A regular meeting of the Leesburg Town Council was held on April 11, 1995, at 7:30 p.m. in the
Council Chambers, 25 West Market Street, Leesburg, Virginia. The meetingwas called to order by the Mayor.

On motion of, and duly seconded, the following Resolution of Respect was proposed and unanimously
adopted.

Gerald Asa Shipp
WHEREAS, Gerald Asa Shipp, a 31-year employee of Loudoun County Public Schools, died March
22, 1995; and
WHEREAS, Mr. Shipp joined the school system in 1960 as a mathematics teacher at Loudoun County
High School in Leesburg, moving to a brief term as principal of Catoctin Elementary and then assistant
principal of Loudoun County High School; and
WHEREAS, in 1972, Mr. Shipp was appointed principal at Loudoun Valley High School, from which
he retired in June 1991; and
WHEREAS, Mr. Shipp touched many lives during his three decades of service in the public school
system.
THEREFORE, RESOLVED thai I~ Mayor an~l~aembers of Council of the Town of Leesburg in
Virginia extend their sympathy to Mr. Shipp's family and to all who knew him; and
BE IT FURTHER RESOLVED that this Resolution of Respect be spread upon the minutes of this
meeting and that a copy be sent to his family.

On motion of Ms. Umstattd, seconded by Mr. Trocino, the following Proclamation was proposed and
unanimously adopted.
PROCLAMATION
MOTORCYCLE AWARENESS MONTH
WHEREAS, the safe operation of a motorcycle requires the use of special skills developed through
a combination of training and experience, the use of good judgement, and a thorough knowledge of traffic laws
and licensing requirements; and
WHEREAS, motorcycle riding is a popular form of transportation and recreation for thousands of
people across the state and nation; and
WHEREAS, the safety concerns created by motorcycle riding should be of great concern to
motorcycle riders, as well as all other motor vehicle operators; and
WHEREAS, all motorcycle orga~.~ ations, clubs, dealerships, groups and highway safety officials in
our state should join with the Virginia Motorcycle Safety Department and ABATE of Virginia in actively
promoting safe operation, increased rider training, improved licensing efforts, and motorists awareness; and
WHEREAS, during the month of May, all roadway users should unite in the safe sharing of roadways
throughout the state of Virginia; and
WHEREAS, the Motorcycle Safety Awareness Campaign is intended to reduce the number of
accidents, injuries and fatalities associated with motorcycling by encouraging motorcycle operators to
participate in rider education programs, wear the proper apparel and operate their vehicle defensively
according to the rules of the road.
THEREFORE, BE IT RESOLVED that the Mayor and Town Council of the Town of Leesburg in
Virginia do hereby proclaim the month of May 1995 as MOTORCYCLE AWARENESS MONTtl in Leesburg,

PETITIONERS
Mr. Tolbert, Chairman of the Environmental Advisory Commission, provided an update of the Conunission's
work during the year.
Shawn Lumis addressed the Town Council requesting support for construction of a skateboard park.
Mayor Clem referred Mr. Lumis to Director of Parks and Recreation, Gary Huff for further assistance.
Cliff Wicker, owner of Swim Gem on East Market Street, expressed concerns with a neighboring business
blocking the sidewalk with merchandise. He requested help in having the sidewalk cleared.
Ms. Umstattd asked how long this had been going on?
Mr. Wicker responded 4 months.
Mr. Stephenson advised Mr. Wicker that the Council has received a memo and he would follow the process.
Neil Steinberg, addressed the Town Council relaying concerns of the Leesburg Business Community &
Assodates regarding the design of the new the Amoco Station on Harrison Street. He requested a public

forum of the Town Council and Planning Commission to better understand the design approval process.
Mr. Steinberg discussed the closing of Loudoun Street for the county complex construction and asked that the
town formally notify businesses of such closings.
Mr. Steinberg urged the Council to press state legislatures into reversing legislation concerning concealed
weapons.
Mr. Cohen, a local business owner, suggested a mural be constructed in front of the Amoco Station on
Harrison Street depicting an historical event.
PUBLIC HEARING: To consider the imposition of new water and sewer fees

On motion of Ms. Emswiller, seconded by Mr. Trocino, the five minute rule for petitioners will apply.

