HomeMy Public PortalAbout1995_02_08SPECIAL MEETING MINUTES OF FEBRUARY 8, 1995 A special meeting of the Leesburg Town Council was held on Wednesday, February 8, 1995, at 6:00 p.m., in the Council Chambers, 25 West Market Street, Leesburg, Virginia. Notice having been delivered to all members of the Leesburg Town Council prior thereto. The purposes of the meeting were: 1.) To conduct a public hearing to receive comments on a proposed amendment to Chapter 3, new Section 308, Authority to remove or repair buildings. 2.) To consider the acquisition of real property related to the Balls Bluff expansion. The meeting was called to order by Mayor Clem. Councilmembers present George F. Atwell Frank Buttery Jewell Emswiller Joseph R. Trocino Kristen C. Umstattd William F. Webb Mayor James E. Clem Staff members present Town Manager Steven C. Brown Deputy Town Manager Peter M. Stephenson Director of Parks and Recreation Gary Huff Deputy Town Attorney Deborah Welsh Mr. Stephenson presented a brief staff report regarding the proposed amendment to Chapter 3, new Section 3-8, Authority to remove or repair buildings. There was no public comment. Mayor Clem closed the public. The Council generally agreed with the comments made by town staff. No action was taken on this matter. The Council convened in thc Mayor's office to conduct the executive session. The following members were present: Councilmembers Buttery, Emswiller, Umstattd, Webb and Mayor Clem. Mr. At,veil and Mr. Trocino were not present. MOTION On motion of; and duly seconded, the following motion was made. Pursuant to Section 2.1-344 of the 1950 Code of Virginia, as amended, I move that the Leesburg Town Council convene in Executive Session. The authority for this Executive Session is found in Section 2.1-344 (a), Subsection (3) of the 1950 Code of Virginia, as amended. The purposes of this Executive Session is to consider the acquisition of real property related to the Balls Bluff expansion. VOTE: Aye: Councilmembers Buttery, Emswiller, Umstattd, Webb and Mayor Clem Nay: None Absent: Councilmembers Atwell, Trocino MOTION On motion of; and duly seconded, the following motion was made. I move that the Executive Session be adjourned, that the Leesburg Town Council reconvene its public meeting and that the minutes of the public meeting reflect that no formal action was taken in the Executive Session. VOTE: Aye: Councilmembers Buttery, Emswiller, Umstattd, Webb and Mayor Clem Nay: None Absent: Councilmembers Atwell, Trocino MOTION On motion of, and duly seconded, the following resolution was proposed and adopted. 95-22 - RESOLUTION: CERTIFYING EXECUTIVE SESSION OF FEBRUARY 8, 1995 WHEREAS, the Town Council of the Town of Leesburg, Virginia, has this day convened in Executive Session in accordance with an affirmative recorded vote of the Leesburg Town Council and in accordance with the provisions of the Virginia Freedom of Information Act: NOW, THEREFORE, BE IT RESOLVED that the Leesburg Town Council does hereby certify that to the best of each member's knowledge, 1) only public business matters lawfully exempted from open meeting requirements under the Freedom of Information Act were discussed in the Executive Session to which this certification applies; and 2) only such public business matters as were identified in the Motion by which the said Executive Session was convened were heard, discussed or considered by the Lcesburg Town Council. VOTE: Aye: Councilmembers Buttery, Emswiller, Umstattd, Webb and Mayor Clem Nay: None Absent: Councilmembers Atwell, Trocino MOTION On motion of; and duly seconded, the meeting was adjourned. Clem, Mayor Town of Leesburg -2- Nay: None · Absent: Councilmember Umstattd MOTION On motion of Mr. Webb, seconded by Mr. Trocino, the following proclamation was proposed and adopted. PROCLAMATION 1995 YMCA HEALTHY KIDS DAY WHEREAS, the YMCA's vision is to be the nation's leader in prevention and development programs for children; and WHEREAS, the YMCA nurtures the healthy development of children, strengthens families, and helps communities become healthier and safer; and WHEREAS, the YMCA helps people of ages, incomes, races, religions and abilities lead healthier lives; and WHEREAS, at the YMCA there is a sense of belonging and everyone can succeed. THEREFORE, BE IT RESOLVED, that the Mayor of the Town of Leesburg hereby declares April 1, 1995, as YMCA of Loudoun County YMCA Healthy Kids Day in collaboration with the Town of Leesburg Parks and Recreation and the Loudonn Road Runners. VOTE Nay: Absent: Councilmembers Atwell, Buttery, Emswiller, Trocino, Webb, and Mayor Clem None Councilmember Umstattd CERTIFICATES OF APPRECIATION Mayor Clem presented Certificates of Appreciation to Leesburg Police Officers Thomas F. Butler, Brandon Leigh, and Eric Paul. PETITIONERS Mary Fishback, representing the Thomas Balch Library Commission, presented a brief update of the Commission's work. Dave Tinkham,. addressed the Town Council requesting an amendment to the town's Zoning Ordinance regarding setbacks for decks and additions. Mr. Brown agreed to forward the issue to the Planning Commission and provide information to the Town Council on Friday. C.B. Baldwin, Planning Director at Loudoun Hospital Center, provided an update on Loudoun Healthcare's progress. He announced LHI plans to begin construction at Landsdowne in June, 199~ with completion in June 1997. He stated the current facility would be converted to a retirement home. Ms. Emswiller asked if any type of emergency care would be available at the current facility? Mr. Baldwin responded an assessment is underway at this time to address the issue. Jim Carr, a member of the Library Foundation's Board of Directors, invited the Town Council to attend the annual Library Foundation meeting on March 19, 1995 at 2:30 p.m. at the Rust Library. Mr. Cart, speaking as a resident of the Fox Chapel Condominiums, petitioned the council for provision of a noise barrier when the Plaza Street extension is constructed. John King. a resident of Lounsbury Court, spoke in reference to item 10(e). He asked that the town fund the additional money proposed to study traffic alternatives. Carolyn Sadler, a resident of the Fox Chapel Condominiums, emphasized the need for a sound barrier when the Plaza Street extension is constructed and requested the Town Council work with residents to preserve the trees in this area.
