HomeMy Public PortalAbout19980528CCMeeting1 1998 -05 -28 City Council Minutes Mayor Walter W. Parker called the May 28, 1998 City Council meeting to order at 7:30 P.M. The following members of Council were present: Ed Merves, Jack Youmans, Anne Monaghan, Donald E. Anderson, Jr., Michael A. Hosti, and Mallory Pearce. City Attorney Edward Hughes was present to give legal advise to the Council, on issues coining before them during the meeting. The Pledge of Allegiance was recited following the invocation given by Reverend Lee Bennett. Mayor Parker said that he would like to take a minute to address a letter to the editor concerning Mayor and Council not attending the Reception for the Accredition of the Police Department. Mayor Parker said that the City policy is to coordinate programs that are important to the City. For two month Jack Youmans, Rowena Fripp and myself have been registered for a GMA seminar out of town. Hosti said that he was in New Orleans on Fort Pulaski business. Monaghan said that she wrote a note to the Police Department explaining that she would be out of town. Merves said that he was a his sons' baseball game and then attended a ceremony for his daughter. Mayor Parker read a few letters form Bartow Elementary School stating that the beach was clean and calling Tybee the trash busters. Mr. Bernie Goode said that he and his wife were appalled at the amount of trash on the beach when they were out walking one morning. They went back home to get bags and by the time they returned to the beach DPW had already picked up the trash. Mayor Parker said that there was more trash on the beach from Memorial Day weekend than from the Crush or the Bums the prior weekend according to Billy Pye, Director of DPW. City Marshall Chuck Bargeron presented Council with the results of a request for bids for the replacement of the windows and doors at City Hall. Bargeron said that specs where sent to 18 companies and he had 7 to 8 replies. Ynmans said that the information is dated May 28th and we have an agreement that nothing is placed on the agenda after noon Friday prior to the Council meetings. Bargeron said the bids ranged from $9,000 to $21,000. Nulite and Odum are top of the line windows, they are compatible, the bid covers the removal and the installation of the windows and doors. If there is any problem such as rotten wood or termites then the City would be responsible for the materials to correct the problems, the City would also have to pay the extra labor costs. It would take 3 to 5 days for the installation of 31 windows and 3 fire doors. The bids were $10,423. from Nulite and $9,068.86 from Odum. Mayor Parker said that this subject was for information only. Mayor Parker opened the meeting for business legally presented. Merves moved to accept the minutes of the May 14th meeting as written. Pearce seconded. Vote by Council was unanimous. Angela Byers explained the contract renewal to Council from Waste Management. The costs per month will increase from 11.98 to 12.50 per cart. Byers said that City Manager Farmer changes the wording concerning private drives. Waste management will not be going down the private drives because of the liability involved. The City will notify all property owners that Waste management will pick up carts within 25 feet of Butler Avenue at a central location. The property owner will have to meet and determine that location. Size of dry trash piles is set in the contract, palm fronds will be staked by 3's and placed by the rollout carts. Byers mentioned that Salt Pines approached her about having a dumpster instead of the individual roll out carts. Salt Pines would pay for the dumpster. Youmans questioned if the City should pay for half the cost of the dumpster. Byers said that the charge on the water bill is for cart rental, not on garbage charge . If you have no cart then you would not be billed on water bill. byers said that the key is enforcement. Merves asked about white and brown goods. Byers said that residents would have to pay to have items hauled off. Merves asked if residents could take to DPW. Byers answered yes. Monaghan asked how this information would be communicated to the public. Byers said that she would mail letters to private drive property owners, would also meet with residents, an article in the Tybee News, plus a notice in the mass mailing for the ISO rating. People in violation would receive a form letter and then court if problem is not corrected. Monaghan moved to accept the contract with Waste Management. Pearce seconded. Vote by Council was 5 in favor (Merves, Monaghan, Anderson, Hosti, Pearce); 1 opposed (Youmans) Pearce moved to accept Section 5 -2-4 (d) Storage of Yard Trimmings on its first reading with the wording from the Waste Management contract (B)(B)(2). Monaghan seconded. Merves asked if you can put yard clippings in the carts. Byers answered no, but you would be surprised at what is place in the carts. Vote by Council was unanimous. 