A special meeting of the Leesburg Town Council was held on September 27, 1993, at 8:00 p.m., in
the seconded floor Councilmember's meeting room, 25 West Market Street. The purpose of the meetingwas
to discuss the Toll Road. Members of the media were notified. The meeting was called to order by Mayor
Clem.

MOTION
Councilmember Blake made the following motion.
We, the undersigned, being members of the Town Council of the Town of Leesburg, in Virginia, do
severally waive all statutory and Charter requirements as to notice of time, place and purpose of a special
meeting of the Leesburg Town Council, to be held on Monday, September 27, 1993 at 8:00 p.m., to be held
in the first floor executive conference room, 25 West Market Street, Leesburg, Virginia for the purpose of
discussing the Toll Road.
The motion was seconded by Councilmember Bange.

After some discussion, the following motion was made.
MOTION
On motion of Ms. Bange, seconded by Mr. Blake, the following resolution was proposed and adopted.
93-180 - RESOLUTION: AUTHORIZING AN AMENDMENT OF THE ESCROW AGREEMENT FOR
THE RECORDATION OF CERTAIN TOLL ROAD RELATED DOCLIMEN'I~
WHEREAS, the Town of Leesburg (Town) and the Toll Road Corporation of Virginia (TRCV)
executed an Implementation Agreement effective July 28, 1992, regarding installation and maintenance of
public improvements for the Town required by the construction of the Dulles Toll Road Extension to
Leesburg (DTRE) and public improvements related thereto; and
WHEREAS, the Town, TRCV and Real Title Company, Inc. entered into an Escrow Agreement
effective July 28, 1992, setting forth terms and conditions of escrow documents and release thereof which was
made a part of the Implementation Agreement; and
WHEREAS, the TRCV requested the Town Council waive a proyision of the Escrow Agreement to
allow the recordation of documents for certain properties in a timely fashion prior to closing on their
financing; and
WHEREAS, the timely acquisition of these vital properties is required to ensure the DTRE's success;
and
WHEREAS, the Town Council has historically encouraged the completion of the DTRE to serve as
an economic development asset for the town.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The following documents are hereby authorized to be released from escrow and
recorded and the escrow agreement shall be modified to reflect such release: Royco subdivision plats and
easements number 96, 89, 39 and the Ours subdivision plats and easement number 40.
SECTION II. The Mayor is authorized to sign a second amendment to the Escrow Agreement
reflecting such modifications referred to in Section I, in a form approved by the Town Attorney.
SECTION III. The remainder of the town's Implementation Agreement and Escrow Agreement with
TRCV shall remain in full force and effect and no construction shall begin on this property or any property
associated with the DTRE until the requisite bond and insurance policy are provided to the Town.
