WHEREAS, Townsend Community Center, having its principal offices at 855 North 12th Street, Richmond,lndiana,has petitioned the Common Council request- ing vacation of certain public reghts-of-way in order to accommodate the intended expansion of its community based programs and activities; and, WHEREAS, the Common Council pursuant to the provisions of I.C. 36-7-3-12, conducted a public hearing on said vacation petition on G 1984; and, WHEREAS, a study of this Ordance was conducted by the Richmond City Plan Commission the ? S day ofa , 1984, at which time remonstrances wree heard Prom al6i parties interested in or affected by this Ordinance; and WHEREAS, the vote of the Richmond City Plan Commission was 8 to / in favor of/a recommending apssage of Ordinance No. 76-1984. NOW THEREFORE BE IT ORDAINED by the Common Council fo the City of Richmond, Indiana, as follows: SECTION 1. That subject to the preservation of all easements for existing utilities and also subject to Townsend Community Center dedicating to the public right-of-way so that the northern end of a certain fifteen (15) foot alley, described below, may intersect with North 13th Street and also subject to Townsend Community Center granting an easement to the public to be used as a turn -around at the south- ern end of a certain fifteen (15) foot alley described below, the public right-of-way described below are hereby,vacated. Being all of the sixty (60) foot of North V' Street, running east and west between the east line of North 12th Street and the west line of North 13th Street in. the City of Richmond, CDxrr- Indiana. Being all of the twenty (20) foot alley, running east and west cmbetween North 12th Street and North 13th Street in the City of Richmond, Indiana which lies between the east and west line of =4 North 12th Street and the west line of Lot 28 of the Eunice Moffitt Moore's Addition. UJ � 2 -21 Being all of the twenty (20) foot alley running north and south Q between Lot O.M. 426 and Lot 38 of the Eunice Moffitt Moore's cb Addition in the City of Richmond, Indiana which lies between the north line of vacated North "H" Street adn the south line of Lot O.M. 425. Being that portion of the fifteen (15) foot alley, running north and south between North 13th Street and North 12th Street in the City of Richmond, Indiana which lies between the north line of vacated North "H" Street and the northern lot line of Lot 31 in the Moffit and Moore's Addition extended SECTION 2. This Ordinance shall be in full force and effect form and after the passage and approval as by law required. (2) Petitioner seeks to expand its community based programs and activities offered at its facilities at 855 North 12th Street. (3) In order to accommodate such intended expansion, Petitioner seeks to effect the vacation of the public ways described below: Being all of the sixty (60) foot of North "H" Street, running east and west between the east line of North 12th Street and the west line of North 13th Street in the City of Richmond, Indiana. Being all of the fifteen (15) foot alley, running north and south between North 13th Street and North 12th Street in the City of Richmond, Indiana which lies between the south line of vacated North "J" Street and the north line of vacated North "H" Street. Being all of the twenty (20) foot alley, running east and west between North 12th Street and North 13th Street in the City of Richmond, Indiana which lies between the east and west line of North 12th Street and the west line of Lot 28 of the Eunice Moffitt Moore's Addition. Being all of the twenty (20) foot alley, running north and south between. Lot O.M. 426,and Lot 38 of the Eunice Moffitt Moore's Addition in the City of Richmond, Indiana which lies between the north line of vacated North "H" Street and the south line of Lot O.M. 425. (4) The Petitioner owns the majority of land that abuts the proposed property to be vacated. The names and addresses of the other property owners who have an interest in the proposed vacation are set forth on the attached Exhibit.A", incorporated herein and made a part hereof. (5) A list of those utility companies who will be contacted to ascertain the effect of the proposed vacation upon the existing utility services is set forth in the attached "Exhibit B", made a part hereof, and incorporated herein. It is acknowledged by the Petitioner that the vacation herein requested should be con- ditioned upon the preservation and/or adjustment and relocation of presently existing utility easements and right-of-ways.
