HomeMy Public PortalAbout048-1984- VOIDED - ORDINANCE CORRECTING THE ADOPTION OF THE ESTABLISHED CURFEW TIME FOR THE CITYORDINANCE NO. 48-1984 AN ORDINANCE CORRECTING THE ADOPTION OF THE ESTABLISHED CURFEW TIME FOR THE CITY OF RICHMOND, AND TO PROVIDE MEANS FOR ALTERING THE CURFEW TIME. WHEREAS, the Common Council of the City of Richmond adopted the State curfew time in Ordinance No. 37-19.84 on April 16, 1984; and WHEREAS, Ordinance No. 37-1984 contained an inadvertent error in the omission of a material provision in Section I, NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond, Wayne County, Indiana that Section I of Ordinance No. 37-1984 be corrected to read as follows: SECTION I. (a) It is a curfew violation for a child fifteen (15), sixteen (16), or seventeen (17) years of age to be in a public place: (1) between 1 a.m. and 5 a,m, on Saturday or Sunday; (2) after 11 p.m, on Sunday, Monday, Tuesday, Wednesday, Thursday, or (3) before 5 a.m. on Monday, Tuesday, Wednesday, Thursday, or Friday. (b) It is a curfew violation for a child under fifteen (15) years of age to be in a public place after 11 p.m. or before 5 a.m. on any day. (c) Thi.s section does not apply -to a child who is-, (1) accompanied by h.is parent, guardian, or custodian; (2) accompanied by an adult specified by his parent, guardian, o_rcustodian; or (3) participating in, going to, or returning from: (A) lawful employment; (B) a school sanctioned activity; or (C) a religious event, PASSED AND ADOPTED by the Common Council of the City of Richmond, Indiana, this day of , 1984.
