ORDINANCE NO. 276-04-22
AN ORDINANCE OF THE CITY OF IONA, IDAHO;
ENACTING A NEW SECTION 9-1-9 OF THE IONA CITY
CODE; PROHIBITING THE USE OF ENGINE COMPRESSION
BRAKES (A.K.A. JAKE BRAKES) OR OTHER LOUD
BRAKING SYSTEMS WITHIN CITY BOUNDARIES;
PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA,
IDAHO THAT:
Section 1. Enactment of new Section 9-1-9 of the Iona City Code. A new Section
9-1-9 of the Iona City Code is hereby enacted as follows:
9-1-9: ENGINE COMPRESSION BRAKES. No person shall, while operating a motor
vehicle within the City,apply or otherwise use Engine Compression Brakes,"Jake Brakes",or any
similar braking system that emits a clearly audible noise when measured from a distance of 50 feet
away from the source. Engine Compression Brakes include any braking system that uses
compressed air from a motor vehicle's engine to slow the vehicle as well as any similar system that
causes an audible noise prohibited by this section. Any person who violates this section shall be
guilty of an infraction.
Section 2. Severability. The sections and subsections of this Ordinance are severable.
The invalidity of any section or subsection shall not affect the validity of the remaining sections or
subsections.
Section 3. Effective Date. This Ordinance shall become effective upon its passage,
execution and publication in the manner provided by law.
