HomeMy Public PortalAbout1995_03_27SPECIAL MEETING MINUTES OF MARCH 27, 1995 A special meeting of the Leesburg Town Council was held on Monday, March 27, 1995 at 5:30 p.m., in the first floor executive conference room, 25 West Market Street, Leesburg, Virginia 22075. The purposes of the meeting were: To conduct a presentation of the Draft Technical Study for annexation and to discuss legal issues of the same with the Deputy Town Attorney. To consider the acquisition of real property for a waterline easement on the John Rocca property and the Bange property. To discuss personnel issues related to the replacement of the Police Chief and Assistant Town Manager for Economic Development and to consider appointments to the town's Tree Commission and Environmental Advisory Commission. Notice having been delivered to all members of the Town Council. The meeting was called to order by Mayor Clem. Councilmembers present George F. Atwell Frank J. Buttery Jewell M. Emswiller Joseph R. Trocino Kristen C. Umstattd (absent) William F. Webb Mayor James E. Clem Staff members present Town Manager Steven C. Brown Director of Engineering and Public Works Thomas A. Mason Director of Planning, Zoning and Development Michael Tompkins Deputy Town Attorney Deborah Welsh Also present were Mark G~b and Linda Kemp, representing the NVPDC. Mr. Tompkins provided a brief presentation of the County-Wide Transportation Plan. Discussion was held with regard to the Route 7 corridor study and the interchange at Lansdowne. The Council agreed to send a letter to the Board of Supervisors strongly supporting the Planning Commission. Mr. Gibb, with the NVPDC, presented an annexation report. Councilmember Buttery abstained from discussion regarding the waterline easement acquisition as it relates to the Rocca property because of a potential conflict of interest. MOTION On motion oi; and duly seconded, the following motion was made. Pursuant to Section 2.1-344 of the 1950 Code of Virginia, as amended, I move that the Leesburg Town Council convene in Executive Session. The authority for this Executive Session is found in Section 2.1-344 (a), Subsections (1), (3) and (7), respectively, of the 1950 Code of Virginia, as amended. The purposes of this Executive Session are: To consider the acquisition of real property for a waterline easement on the John Rocca property and the Bange property. To discuss personnel issues related to the replacement of the Police Chief and Assistant Town Manager for Economic Development and to discuss legal issues related to such, and to consider vacancies on the Environmental Advisory Commission. VOTE: Aye: Nay: Absent: Councilmembers Atwell, Buttery, Emswiller, Trocino, Webb and Mayor Clem None Councilmember Umstattd MOTION On motion of, and duly seconded, the following motion was made. I move that the Executive Session be adjourned, that thc Lecsburg Town Council reconvene its public meeting and that the minutes of the public meeting reflect that no formal action was taken in thc Executive Session. VOTE: Aye: Counciimembers Atwell, Buttery, Emswiiler, Trocino, Webb and Mayor Clem Nay: None Absent: Councilmember Umstattd MOTION On motion of, and duly seconded, the following resolution was proposed and adopted. 95-59 - RESOLUTION: CERTIFYING EXECUTIVE SESSION OF MARCH 27, 1995 WHEREAS, the Town Council of the Town of Leesburg~ Vir~nia, has this day convened in Executive Session in accordance with an affirmative recorded vote of the Leesburg Town Council and in accordance with the provisions of the Virginia Freedom of Information Act: NOW, THEREFORE, BE IT RESOLVED that the Leesburg Town Council does hereby certify that to the best of each member's knowledge, 1) only public business matters lawfully exempted fi.om open meeting requirements under the Freedom of Information Act were discussed in the Executive Session to which this certification applies; and 2) only such public business matters as were identified in the Motion by which the said Executive Session was convened were heard, discussed or considered by the Leesburg Town Council.
