AN ORDINANCE ADOPTING THE STATE CURFEW TIME AS
THE ESTABLISHED CURFEW TIME FOR THE CITY OF
RICHMOND, AND TO PROVIDE MEANS FOR ALTERING THE
CURFEW TIME.
WHEREAS, Indiana Code, I.C. 31-6-4-2 provides a standard curfew time
for children seventeen(17) years of age and under; and
WHEREAS, the Common Council of the City of Richmond finds that the
curfew times established in I.C. 31-6-4-2 are reasonable
for public safety; and
WHEREAS, at times it may become necessary to change the curfew time
because of emergencies or special events.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City
of Richmond, Wayne County, Indiana:
SECTION 1. (a) It is a curfew violation for a child fifteen (15),
sixteen (16), or seventeen (17). years of age to be
in a public place;
(1) between 1 a.m. and 5 a.m. on Saturday or
Sunday;
(2) after 11 p.m. on Sunday, Monday, Tuesday, Wednesday,
Thursday, or Friday.
(b) It. is a curfew violation for a child under fifteen
(15) years of age to be in a public place after 11 p.m.
or before 5 a.m. on any day.
(c) This section does not apply to a child who is;
(1) accompanied by his parent, guardian, or custodian;
(2) accompanied by an adult specified by his parent,
guardian, or custodian; or
(3) participating in, goiing to, or returning from:
(A) lawful employment;
(B) a school sanctioned activity; or
(C) a religious event.
SECTION 2. The Board of Public Works and Safety of the City of Richmond
may, upon written request, temporari.7y suspend,'change or
waive the curfew times set forth in Section 1 for a period
not to exceed twenty-four (24) hours. As part of its
determination, the Board of Public Works and Safety shall
designate an effective curfew time during the period in
which the regular curfew time has been suspended, changed,
or waived.
SECTION 3. Whenever the Mayor finds that the circumstances warrant
earlier curfew times than those set forth in Section 1,
the Mayor may declare earlier curfew times, The'Mayor
shall cause such declaration made by him pursuant this
section to be publicly announced by means of broadcasts
with normal operating range covering the city. He may cause
the declaration to be further announced in newspapers of
general circulation when feasible. Each announcement
shall describe, the action taken by the Mayor, including the
time it became or will become effective, and shall specify
the areas affected. The Mayor shall make or cause to be
made a record of each time and date when any declaration
is announced to the public in accordance with this section.
Such declaration of earlier curfew times shall be effective
ORDINANCE NO. 1984
for no more than a twenty --four (24), hour period, unless
renewed by the'Mayor.