Myron Olsteen, with O'Brien and Gere, the town's consultant, provided a brief presentation regarding the
water and sewer rate study.
Hub Turner, a resident of Leesburg, asked what is considered a winter quarter? When does it end and what
is the billing date?
Mr. Olsteen addressed Mr. Turner's question by stating the winter quarter is referred to as quarter #3 and
generally runs from November through March.
Mr. Turner expressed concern about the rates.
A resident of Leesburg addressed the Council, stating that having lived in many places, he found the water
rates in Leesburg to be outrageous. He stated he paid approximately $600 for water last summer, and
emphasized the need for more accountability on the town's part.
John Kin~. a resident of Lounsbury Court, was pleased to hear the town is trying to deal with the inequity of
the cost of water use from winter to summer. He was distressed with the imprecision with which %vinter' is
defined. Mr. King asked for more refinement. He also suggested a reduction of commercial and industrial
availability fees and a raise in connection fees for additional residential units.
Mayor Clem closed the public hearing stating the hearing would remain open for 10 days.
Mr. Atwell was pleased to learn there is no increase in water rates for the next year in the report. He
reminded everyone that committee meetings are workshops of the Town Council though they are open to the
public. He concluded by asking that public comments be made at public hearings.
The issue was referred to the April 18, 1995 Administration and Public Works Committee meeting.
PUBLIC HEARING: To consider a proposed increase in meals taxes
Mr. Stephenson provided a brief report.
Jim Mahoney, co-owner of Ledo's Pizza, expressed opposition to the meals tax increase.
Mary Huffard, representing the Vir~nia Hospitality Association, spoke in opposition to the proposed meals
tax increase.
Hubbard Turner spoke in opposition to the meals tax increase.
Steve Price, representing the Chamber of Commerce, spoke in opposition to the meals tax increase.
James Mastria thanked the local restaurantuers for their support and spoke in opposition to the meals tax
increase.
Mayor Clem closed the public hearing stating this item would be referred to the Finance Committee for
further consideration.

PUBLIC HEARING: To consider the proposed Budnet for Fiscal Year July 1, 1995 - June 30, 1996
Mr. Stephenson provided a brief overview.
Frank Ratio addressed the Town Council regarding the proposed budget.
Anne Williams, representing Natural Light School of the Arts, addressed the Town Council requesting a
contribution from the Town of Leesburg.
Ms. Beck~, OttinRer, President of the YMCA, requested a $20,000 contribution from the Town of Leesburg.
Hub Turner discussed the town's Airport Fund.
Mayor Clem dosed the public hearing, referring the issue to the April 12, 1995 budget worksession.
COUNCILMEMBER COMMENTS
Ms. Em.swiller thanked the petitioners for their comments this evening.
Mr. AtweH attended the Balch Library Commission meeting April 10, 1995 and reported that there were 584
patrons of the library in March, 199~. 135 from Loudoun County alone.
A genealogy class will begin on Thursday April 13, 199~.
Nominations for the Annual History Award should be sent to Jane Sullivan at the Balch Library, by June 1.
The Friends of the Library committee is getting organized.
Mr. Atwell invited everyone to attend the 2nd Annual Genealogy Conference in Leesburg on April 28, 29, and
30.
Mr. Trocino pointed out that the water and sewer consumption per capita has been reduced.
Ms. Umstattd thanked everyone for their comments tonight.
She commended the Loudoun Business & Professional Women's Group for recently hosting Career Day, and
Keep Loudoun Beautiful for the clean-up of Goose Creek.
Ms. Umstattd thanked Mayor Clem, the Town Council and specifically George Atwell and Peter Stephenson,
for implementing one of the most efficient emergency notification systems she has seen.
Mr. Buttery referred to the tragedy in town over the weekend and asked that anyone with a conflict in their
life to seek help.
MAYOR'S REPORT
Mayor Clem reported the new elementary school in Potomac Crossing is two months ahead of schedule.
Mayor Clem enjoyed the visit to Leesburg by the 35 Scottish students.
He announced an Executive Session regarding personnel matters, is scheduled for April 19, immediately
following the budget work, session.