1 1 Pearce moved to approve Section 5 -2-4 Building waste - accumulation prohibited on its first reading. Monaghan seconded. Vote by Council was unanimous. Youmans said that any action on Section 9 -5 -1 Beach rules and regulations is illegal because he asked to table until the exact city limits were on a map. Parker said that there is a map with dotted lines showing the city limits. Pearce moved to adopt Section 9 -5 -1 Beach rules and regulations on its first reading. Monaghan seconded. Hosti questioned the disorderly court charge of $145.00 against the charge of littering for $437.50. Monaghan said that it is a wild dollar amount. Fines need to be posted on signs in order to educate the public. Farmer said that figures would be put on signs and publicized, the figures were estimated by court judge.Merves stated that he does not think it is a good idea that lifeguards can issue tickets or citations. Farmer said that the only change before Council is putting the fine amounts in the ordinance that way City Council estimates fine instead of the court estimate them. Merves said that he would like to hear from the Chief because at the last Council meeting Price gave the impression that he was against lifeguards writing tickets or issuing citations. Youmans agreed with Merves about holding up until we hear from Chief Price because young kids are working as lifeguards males and females. . Merves asked for an amendment to the ordinance by taking out the word lifeguard. Pearce agreed to the amendment. Vote on the amendment was unanimous. Farmer stated that young people are writing parking tickets. Parker said that lifeguards should not be tied up with citations they should be watching the swimmers. Merves said that there is a big difference. Monaghan questioned the City Marshall? Bargeron said that he is duly deputized and has arrest powers. Vote on the main motion was unanimous. Parker said that we do need to look at the fees. Monaghan suggested a small committee from Council. Parker appointed Mona. halt, Hosti and Anderson. Parker said that Judge Scheer needs input. Mayor Parker requested that the Resolution for Savannah Harbor Expansion Project be placed on the June 11th agenda. Council agreed to his request. Farmer explained the agreement concerning appraisal and survey of lands for Tybee Island beach renourishment with the Corps of Engineers stating that Tybee would have to put $15,800. up front but later on the City would get a share back. Youmans said that the City still needs to wait until we have assurance on 2nd Street. Parker answered that this has no bearing on 2nd Street. Hughes stated that the land acquisition for any project concerning 2nd Street has already been completed with the 1st renourishment and that this has not been done on the Back River. Hughes said that we need to get started now and he would like the authority to meet with the Corps to get his end of the project started so that we will not be behind, because then the Corps would have to wait on Tybee. to acquire. Hosti asked Hughes if he was making sure that the sand can be pumped on the beach. Hughes said before sand we need to make sure no problems exist and he understands that all property owners in the area are in agreement. Pearce moved to allow Hughes to meet with the Corps. Monaghan seconded. Vote by Council was 5 in favor (Nerves, Monaghan, Anderson, Hosti, Pearce); 1 opposed (Youmans) Farmer said that the Corps hope to do the groins at 2nd Street and the Back River at the same time, trying to avoid storm damage in the winter. Mayor said that Representative Jack Kingston is trying to push through 1.5 million for more sand and is also working with Georgia Ports Authority for more sand. It was noted that the ordinance for an amendment to the Land Development Code was going to be advertised for a public hearing at the June 11, 1998 Council meeting. Pearce said that it is an excellent ordinance on the telecommunication but that there is no mention of heights. Can we limit the height? Hughes answered saying that the City can not set an arbitrary height limit. Byers said\id that 180 feet is standard. Pearce moved to approve a grant to the Rape Crisis Center in the amount of 5500.00. Monaghan seconded. Vote by Council was unanimous. Pearce moved to adopt a proclamation for National Management Week. Hosti seconded. Vote by Council was unanimous. Hosti request that Council hold off on any decision for the closing of a portion of Solomon Avenue until the City Attorney can research it fully. Mr. George Wand of the Chinese American Association of the United States is requesting that Tybee Island consider becoming the sister city to Wenzhou. Youmans said that he would like to see the 1 1 1 entire Council go visit not just the Mayor. Monaghan said that she would like to consider the town in France where some of the children who come and attend Saint Michael's as exchange students. Parker said that Mola Jung recommended that Mr. Wang contact the City Council. Pearce moved to adopt Section 2-4 -13 Leave Policies on its first reading. Monaghan seconded. Clerk of Council Brown explained the changes to the ordinance. Vote by Council was 5 in favor (Merves, Mona ' han, Anderson, Hosti, Pearce); 1 opposed (Youmans). Mayor parker said that the fire and police statistical reports were in the council packets. Being as there was no further business to come before Council the meeting was adjourned at 8:32 P.M. PARKER, MAYOR OF THE CITY OF TYBEE ISLAND, GEORGIA, DO HEREBY PROCLAIM THAT THE WEEK OF JUNE 1 THROUGH JUNE 5, BE RECOGNIZED AS "NATIONAL MANAGEMENT WEEK" ON TYBEE ISLAND, AND ENCOURAGE ALL CITIZENS TO JOIN THE GULFSTREAM MANAGEMENT ASSOCIATION IN PARTICIPATING IN THIS ANNUAL CELEBRATION OF MANAGEMENT WEEK IN AMERICA.
