HomeMy Public PortalAbout081-1984 - ORDINANCE TO ESTABLISH SERVICE CHARGES FOR THE PERFORMANCE OF CERTAIN NON-EMERGENCY MATTERS BY POLICE OFFICERS OF THE CITYORDINANCE NO. 81- 1984 AN ORDINANCE ESTABLISHING SERVICE CHARGES FOR THE PERFORMANCE OF CERTAIN NON -EMERGENCY MATTERS BY POLICE OFFICERS OF THE CITY OF RICHMOND, INDIANA AND ESTABLISHING A NON -REVERTING FUND CONSISTING OF SUCH SERV.IC-ECHARGES DEDICATED TO THE 'FUNDING Of LONGEVITY PAY OF SUCH POLICE OFFICERS OF THE CITY OF RICHMOND, INDIANA; AND -PROHIBITING THE USE OF CERTAIN TYPES OF ALARM EQUIPMENT. NOW THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond, Indiana: SECTION 1. ESTABLISHMENT OF SERVICE CHARGES That on and after September 1, 1984, the following service charges will be in effect for the performance of the following non - emergency matters by officers of the Police Department of the City of Richmond, Indiana: SECTION 1.1 VEHICLE INSPECTION NUMBER CHECK $3,00 per check SECTION 1.2 FALSE ALARMS BY AUTOMATIC BURGLARY ALARM SYSTEMS First call in any calendar year - no charge Second and Third calls in any calendar year - $25.00 charge per call. Fourth and subsequent calls in any calendar year - $50.00 charge per call, SECTION 2. DEFINITIONS For the purpose of this ordinance, the following terms, phrases, words and their derivations shall be defined as follows: SECTION 2.3 ALARM SYSTEM is an assembly of equipment and devices designed to signal, or transmit a signal to police, the presence of a hazard at the premises of the alarm holders requiring urgent attention and to which police personnel are expected to respond. Such an alarm system may include "Burgla"r":, "Hold-up" or "Robbery" warning devices. Included. in the Alarm System are alarm devices emitting sounds, flashing lights or beacon signals to warn persons outside the premises of the existence of a hazard at the premises.. SECTION 2.1 ALARM DEVICE is. the portion of the alarm system located within or upon the premises of the Alarm Holder to detect entry into said premises by an unauthorized intruder. SECTION 2.2 ALARM HOLDER is the owner, lessee or person responsible for the existence of an Alarm Device within or upon his or her premises, SECTION 2.4 AUTOMATIC DIALER is an alarm system which. Automatically sends over regular telephone lines a prerecorded voice message, or coded signal, indicating the existence of an emergency situation at the premises of an Alarm Holder, -2- SECTION 2.5FALSE ALARM is an alarm signal received by police from an alarm device or system from causes other than burglary, attempted burglary, severe weather conditions or timely and proper telephone call to police cancelling any response by police to the alarm signal. Such other causes are generated from human error; improper maintenance; improper installation; faulty equipment; electrical or mechanical malfunction; or excessive insensitivity. SECTION 2.6 POLICE shall mean theCity of Richmond, Indiana, Police Department. SECTION 2.7 SERVICE CHARGE is an assessment by the Police against an Alarm Holder for a false alarm; or against a person requesting a Vehicle Identification Number check. SECTION 3. AUTOMATIC VOICE DIALERS PROHIBITED The installation hereafter of any Automatic Voice Dialer to the Police is prohibited. Alarm Holders who, at the time of the enactment of this Ordinance, have in their possession an Automatic Voice Dialer connected to the Police shall be allowed to retain such connection for a period of no more than sixty (60) days after the effective date of this Ordinance, Whoever violates this section shall be fined Fifty D"ollars ($50,00) for each offense in addition to which service charges for false alarms rendered by such Automatic Voice Dialers may be assessed in accordance with the provisions of this ordinance; and each day that such offense continues shall be considered a separate and distinct offense. SECTION 4. SERVICE CHARGES TO DEDICATED FUND All service charges assessed in accordance with. this ordinance shall b.e paid directly into a separate fund which_ shall not revert to the general fund of theCity of Richmond, Indiana, and all such charges shall be dedicated, cumulatively, for the payment of Police longevity pay as provided by Ordinance, The office of the City Clerk of Richmond, Indiana shall bill and collect such service charges and shall maintain in its records such dedicated fund on a cumulative basis, and shall be authorized to retain for its expenses in connection with such duties an amount not to exceed Ten (10) percent of monies received hereunder.
