, like the City Marshal. Merves agrees that the facility needs to be checked before the next
person uses it, some kind of accountability is needed. Hosti said that we don't know who leaves the
messes. Youmans said that it would only take about 5 minutes each morning to check the
Community House. Pearce moved to adopt on first reading. Hosti seconded. Youmans asked
Hughes if he had to have a written policy in front of Council in order to adopt because he feels like
a policy is definitely needed. Vote on the motion was 4 in favor (Merves, Hosti, Anderson,
Pearce); 2 opposed (Youmans, Monaghan). Youmans moved for a written policy concerning the
inspection of the facility after each use. Monaghan seconded. Vote by Council was unanimous.
Hosti requested that Section 6 -1 -10 be brought back for discussion concerning the cost for
a water meter for sprinkler or watering garden only. Youmans said that we should do away with
letting people purchase a meter for watering of the grass or the garden since we have problems.
Hughes explained the McCusker property between 15th Street and Atlantic Avenue
stating that there is a roadway showing on the plat, Hughes said that the McCuskers' need an
affidavit from the Clerk of Council stating that the City has no interest in the property or the
roadway.
Youmans moved to go into executive session to discuss litigation. Monaghan seconded.
Vote by Council was unanimous.
Anderson reconvened the regular meeting.
Farmer explained the sewer problem at Lift Station # 3 stating that it has failed and that
we are now on by pass pumps. Authorization for the design work was approved at the last Council
meeting. The cost for the construction work will be in the $30 to $40 thousand dollar range.
Youmans moved to approve the construction work and that it will be paid by funding out of the
SPLOST funds. Pearce seconded. Youmans said that we had already approved using SPLOST
funds to get us up to par in the water and sewer department and all was to be paid by the SPLOST
funding. Farmer said that we can have a GEFA loan that is readily available within a week. This
loan will be paid back with SPLOST funds. Mayor Pro Tem Anderson adjourned the meeting at
8:47 P.M.

It is hereby ordained by the governing authority of the City of Tybee Island, in open meeting
assembled, that the Tybee Island Code of Ordinances, Title ( Chapter 1 , Section L),

[Amending 6 -1 -10 Tapping/stubbing fees, meters.]
Water tapping and sewer stubbing fees for a water consumer will be based on the following
formula. The fee shall cover the cost of the meter and inspection of installation of same. Actual
installation of both lines and meter shall be the responsibility of the applicant. This tappingand
stubbing fee is payable in advance.

The cost for a water meter for sprinkler systems, swimming pools,etc. shall be based on the size
of meter deemed necessary by the Water and Sewer department supervisor and/or his designee.
The following rates cover the cost of the meter only. The property owner is responsible for both
installation of meter and running of necessary lines.