CONCEPT PLAN AND PROFFER AMENDMENT BY THE TOWN OF LEESBURG
RESOLVED, by thc Council of the Town of Leesburg in Virginia, as follows:

A notice of Public Hearing to consider #ZM-145 Edwards Landing Concept Plan and Proffer
Amendment to #ZM-109 Edwards Landing PRN by the Leesburg Town Council and the Leesburg Planning
Commission to accommodate the preservation of certain Civil War era earthworks discovered on the property
located east of the Route 15 Bypass and north of Route 773 Edwards Ferry Road shall be published in the
Leesburg Today on June 14, 1995 and June 21, 1995 for a joint public hearing on Tuesday June 27, 1995 in
the Council Chambers of the Government Center at 25 West Market Street, Leesburg, Virginia 22075.
95-72 - A RESOLUTION: PROCLAIMING APRIL 23 AS THE OFFICIAL ARBOR DAY FOR THE
TOWN OF LEESBURG
WHEREAS, in 1872 J. Sterling Morton proposed to the Nebraska Board of Agriculture that a special
day be set aside for the planting of trees; and
WHEREAS, this holiday, called Arbor Day, was first observed with the planting of more than a
million trees in Nebraska; and
WHEREAS, Arbor Day is now observed throughout the nation and world; and
WHEREAS, trees can reduce the erosion of topsoil, cut heating and cooling costs, moderate the
temperature, clean the air, produce oxygen and provide habitat for wildlife; and
WHEREAS, trees in our town increase property values, enhance the economic vitality of business
areas, and beautify our community; and
WHEREAS, the Town of Leesburg has been reco~i?ed as a Tree City USA by the National Arbor
Day Foundation for five consecutive years and desires to continue its tree planting ways:
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
April 23 is hereby proclaimed as the official Arbor Day of the Town of Leesburg for 1994.
95-73 - A RESOLUTION: EAST MARKET STREET WIDENING PROJECT PROGRAMMING
RESOLUTION
WHEREAS, the Virginia Department of Transportation (VDOT) Six Year Improvement Program
for Fiscal Years 1994-1995 through 1999-2000 for urban highways includes the allocation of STP funds for
design improvement project in the Town of Leesburg known as East Market Street Widening; and
WHEREAS, VDOT requires a resolution from the town which states that if the town elected to
cancel this project, the town agrees to reimburse VDOT the cost; and
WHEREAS, East Market Street from Sycolin Road to Loudoun Street should be widened a distance
of approximately 2,000' including new pavement, sidewalk, curb, gutter, storm drainage and modification to
traffic signal at East Market Street and Catoctin Circle; and
WHEREAS, the project will be funded by Regional Surface Transportation (STP) Funds which will
be used to pay design, right-of-way and construction costs; and
WHEREAS, administration and management of the East Market Street Project by the town will be
more efficient since these roads are operated and maintained by the town and the overall scope of the work
is uncomplicated.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
If the Town Council elects to stop or cancel this project, the town hereby agrees to reimburse VDOT
for the total amount of the costs for preliminary engineering, fight-of-way and construction expended by
VDOT through the date VDOT is notified of such suspension or cancellation.
95-74 - A RESOLUTION: AWARDING A CONTRACT FOR THE ENGINEERING AND DESIGN OF
THE CATOCTIN CIRCLE WIDENING PROJECT TO WILBUR SMITH ASSOCIATES
WHEREAS, proposals were received from engineering consulting firms in response to the Request
for Proposals issued by the town for the engineering and design of the Catoctin Circle Widening project; and
WHEREAS, the selection committee, including a member of the Town Council, evaluated the
proposals, prepared a shortlist of the best qualified firms, and interviewed each of the shortlisted firms; and
WHEREAS, the firm of Wilbur Smith Associates was selected as the top ranked finn, and fee
negotiations have been completed; and

