HomeMy Public PortalAbout042-1984 - VOIDED - ORDINANCE PROVIDING FOR THE SUCESSION IN THE CACE OF VACANCY IN THE MAYORS OFFICE FOR THE CITYORDINANCE NO. 42-1984 AN ORDINANCE PROVIDING FOR THE SUCCESSION IN THE CASE OF A VACANCY IN THE OFFICE Of THE MAYOR FOR THE CITY OF RICHMOND, AND PROVIDING FOR AUTHORITY TO A DESIGNATED CITY OFFICIAL TO PERFORM MAYORAL FUNCTIONS IN THE ABSENCE OF THE MAYOR FROM THE CITY OR STATE. WHEREAS, it becomes necessary to establish a procedure for succession to the Office of the Mayor for the City of Richmond, Wayne County, State of Indiana, in the event of a vacancy in that office; and WHEREAS, it is necessary to authorize an officer of the City to perform mayoral functions in the absence of the mayor from the City or State. NOW, THEREFORE, BE IT ORDAINED by the Common Council for the City of Richmond, Wayne County, State of Indiana, that: SECTION I. Succession to the office of the Mayor of the City of Richmond, in the event of a vacancy in that office, shall be governed by Indiana Code, IRC. 3-2-10-5. SECTION II.. If the Mayor shall be absent from the City of Richmond or the State of Indiana for such period of time that the Mayor cannot perform his regular duties as Mayor, the Mayor may authorize another city officer to perform such mayoral functions as may be required during the Mayor's absence. Such authority shall be evidenced by a certificate Signed by -the Mayor and filed with the office of the City Clerk, which shall designate the effective dates of authority. (a) This section applies to all cities except consolidated cities. (b) If a vacancy occurs in an elective office, except the office of mayor, common council, or city j council. udge, the mayor, or acting mayor, shall appoint a replacement, subject to the approval of the common (c) If a vacancy occurs in the office of mayor and there is no dep- uty mayor, the city controller shall act as mayor and shall appoint a suitable person to act as controller during this time. (d) If a vacancy occurs in the office of mayor and there is no dep- uty mayor or city controller, or the office of city controller is vacant, the common council shall elect a suitable person to complete the unex- pired term of the mayor at a special meeting to be held not less than ten (10) days nor more than fifteen (15) days after the vacancy oc- curs. The city clerk shall give notice of the special meeting by publi- cation in accordance with IC 5-,3-1. In the meantime the common council shall designate one (1) of its members to act as mayor pro tempore. (e) If a vacancy occurs in the office of mayor of a second class city having a deputy mayor, the deputy mayor assumes the office of mayor for the remainder of the mayor's term. (f) If a vacancy occurs in the membership of the common council, the common council shall fill the vacancy at a special meeting to be held not less than two (2) days nor more than fifteen (15) days after the vacancy occurs. The city clerk shall give notice of the special meeting by publication in accordance with IC 5-3--1. (9) If there is a tie vote for any city office, the office is consid- ered to be vacant and shall be filled as provided by this section. Idow- ever, if there is a tie vote in the common council to fill a vacancy, the mayor shall cast thedeciding vote. As added by Acts 198o, P.L.8, SEC.2.
