HomeMy Public PortalAbout017-1984 - REZONING - 125 SOUTHWEST 5TH STREET AND 426 428 NATIONAL ROAD WESTAMENDED: -ORDINANCE NO. 117-1984 AN ORDINANCE AMENDING THE DESIGNATION OF HANDICAPPED PARKING SPACES TO PERMIT VEHICLES IDENTIFIED BY THE INDIANA REHABILITATIVE SERVICES AGENCY AS BEING USED TO TRANSPORT HANDICAPPED PERSONS TO USE SUCH DESIGNATED PARKING SPACES. WHEREAS, Public Law 37-1984 amended Indiana Code 5-16-9 to allow the Indiana Rehabilitative Services Agency to issue placards to individuals whom that agency certifies as handicapped to use designated handicapped parking spaces; NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Wayne County, Indiana as follows: Section I of Ordinance No. 20-1984 be amended to read, and included in the Richmond City Code as Section 74.29, as follows: SECTION I The Board of Public Works and Safety of the City of Richmond, Indiana shall reserve parking spaces on municipally owned parking spaces of city streets designated to be used for the exclusive use of physically handicapped persons. Use of these designated parking spaces shall be limited to vehicles displaying a placard, license or registration plate or other means of identification issued by the Bureau of Motor Vehicles, the Indiana Rehabilitative Services Agency, or any other authorized state, local or federal agency, which designates the vehicle as one used to transport handicapped persons, or as one registered to a Disabled American Veteran. Designation of a parking space is one for the exclusive use of a handicapped person and shall not exempt the space nor the vehicle parked in that space from any other applicable traffic or parking laws, statutes, ordinances or regulations unless so determined by the Board of Public Works and Safety. The owner of a vehicle parked in violation of this section shall be subject to a $50.00 dollar fine payable in the office of the City Clerk in the City of Richmond, Indiana. BARDEN CITY ATTORNEY The Indiana General Assembly and Public Law PL 37-1984 amended Indiana Code I.C. 5-16-9-1 et se to establish a procedure for the Indiana Rehabilitative Services Agency to issue placards to individuals whom the agency certifies as handicapped according to standards outlinedin the act. These placards will suffice as well as handicapped registration plates as proper identification of vehicles and how to use handicapped parking spaces. This new Ordinance NO. 117 —1984 reflects the change in the state law. While the handicapped parking ordinance was amended in early April 1984, notice of the change in the Indiana Statute was not received until after that time. The change in the Indiana Statute does not become effective until September 1, 1984. For those of you who have questions about what the states penalties were for violation of the handicapped parking under State Statute violation it states that it is a Class C infraction which is punishable by a fine and judgment of up to $500.00. As you can readily see, the city ordinance is much less costly than a violation under the state statute would be. Respectfully submitted, Kenneth E.
