HomeMy Public PortalAbout1994_06_23367 SPECIAL MEETING MINUTES OF JUNE 23, 1994 A special meeting of the Leesburg Town Council was held on Thursday, June 23, 1994 at 5:30 p.m., in the first floor Executive conference room, 25 West Market Street, Leesburg, Virginia. The purpose of the meeting was to discuss the fire station site. Councilmembers present George F. Atwell (absent) Georgia W. Bange R. W. Blake (absent) Joseph R. Trocino Kristen C. Umstattd (absent) William F. Webb Mayor James E. Clem Also present were Councilmembers-elect Frank Buttery, Jr., and Jewell Emswiller Staff members present Deputy Town Manager Peter Stephenson Director of Planning, Zoning and Development Michael Tompkins Deputy Town Attorney Deborah Welsh Also present was Bob Ellis, President of the Leesburg Volunteer Fire Company. Discussion was held with regard to the Union Cemetery appeal of BAR Case 94-52 regarding the proposed chain link fence. Mayor Clem expressed concern about the BAR approval of fencing at Ida Lee Park and the Union Cemetery. He stated that the Council agreed to plain chain link fence and the BAR approved black chain link fence which is more expensive. Ms. Welsh pointed out that if an appeal is filed, the Council may discuss this issue as new business on Tuesday. MOTION On motion of Ms. Bange, seconded by Mr. Webb, the following motion was made. Pursuant to Section 2.1-344 of the 1950 Code of Virginia, as amended, I move that the Leesburg Town Council convene in Executive Session. The authority for this Executive Session is found in Section 2.1-344 (a), Subsection (3), of the 1950 Code of Virginia, as amended. The purpose of this Executive Session is to discuss land acquisition for a fire station site. VOTE Aye: Councilmembers Bange, Trocino, Webb and Mayor Clem Nay: None Absent: Councilmembers Atwell, Blake and Umstattd MOTION On motion of, and duly seconded, the following motion was made. I move that the Executive Session be adjourned, that the Leesburg Town Council reconvene its public meeting and that the minutes of the public meeting reflect that no formal action was taken in the Executive Session. VOTE Nay: Absent: Councilmembers Bange, Trocino, Webb and Mayor Clem None Councilmembers Atwell, Blake and Umstattd sp 6/23/94 -1- 368 MOTION On motion of, and duly seconded, the following resolution was proposed and adopted. 94-131 - RESOLUTION - CERTIFYING EXECUTIVE SESSION OF JUNE 23, 1994 WHEREAS, the Town Council of the Town of Leesburg, Virginia, has this day convened in Executive Session in accordance with an affirmative recorded vote of the Leesburg Town Council and in accordance with the provisions of the Virginia Freedom of Information Act: NOW, THEREFORE, BE IT RESOLVED that the Leesburg Town Council does hereby certify that to the best of each member's knowledge, 1) only public business matters lawfully exempted from open meeting requirements under the Freedom of Information Act were discussed in the Executive Session to which this certification applies; and 2) only such public business matters as were identified in the Motion by which the said Executive Session was convened were heard, discussed or considered by the Leesburg Town Council.
