HomeMy Public PortalAbout065-1984 - ORDINANCE AMENDING SECTION 33.03 OF THE CODE OF ORDINANCES OF THE CITY AND CODIFYING THE POLICY OF THE CITY ON PAID VACATION LEAVE FOR ITS MUNICIPAL EMPLOYEESQ7 Dp NANCE NO. 651984 AN ORDINANCE AMENDING SECTION 33.0.3 OF THE CODE OF ORDINANCES OF THE CITY OF RICHMOND, INDIANA AND CODIFYING THE POLICY OF THE CITY OF RICHMOND, INDIANA ON PAID VACATION LEAVE FOR ITS MUNICIPAL EMPLOYEES WHEREAS, the present ordinance of the City of Richmond dealing with municipal employees' vacation leave is insufficient in its failure to provide progressively greater annual vacation leave to municipal employees based on length of continuous satisfactory employment by the City of Richmond and in its failure to make adequate provision for its Department Heads; and WHEREAS, it is in the interest of the citizens of Richmond to allow to municipal employees appropriate .paid vacation leave incorporating the factors of length of continuous service and level of managerial responsibility, as in other segments of the workplace. NOW, THEREFORE, BE U ORDAINED by th-e Common Council of the City of Richmond, Indiana, that Section 33.03 of the Code of Ordinance of the City of Richmond, Indiana be amended to read as follows: �33.03 EMPLOYEE VACATIONS (A) All city employees, whether employed on an annual, monthly, weekly or hourly basis, shall be granted vacation leave at the rate of 5/6 of one working day for each. full month of continuous employment, not to exceed ten (10) working days per year. (B) Employees shall be eligible for bonus vacation leave upon completion of four (4) years of continuous employment and for various years thereafter according t'othe following schedule. The bonus vacation leave will be added at the end of the fourth year anniversary date and on every anniversary date thereafter of continuous service as follows: day -4 years days-5 years days--6 years days-7 years days-8 through days-11 years 7 days 8 days 9 days 10 days 10 years 11 days 12 days 12 years 13 years 14 years 15 through 17 years 18 years - 19 years and each subsequent year (C) During all vacation leaves, employees shall be paid their regular wages or salary for the period of the leave. Legal foltdays shall not be charged against vacation leave. (D) Vacation leave will be earned, but shall not be granted during any probationary period. (E) Vacation leave will be earned, but shall not be granted,during the first six months of employment, subject to the provisions in 533.03(F). (F) Department heads shall have authority to grant employees the use of not more than five (5) days of unearned vacation in advance during any calendar year, except that department heads shall have the option of using up to the full amount of leave due them in any calendar year in advance during that year. If the employee separates from municipal service before actually earning such leave, payment for leave used but unearned shall be deducted from the final payment of salary. (G) Vacation leave shall be accumulative; and any city employee or his or her heirs, successors, or assigns, shall receive upon the city employee's death, resignation, or other termination of employment, compensation for any vacation days which the city employee has earned but not used. (H) The provisions of this section are of no effect insofaras they conflict with, orare superceded by, any valid collective bargaining agreement in effect between the City of Richmond and any of its employees. (I) For purposes of §33.03(B), continuous employment shall include periods of leaves.of absences granted, whether paid or unpaid, as well as periods of lay-off up to one year and any other interuption up to thirty (30) days; during which periods vacation leave shall not be earned however as provided to §33.03(A). BARDEN CITY ATTORNEY June 1, 1984 Mr. Jack Elstro, President Members of Common Council RE: ORDINANCE NO. 65-1984 (vacation of City Employees) Dear Mr. Elstro and Members of Common Council, The City Attorney and City Controller respectfully request that Ordinance No, 65-1984, currently held on first reading, be struck from the files with leave to submit a similar ordinance in the near future. The City Attorney and the City Controller plan to redraft the entire ordinance to eliminate the unlimited accumulation of vacation time. It would be much simpler and clearer to redraft the entire ordinance than to present amendments to the present ordinance. We plan to present the revised ordinance in early September, 1984, after the budget hearings are completed. We will continue with the policy currently in use of One (1) week after six (6) months, two (2) weeks after one (1) year, andthe addition of one (1) day each year after four (4) years.
