HomeMy Public PortalAbout1993_05_01SPECIAL MEETING MINUTES OF THE LEESBURG TOWN COUNCIL JUNE 1, 1993 A special meeting of the Leesburg Town Council was held on June 1, 1993, at 5:00 p.m., in the Council Chambers, 25 West Market Street, Leesburg, Virginia. Notice having been delivered to all members of the Council prior thereto. The purpose of the meetingwas to receive a proposal from Catoctin Investment Corporation and to discuss the county government complex. The meeting was called to order by the Mayor. COUNCILMEMBERS PRESENT George F. Atwell (Absent) Georgia W. Bange Ronald W. Blake Joseph R. Trocino Kristen C. Umstattd William F. Webb Mayor James E. Clem STAFF MEMBERS PRESENT Town Manager Steven C. Brown Mr. Jeff. Zimmerman, representing Catoctin Investment Corporation, addressed the Council providing a synopsis of the proposals. He stated that Catoctin's proposal is to proceed with the Harding-Lawson investigation and to have the town's participation in this by funding the cost. The Harding-Lawson proposal totals $39,330.00 and they are ready to proceed. Councilmember Trocino asked what is meant by/is being implied by CIC vs. Town of Leesburg, Leesburg, Virginia? Mr. Zimmerman stated "we are in the superfund context - any reliable party under superfund who is a responsible party in the eyes of the law can pursue legal remedies by way of contribution claims against other liable parties to obtain reimbursement of the response costs incurred. It could come to pass that CIC might have to take such action against the town. We obviously prefer not to do that. ThE proposal being made is for a cooperative investigation with a suitable agreement that we will essentially remain friends during this investigation. Our objectives are the same and that is to find out what is there and if it is going any where and if it presents any problems - and to address them and deal with them. This is the nature of superfund. It is a process that if everyone is working cooperatively together it need not get that way." Mayor Clem stated that the Council needs to read the materials received today and take time to digest it and talk with the town's legal counsel. He stated that he has personally never been convinced that there is anything contaminant at the site in question. "I will have a lot of trouble swallowing this bill. It will need to be proven to me." This matter was referred to the town's legal counsel for review. The meeting was adjourned at 5:30 p.m. The Council readjourned at 6:30 p.m., in the first floor executive conference room to discuss the county government complex. MOTION On motion of, and duly seconded, the following motion was made: Pursuant to Section 2.1-344 of the 1950 Code of Virginia, as amended, I move that the LeesburgTown Council convene in Executive Session. The authority for this Executive Session is fi ,.md in Section 2.1-344(a), Subsection (3) of the 1950 Code of Virginia, as amended. The purpose of this Executive Session is to discuss the county government complex. VOTE Aye: Councilmembers Bange, Blake, Trocino, Umstattd, Webb and Mayor Clem Nay: None Absent: Atwell MOTION On motion of, and duly seconded the following motion was made: I move that the Executive Session be adjourned, that the Leesburg Town Council reconvene its public meeting and that the minutes of the public meeting reflect that no formal action was taken in the Executive Session. Aye: Councilmembers Bange, Blake, Trocino, Umstattd, Webb and Mayor Clem Nay: None Absent: Atwell MOTION On motion of, and duly seconded the following resolution was proposed and adopted: 93-109 - RESOLUTION - CERTIFYING EXECUTIVE SESSION OF JUNE I, 1993 WHEREAS, the Town Council of the Town of Leesburg, Virginia, has this day convened in Executive Session in accordance with an affirmative recorded vote of the Leesburg Town Council and in accordance with the provisions of the Virginia Freedom of Information Act: NOW, THEREFORE, BE IT RESOLVED that the Leesburg Town Council does hereby certify that to the best of each member's knowledge, 1) only public business matters lawfully exempted from open meeting requirements under the Freedom of Information Act were discussed in the Executive Session to which this certification applies; and 2) only such public business matters as were identified in the Motion by which the said Executive Session was convened were heard, discussed or considered by the Leesburg Town Council. ames E.
