HomeMy Public PortalAbout069-1984 - AMENDING CHAP 154-REZ0NING- 1321 SOUTH 9TH STREETGENERAL ORDINANCE NO. 69-1984 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 1321 SOUTH 9TH STREET FROM C-2 COMMERCIAL DISTRICT TO C-4 GENERAL BUSINESS DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as C-2 Commercial District the property located at 1321 South 9th Street; and, WHEREAS, it is the intent and purpose hereof to change the zoning classifica- tion of said property from C-2 Commercial District to C-4 General Business District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 2 & 6e day of , 1984, at which time remonstrances were heard fiz m all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was _'to p in favor of/in opposition to recommending the passage of Ordinance No. 69-1984.` NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the zoning classification of the property described below be, and the same is hereby changed to C-4 General Business District and that said property be regulated in accordance with the Zoning Ordinance:: of the City of Richmond, Indiana, and all amendments thereto. Being a part of lot numbered 19 in plat of Greenwood addition, in the City of Richmond, Indiana, and being more particularly described as follows: Beginning at an iron rod at the intersection of the south line of Lot 19 with the east line of South Ninth Street, said rod being 297 feet south of the south line of South M Street, and running thence, from said beginning point, north, along the east line of said South Ninth Street, 195 feet; thence east, parallel to the south line of said South M Street, 142.25 feet; thence south, parallel to the east line of said South Ninth Street, 195 feet to a point on the south line of said Lot Number 19; thence west, along said south line, 142.25 feet to the place of beginning, containing an area of 0.637 acres. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. I E CITY PLAN COMMISSION RICHMOND, INDIANA June 28, 1984 Mr. Howard Elstro, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 69-1984 Plan Commission Case PC-84-10 Dear Mr. Eistro, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, June 26, 1984, on the petition of Prem Magnetics, Inc., owner; Thomas Snow, Agent; requesting a rezoning from the C-2 Commercial District to the C-4 General Business District, at 1321 South 9th Street. Four (4) notices of public hearing were sent to surrounding residents with none returned. During the public hearing, no one spoke in opposi- tion to the request. The Plan Commission considered the following testimony in making its determination: (1) The property in question adjoins a primary thoroughfare and is adjacent to an existing C-4 Zoning. District. (2) The overall pattern of land use in the area is a mix of commercial and residential structures. The predominate commercial occupancy in the area is C-4. (3) The Master Plan designation for the property in question is General Business which corresponds to the C-4 Zoning District. (4) The recent pattern of development in the area has been C-4 with rezonings to that district in 1982 at 1434 South 9th.Street and in 1978 at 1300 South 9th Street. The Plan Commission voted eight (8) to zero (0) to recommend the passage of Ordinance No. 69-1984.