WHEREAS, the selection committee recommends award of the engineering and design contract to
Wilbur Smith Associates.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
The Town Manager is authorized to sign on behalf of the town a contract in a form approved by the
Town Attorney for the engineering and design of the Catoctin Circle Widening project with Wilbur Smith
Associates for a total cost plus fixed fee not to exceed $279,000.00.
95-75 - A RESOLUTION: AUTHORIZING THE USE OF BALCH LIBRARY-GENERAL PURPOSI~.
TRUST FUNDS TO HIRE AN ARCHITECI~RAL FIRM FOR THE DESIGN AND
ENGINEERING OF THE THOMAS BALCH LIBRARY RENOVATION AND EXPANSION
WHEREAS, on July 1, 1994, the Town of Leesburg assumed the operation of the Thomas Bakh
Library; and
WHEREAS, on October 18, 1994, Loudoun County transferred all assets of the library to the Town;
and
WHEREAS, on January 13, 1995, two of the three Trust Funds were transferred to the Town in the
amount of $199,049.84; and
WHEREAS, the Library Advisory Commission has recommended hiring an architect for the design
and engineering of the library renovation and expansion; and
WHEREAS, Loudoun County has already advertised for Requests for Proposals and shortlisted five
THEREFORE, RESOLVED by the Council of the Town of Leesburg as follows:
SECTION I. Trust Funds from the Balch Library-GeneralPurpose Trust in the amount of $193,748.26
is authorized to be utilized for the purpose of hiring an architectural firm for the design and engineering of
the library renovation and expansion.
SECTION II. The Town Manager is authorized to proceed with interviews of the five shortlisted
firms that submitted responses to Loudoun County's Request for Proposal.
95-76- A RESOLUTION:AUTHORIZINGENTERING INTO CONTRACTSWITHDIAMOND RIO AND
TOBY KErrH AT THE COUNTRY WESTER MUSIC SHOW
WHEREAS, the Parks and Recreation Department will be conducting a Country Western Music Show
at Ida Lee Park on June 11, 1995; and
WHEREAS, the show is expected to draw at least 12,000 spectators; and
WHEREAS, Diamond Rio and Toby Keith have been selected t perform with Jeff Foxworthy at the
Country Music Show; and
WHEREAS, through East Coast Entertainment, the department has negotiated performance prices
of $44,000 for Diamond Rio and $22,000 for Toby Keith; and
WHEREAS, on April 4, 1995, the Council's Finance Committee recommended approval to enter into
the contracts:
THEREFORE, RESOLVED by the Council of the Town of Leesburg as follows:
The Town Manager is authorized to enter into contracts with Diamond Rio for $44,000 and Toby
Keith for $22,000 to perform at the Country Western Music Show.
95-77 - A RESOLUTION: AUTHORIZING THE USE OF TOWN POLICE OFFICERS FOR THE
MARCH OF DIMES WALKAMERICA AND MAKING AN APPROPRIATION
WHEREAS, the March of Dimes has scheduled its second annual WalkAmerica Walk-a-thon for
April 30, 1995, in Leesburg, and
WHEREAS, by correspondence dated March 13, 1995, the March of Dimes requests police assistance
to ensure the safety of the event; and
WHEREAS, it is town policy to collect a special events fee for events requiring town forces; and

WHEREAS, the March of Dimes requested a waiver of the fee.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Vir~nia as follows:
SECTION I. The Town Council hereby authorizes the use of town forces for the March of Dimes
WalkAmerica on April 30, 1995.
SECTION II. The Town Council authorizes an appropriation in the amount of $1,050.00 to cover the
expense from the unappropriated general fund balance to the police overtime account.
DISCUSSION
Mr. Atwell asked what the amount of the appropriation for police services will be and that the amount be
included in section 2.
Mr. Huff responded the amount is $1,050 for 10 officers for 3 hours at $35 per hour.
Mr. Atwell recommended a different route for next year requiring fewer police officers.
Mayor Cleng Ms. Emswiller, and Mr. Buttery concurred with Mr. Atwell's comment.
Mr. Buttery suggested training volunteers to direct traffic.
95-78 - A RESOLUTION: MAKING AN APPROPRIATION FROM THE GENERAL FUND
UNAPPROPRIATED FUND BALANCE INTO THE AIRPORT FUND FOR CONTRACTSNOW
REMOVAL SERVICES
WHEREAS, Town Council Resolution No. 94-251 authorized the privatization of snow removal
services at the Leesburg Municipal Airport for the 1994-1995 winter season; and
WHEREAS, Blake Landscapes, Inc. provided timely and quality snow removal services for the Town
of Leesbur~, and
WHEREAS, the Town Council was kept informed of the snow removal contract service costs on a
monthly basis; and
WHEREAS, Resolution 94-25 1 further authorized the reimbursement to the Airport Fund, for this
previously unbudgeted expense, for actual snow removal costs at the end of the season; and
WHEREAS, a total of $12,220.00 was paid from the Airport Fund contractual services account for
winter snow removal costs:
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
An appropriation of $12,220.00 is hereby made from the unappropriated General Fund balance into
the Airport Fund contractual services account #600.6000.300.300 for reimbursement of privately contracted
snow removal services at the Leesburg Municipal Airport.
95-79 - A RESOLUTION: AU'I~ORIZING PURCHASE OF VEHICLES FOR THE UTILITY LINES
DIVISION AND MAKING AN APPROPRIATION
WHEREAS, the current Capital Improvements Program and FY 95 budget, as adopted by Council,
includes purchase of a 3-ton dump truck and utility maintenance vehicle for the Utility Lines Division's
maintenance activities; and
WHEREAS, specifications were prepared and bids solicited for this procurement pursuant to state
and local purchasing laws; and
WHEREAS, the lowest responsive and responsible bid was received from Koons of Tysons, Vienna,
Va., in the sum of $49,322.00; and
WHEREAS, the lowest bid received exceeds the FY 95 appropriation for this purchase by $4,322.00,
thus, requiring an additional appropriation by Council; and
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The Town Manager is hereby authorized and directed to purchase one Chevrolet 3-ton
dump truck and one Chevrolet utility maintenance truck from Koons of Tysons, Vienna, Va., in an amount
not to exceed $50,000.00.

