AN ORDINANCE RATIFYING THE AMENDMENTS TO THE
PROFESSIONAL NEGOTIATION AGREEMENT BETWEEN
THE RICHMOND PROFESSIONAL FIREFIGHTERS LOCAL
14o8 AND THE CITY OF RICHMOND AND PROVIDING
FOR LONGEVITY PAY FOR THE FIREFIGHTERS
WHEREAS, the Board of Public Works and Safety through
its wage negotiating team has negotiated with
the representatives of the Richmond Professional
Firefighters, Local 1408 of the International
Association of Firefighters, AFL-CIO representing
members of the Richmond Fire Department and
Professional Firefighters Union of Indiana and
in said negotiations have agreed to amend their
Professional Negotiation Agreement previously
entered into by the union and the city and
dated the 20th day of November, 1981; and
WHEREAS, Indiana Code I.C. 36-8-3-3 authorizes the Common
Council of the City of Richmond, Indiana to
ratify such amendments; and
WHEREAS, the Board of Public Works and Safety and the
Richmond Professional Firefighters Union have
set their hands and seals this 10th day of
August, 1984, to the amendments to the professional
negotiation agreements; and
WHEREAS, such amendments to the Professional Negotiation
Agreements have been approved by Mayor Frank
H. Waltermann; and
WHEREAS, the Common Council of the City of Richmond,
Indiana, desires to ratify such amendments to
the Professional Negotiation Agreement and to
incorporate such amendments and the original
Professional Negotiation Agreement into this
ordinance; and
WHEREAS, the Board of Public Works and Safety has negotiated
with representatives of the Richmond Professional
Firefighters Local 1408 of the International
Association of Firefighters, AFL-CIO representing
members of the Richmond Fire Department and
Professional Firefighters Union of Indiana and
in said negotiations have agreed in the Professional
Negotiation Agreement Addendum No. 1 Section
B - Longevity - to pay longevity pay to the
members of the Richmond Fire Department, and
WHEREAS, effective January 1, 1985 the longevity pay
will be increased to the amount of Three Hundred
Dollars ($300.00) at each longevity level; and
WHEREAS, effective January 1, 1985 amended Ordinance
No. 53-1981 and Ordinance No. 3297-1977 shall be rescinded,
NOW THEREFORE BE IT ORDAINED by the Common Council of
the City of Richmond, Indiana that
SECTION I. The Professional Negotiation Agreement
previously entered into by the Union and the
City and dated the 20th day of November 1981
and the amendments to such Professional Negotiation
Agreement entered into by the Union and the
City and dated the loth day of August,
1984 is hereby adopted by reference, ratified
and incorporated into this ordinance.
SECTION II. Effective the lst day of January,
1985 any member of the fire department on active
duty shall receive in addition to such member's
base pay, longevity pay, which shall be determined
on the basis of the length of active service
in the fire department, which said longevity
pay shall be as follows, to wit:
1. Any member of the Fire Department who
shall have had not less than three years and
not more than six years of active service in
such member's department shall receive the sum
of $400.00 per year in addition to such member's
base pay; the annual payment shall commence
upon the date upon which any such member shall
have completed three years of active service
with such member's department;
2. Any member of the Fire Department who
shall have had not less than six years and not
more than eight years of active service in such
member's department shall receive the sum of
$500.00 per year in addition to such member's
base pay; the annual payment shall commence
upon the date upon which any such member shall
have completed six years of active service with
such member's department;
3. Any member of the Fire Department who
shall.have had not less than eight years and
not more than ten years of active service in
such member's department shall receive the sum
of $600.00 per year in addition to such member's
base pay; the annual payment shall commence
upon the date upon which any such member shall
have completed eight years of active service
with such member's department;
4. Any member of the Fire Department who
shall have had not less than ten years and not
more than twelve years of active service in
such member's department shall receive the sum
of $700.00 per year in addition to such member's
base pay; the annual payment shall commence
upon the date upon which any such member shall
have completed ten years of active service with
such member's department;
5. Any member of the Fire Department who
shall have had not less than twelve years and
not more than fourteen years of active service
in such member's department shall receive the
sum of $800.00 per year in addition to such
member's base pay; the annual payment shall
commence upon the date upon which any such member
shall have completed twelve years of active
service with such member's department;
6. Any member of the Fire Department who
shall have had not less than fourteen years
and not more than sixteen years of active service
in such member's department shall receive the
sum of $900.00 per year in addition to such
member's base pay; the annual payment shall
commence upon the date which any such member
shall have completed fourteen years of active
service with such member's department;
(. Any member of the Fire Department who
shall have had not less than sixteen years and
not more than eighteen years of active service
in such member's department shall receive the
sum of $1,000.00 per year in addition to such
member's base pay; the annual payment shall
commence upon the date upon which any such member
shall have completed sixteen years of active
service with such member's department;
8. Any member of the Fire Department who
shall have had not less than eighteen or more
years of active service in such member's department
shall receive the sum of $1,100.00 per year
in addition to such member's base pay; the annual
payment shall commence upon the date upon which
any such member shall have completed eighteen
years of active service with such member's department.
SECTION III. It is intended that the eligibility
for longevity pay and the amount of longevity
that is to be paid to each member of the Fire
Department shall be determined as upon that
date upon which such member shall have completed
three years of active service with such member's
department, and upon that same calendar date
in each ensuing year thereafter.
SECTION IV. It is further intended that any
member of the Fire Department who has not accumulated
three years of active service shall not be eligible
for longevity pay.

