HomeMy Public PortalAbout068-1984 - AMENDED CHAP 154-REZONING-323 NORTH 5TH STREETGENERAL ORDINANCE NO. 68-1984 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 323 NORTH 5TH STREET FROM R-3 ONE -TO -EIGHT FAMILY RESIDENCE DISTRICT TO C-1 LIMITED COMMERCIAL DISTRICT. WHEREAS, the Zoning Map which is part of the Ordinance No. 2325-1968 designates and describes as R-3 One -to -Eight Family Residence District the prop- erty located at 323 North 5th Street; and, WHEREAS, it is the intent and purpose hereof to change the zoning classifica- tion of said property from R-3 One -to -Eight Family Residence Dis- trict to C-1 Limited Commercial District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the _2& tt day of Qw,, ` 1984, at which time remonstrances were hd6rd from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was If to O in favor of! --- -- recommending the passage of Ordinance No. 68-1984. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to C-1 Limited Commercial District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amendments thereto. Lot Number One(, in the W. L. Brady's Addition to the City of Richmond, Indiana SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. June 28, 1984 Mr. Howard Elstro, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 68-1984 Plan Commission Case PC-84-11 Dear Mr. Elstro, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, June 26, 1984, on the petition of Harlan and Ruth Green, owners, reques- ting a rezoning from R-3 One -to -Eight Family Residence District to C-1 Limited Commercial District at 323 North 5th Street. Eleven (11) notices of public hearing were sent to surrounding resi- dents with two (2) returned in favor of the request. During the public hearing, no one spoke in opposition to the request. The Plan Commission considered the following testimony in making its determination: (1) The property in question adjoins a C-4 Zoning District immediately to the north. (2) Land use in the area is a mix of industrial, commercial and residential. (3) There have been four (4) rezonings in the general area since 1980 - one (1) to M-1 and three (3) to C-4, so that the residential area is an area in transition: (4) The Master Plan designation for the property in ques- tion is industrial. (5) The intent of the C-1 Zoning District is to allow commercial land use in proximity to residential land use without harm- ing property values or detracting from the quality of life in the neighborhood. The Plan Commission voted eight (8) to zero (0) to recommend the passage of Ordinance No. 68-1984. Respectfully submitted, CITY PLAN CO SSI0 Daniel S.
