HomeMy Public PortalAbout053-1984 - ORDINANCE PURSUANT TO CHAP 154 BEING THE ZONING CODE AND PROVIDING THE AMENDMENT OF A SPECIAL USE SITE PLAN ADOPTED AS EXHIBIT A OF ORDINANCE 7-1984GENERAL ORDINANCE NO. 53-1984 AN ORDINANCE PURSUANT TO CHAPTER 154 OF THE MUNICIPAL CODE, BEING THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE AMENDMENT OF A SPECIAL USE SITE PLAN, ADOPTED AS EXHIBIT "A" OF ORDINANCE NO. 7-1984. WHEREAS, the Common Council of the City of Richmond, Indiana has adopted Ordinance No. 7-1984 which rezoned and authorized the Special Use of property located at 2101 and 2105 Chester Boulevard as a Commercial Development Project; and, WHEREAS, the Common Council of the City of Richmond, Indiana in adopting Ordinance No. 7-1984 included and adopted as a part thereof Exhibit "A", the Special Use Site Plan detailing the proposed Commercial Development Unit Project; and, WHEREAS, it is the intent and purpose hereof to amend the Exhibit "A" Special Use site plan by relocating the proposed street and, by modifying certain required building setback dimensions; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the day of %'77at�e;k _ 1984, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was Q to 0 in favor of/in , y_g;t4wa t_9 recommending the passage of Ordinance No. 53-1984. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the Special Use Site Plan, being Exhibit "A" of Ordinance No. 7-1984, shall be amended by relocating the centerline of pro- posed Engle Drive fifteen (15) feet north. SECTION 2. That pursuant to Article 45.051 of Chapter 154 of the Municipal Code, the minimum distance a building may be located from any prop- erty boundary shall be reduced from fifty (50) feet to twenty (20) feet in only those instances as detailed on the amended Exhibit "A" of Ordinance No. 7-1984, the Special Use Site Plan. SECTION 3. That the owner shall amend and revise the Record Plan and cone struction drawings detailing the relocation of proposed Engle Drive as required by the City Engineer. SECTION 4, That Ordinance No. 7-1984 shall remain in full force and effect except as amended herein. SECTION 5. This Ordinance shall be in full force and effect from and after the passage and approval as by law required. Elstro, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 53-1984 Plan Commission Case PC-84-8 Dear Mr. Elstro, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, May 15, 1984, on the petition of Bartlemay Realty, Inc., requesting to amend Exhibit "A" of Ordinance No. 7-1984 which is the Site Development Plan for the Commercial Development Unit Project authorized at 2101 and 2105 Chester Boulevard. In order to facilitate the location of a drug store within the project, the developer is requesting to relocate proposed Engle Drive fifteen (15) feet north and also requesting that the building setback require- ment of 50' be modified to 20' in those instances where the commercial buildings in the project are adjacent to proposed Engle Drive. Twelve (12) Notices of Public Hearing were sent to surrounding residents with one (1) returned in favor of the request. During the public hearing no one spoke in opposition to the request. The Plan Commission voted eight (8) to zero (0) to recommend the passage of Ordinance No. 53-1984.