AMENDMENTS TO PROFESSIONAL NEGOTIATION AGREEMENT
WHEREAS, after negotiations between the Richmond Professional
Fire Fighters Local 1408 and the City of Richmond, Indiana, the
Union and the City did mutually agree to amend their Professional
Negotiation Agreement;
NOW THEREFORE, the parties hereto expressly agree to the
following amendments to the Professional Negotiation Agreement
previously entered into by the Union and the City and dated the
20th day of November, 1981:
ARTICLE 3 - DEFINITIONS - is amended to delete "(c) The Battalion
Chiefs" from exclusion from the!,Fire Department members covered
by the agreement. Said Battalion Chiefs shall be subject to the
provisions of Article 5 regarding Union Membership and Security.
ARTICLE 11 - WORK WEEKS - is amended as follows: Paragraph
one, sentence one is amended to read: "The scheduled work week
of the Richmond Fire Department shall not average more than fifty
and four tenths (50.4) hours."
Paragraph two is amended to insert after the first sentence:
"Provided the actual manpower assigned at any given time to a
particular company may be less than the permanently assigned manpower
due to the scheduling of vacations, union business time off, scheduled
personal days, training leaves, and the absence of sick or injured
employees."
ARTICLE 20 - CLOTHING ALLOWANCE - In consideration of amendments
to the agreement contained in ADDENDUM NUMBER ONE hereunder, ARTICLE
20 is amended to read as follows:
"The City agrees to pay firefighters a clothing allowance
of Three Hundred Dollars ($300.00) per year, payable in the
following manners: $75.00 in the regular paycheck preceding
April first, $75.00 in the regular paycheck preceding July
first, $75.00 in the regular paycheck preceding October first,
and $75.00 in the regular paycheck preceding Christmas Day
of each year."

ARTICLE 29 - SENIORITY - Paragraph one is amended to read:
"Ail promotions within the Richmond Fire Department shall be made
on a seniority basis."
ADDENDUM NUMBER ONE - The Wage Addendum as provided for in
Article 30 of the agreement is amended to read as follows:
A. WAGES: Beginning on January 1, 1985, the annual salary
for the uniformed fire ranks shall be:
PROBATIONARY FIREFIGHTER $16,489.00
FIREFIGHTER 16,989.00
ENGINEER 17,510.00
LIEUTENANT 18,244.00
CAPTAIN 18,540.00
MECHANIC/EDUCATION OFFICER/
BATTALION CHIEF 19,565.00
These annual salaries include:
$175.00 to be paid at the time of the regular
payroll immediately prededing each firefighter's
first vacation draw.
B. LONGEVITY: Beginning on January 1, 1985, longevity
pay will be paid in accordance with the rate
set forth in CITY ORDINANCE NO. 91-1984, increasing
such pay by $300.00 at each longevity level,
subject to passage of such ordinance by the
Common Council.
ADDENDUM NUMBER TWO - Beginning on January 1, 1985, each
member of the Fire Department shall be regularly assigned to an
average fifty and four tenths (50.4) hour work week.
Personal days may be taken only if the number of on-line
employees available for duty at any given time equal or exceed
the minimum manpower level herein defined to be seventeen (17).
The minimum manpower level may be maintained through the
payment of overtime up to the amount of Three Thousand Dollars
($3,000.00) budgeted for the Fire Department for that purpose
for the year 1985.
Overtime shall be paid at the same rate as that set by Article
12 of the agreement for paid holidays; that is, one (1) days pay
shall be equivalent to 1/260th of the member's regular annual
base pay.

Personal days must be taken by the member according to the
shift calander and may not be deferred. Said days may not be
accumulated beyond six (6) months after such days are earned.
Both parties agree to abide by the provisions of Indiana
Code I.C. 36-8--4-9(b) in the event of an emergency.
THESE AMENDMENTS to the Professional Negotiation Agreement
shall be effective as of the lst day of January, 1985, and shall
be part of and incorporated within the Professional Negotiation
Agreement from that date.
IN WITNESS WHEREOF, the parties have hereunto set their hands

Ordinance No. 91-1984 ratifies the professional negotiation agreement currently
.in existence, the amendments to that agreement for 1985, revokes Ordinance No.
53-1981 (hte current longevity ordinance) and provides for the increased longevity
Pay.. .
The professional agreement signed November 20, 1981 renewed automatically as
neither party chose to open the contract. The amendments are for 1985. Negotiations
in 1985 for 1986 will cover the complete contract.
The 1985 wage package, clothing allowance and longevity pay outlined in the August
10th amendments are the same as they were inthe first amendments that were revoked
due to ambugous language.
The wage package reflects an. overall 4.3% icnrease, includign 1/3 of the phase -in
of permenent rank differences. The clothing allowance was reduced by $200.00,
with that being shifted to longevity plus $100.00 of "new" money for a total
behinning longevity pay of $400.00 increasing to $1,100.00 at the highest level.
Article #11 and Addendum #2 explain the work week and the rules under which
the personal days will operate, and provide for a definition of a minimum
manpower at 17 personnel. this minimum was agreed to in a meeting with the Mayor
at his request and concern for public safety. This minimum guarantees that no
fire station will be closed. In addition the last paragraph of addendum #2
recognized the provision of IC 36.8.4.9(b) in the case of an emergency. A copy
of the code is attached.
The 1985 fire dept. budget included overtime of $3,000.00 as a part of the
implementation of the personal days.
A copy of the professional agreement has been placed in the Council's office
for your review. It is a lengthy document and we haven't reproduced a copy for
each Council member at this time.
Costs of the 1985 amendments are:
Additional Base pay $59,442.
Overtime 3,000.
Additional longevity 7,900.
Additional pension cont. by City 4,956

the the position of Administrative Assistant in the Mayor's Budget to create two (2)
