Pursuant to the Provisions of Iowa Code 21.51 (1) (c)the council may choose to go into closed `session to discuss the possible purchase of certain Real Estate J. Pursuant to the Provisions of Iowa Code sec 21.5 ( 1 )the Council may hold a closed Session for discussion of possible litigation for collection of certain delinquent accounts And misappropriated funds. Delinquent Water Bills and Bad Meter Readings Regular City Council Meeting February 13, 2008 Mayor Royce Phillips called regular City Council meeting to order at 6:30pm at the Tiffin Fire Station Meeting Room. Present were Councilpersons James Bartels, Michael Gericke, Mark Petersen and John Wright. One seat vacant. Also present Attorney Steve Greenleaf, Engineer Mike Hart, Public Works Brett Mehmen and P&Z Melvin Reeve. No comments on Community Forum. Motion Wright and seconded by Bartels to approve January 9, 2008 minutes and to accept January 2008 receipts and expenditures. All Ayes. Motion by Wright and seconded by Petersen to not approve or accept the revised November 14, 2007, December 12, 2007 and January 2, 2008 minutes as published. Councilors instructed Clerk to revise these minutes, republish and make available for approval at March 12, 2008 City Council meeting. All Ayes. Laura Bergus from North Liberty presented information and handouts on Video Taping the City Council Meetings and possible methods of public viewing the tapes. Councilors will review materials and further research. Motion by Wright, seconded by Petersen to appoint the Iowa City Press Citizen as the newspaper of record for legal publishing. All Ayes. Motion by Gericke, seconded by Wright to allow Mayor and Clerk to obtain bids for lease agreements on office equipment with final approval by Council. All Ayes. Motion by Petersen, seconded by-Wright to publish in Community newsletter to solicit volunteers to design and,implement City of Tiffin website. All Ayes. Motion by Bartels, seconded by Wright to set Public Hearing for 2008-2009 Budget on March 12, 2008 Regular City Council meeting. All Ayes. Motion by Wright, seconded by Petersen to open Public Hearing for comments on repealing Ordinance 1985-133 Establishing Parks Commission. No comments. Motion by Wright, seconded by Petersen to close Public Hearing. Motion by Wright, seconded by Petersen to repeal current Ordinance 1985-133 Parks Commission to be replaced with the Ad Hoc Committee Parks, Recreation, Festivals, and Parks. All above actions were passed All Ayes. Discussion on Renewal of Building Inspector Tom Layetter contract tabled until March regular City Council meeting. Motion by Wright, seconded by Gericke. All ayes. Discussion by Council on Slim's request for Winter Volleyball Tournament on Saturday, March 8, 2008. Sheriff Department, Tiffin Fire Dept,Tiffin Public Works, and citizens voiced concerns on Safety, Parking, and Security. Motion by Petersen, seconded by Wright to further discuss with Owner of Slim's on the above mentioned concerns and possibly be available for a special City Council meeting on February 27, 2008. All Ayes. Motion by Gericke, seconded by Wright to approve second reading by title only on Ordinance 2008-290 on Oversized Metered Water Rates for all Zones. All Ayes. Tiffin Community Fund appointments tabled no applications available. • Motion by Wright, seconded by Petersen to approve revised 28E agreement with Clear Creek Amana School District with additional wording changes by Engineer and Attorney. Signed agreement will be forwarded to Superintendent Paula Vincent prior to the February 21, 2008 School Board Meeting. All Ayes. Mayor Phillips reported on inquiries made on the Johnson County Secondary Roads facility located on Railroad Avenue that will be available for purchase by the City of Tiffin in 2008. Discussion was held on four way stop signs at Goldfinch Dr and Roberts Ferry Rd intersection.._Citizens concerned on speed and safety. Council wants to review and discuss at later date. Council requested Clerk to continue action on City Audit. Councilperson Bartels reported on his progress of reviewing and selecting resumes for interviewing applicants to fill position for Deputy City Clerk. Motion by Wright, seconded by Petersen to close Open Session to enter into Closed Session pursuant to the provisions of Iowa Code 21.51 (1) ©to discuss pending litigation in the matter of Allen v. Tiffin,to discuss the possible purchase of certain Real Estate, and for discussion of possible litigation for collection of certain delinquent accounts and misappropriated funds. All Ayes. Motion by Wright, seconded by Bartels to close Closed Session and to open Open Session. All Ayes. Motion by Wright, seconded by Petersen to authorize Attorney to send correspondence to former Clerk Reihman to secure payment for unauthorized expenditure. Authorize Clerk Demuth to proceed with remedy solutions regarding outstanding utility bills. All Ayes. Engineer Hart requested Clerk to locate Trail Phase II and Phase III files to continue process to secure Trail funding for year 2009. Engineer reported on progress of Hwy 6 speed study and study on revising City of Tiffin TIF map. Mayor Phillips reported on upcoming meeting with Jeff Heil, Ruan Securities and Dorsey and Whitney Law Firm regarding TIF funding. Mayor Phillips stated to Council of urgent need for an appointment to be made to the Johnson County Emergency Management Commission and he would make a request for a volunteer in the community newsletter. Motion by Wright, seconded by Bartels for adjournment. All ayes. Adjourned at 8:45pm.