SECTION II. An appropriation is hereby made to Utility Fund Account Number 306.3120.700.705
in the amount of $5,000.00 from the unappropriated Utility Fund balance for the fiscal year ending June 30,
1995.

95-80 - A RESOLUTION: MAKING AN APPOINTMENT TO THE ENVIRONMENTAL ADVISORY
COMMISSION
WHEREAS, Environmental Advisory Commission member Robert Lake tendered his resignation
effective April 1, 1995.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
Karen Richardson is appointed to the Environmental Advisory Commission to fiH the unexpired term
of Robert Lake whose term shah expire on June 30, 1996.

95-81 - A RESOLUTION: AUTHORIZING THE CLOSING OF MARKET STREET BETWEEN THE
LOUDOUN TIMES-MIRROR AND WIRT STREET AND KING STREET BETWEEN
CORNWALL AND LOUDOUN STREETS AND THE MARKET STREET ENTRANCE AND
EXIT TO THE PARKING GARAGE
WHEREAS, the Optimist Club of Leesburg has scheduled an Oldies Dance on the Courthouse lawn
on Saturday, May 27 in conjunction with their second annual Custom Car/Hot Rod Show at Ida Lee Park over
Memorial Day weekend, May 27-28, 1995; and
WHEREAS, the Optimist Club of Leesburg has requested the closing of downtown streets to park
classic cars as part of a car show while conducting the Oldies Dance from 7:00 p.m. to 11:00 p.m.; and
WHEREAS, the club requests the closing of Market Street between the Loudoun Times-Mirror and
Wirt Street and King Street between Cornwall and Loudoun Streets, as well as the Market Street exit and
entrance to the parking garage.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
Authorization is hereby granted to close Market Street between the Loudoun Times-Mirror and Wirt
Street and King Street between Cornwall and Loudoun Streets, as well as the Market Street exit and entrance
to the parking garage from 7:00 p.m. to 11:00 p.m., Saturday, May 27, 1995.
DISCUSSION
Mr. Butteq asked if the Optimist Club received permission to use the courthouse lawn?
Fred Tayl~,, Chairman of the Optimist Club Car Show, stated that permission will be given by Judge Home,
if the Town of Leesburg approves the concert.

Mr. Taylor replied the club is flexible in that matter.

95-82 - A RESOLUTION: SETFING A DATE FOR A FINAL WORKSESSION TO REVIEW AND
ADOPT STRATEGIC GOALS AND A TOWN MISSION STATEMENT
WHEREAS, the Town Council has worked diligently with facilitator Michael Chandler of Vir~nia
Tech to establish strategic goals for 1995 and 1996; and
WHEREAS, five members of council have fundamentally endorsed ten draft strategic goals; and
WHEREAS, it is the desire of the council to fully develop an appropriate mission statement for the
town government:
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
A final, unfacilitated Town Council worksession is hereby set for April 28, 1995 to review and adopt

DISCUSSION
Lou Suta, representing the Riptide Swim Team, requested a waiver of past due fees and long course fees from
April through August.
Ms. Emswiller asked if the swim team was expected to pay its own way when it was established?
Mr. Suta stated the program needs a lot of help.
Gary Huff stated the swim team was originated by the Parks and Recreation Department with the intention
of turning it over to the parents association eventually.
Mr. Atwell recommended referring the issue back to the Finance Committee meeting of April 18, 1995.
NEW BUSINESS
Mayor Clem asked that two department directors, at a time, begin reporting to the Town Council at Council
meetings, beginning April 25, 1995.
He announced the next budget worksession is scheduled for April 12, 1995 at 7 p.m.
Mr. Trocino stated that the VML met this week regarding redistribution of lottery funds. He considers it
incumbent upon the Town of Leesburg to remain on top of the situation.
