Parker called the Special Called Council meeting to order at 7:30 P.M. on Monday, December 28, 1998. The following members of Council were present: Jack Youmans, Anne Monaghan, Donald E. Anderson, Jr., Michael A. Hosti, and Mallory Pearce. Mayor Parker announced that this meeting was called to discuss two items and that is all that Council is allowed to discuss by law. Mayor Parker announced that Council member Merves was out of town until Wednesday. The Pledge of Allegiance was recited by all after the Reverend Lee Bennett gave the invocation. Mayor Parker opened the meeting for business legally presented to Council. Anderson motioned to remove the DeSoto site plan from the table. Youmans seconded. Vote by Council was unanimous. Zoning Administrator Byers presented the site plan that was tabled until more information could be attained from DNR. Byers said that the plan shows all the structures, 63 parking spaces, and that the Planning Commission has approved this site plan. City Attorney Hughes stated that the Public Hearing was held on December 10, 1998 and that there is no new evidence. Pearce questioned Attorney Mahoney on whether the developer has taken into consideration the storm damage issues if any should occur. Mahoney said that he could not advise City Council, but that developers can not accept anything other than proven negligence. Pearce said he is concerned about city liability. Mahoney answered that he does not believe that there are any cases in Georgia that would set precedent. Hughes said that at least in one case with the City of Tybee that a note was on the plat when recorded that would exempt the City of any liability. Youmans said that he does not agree with the wording unless it is on every plat. Pearce also stated that he is concerned about the green space and the drainage. Mahoney answered that the green space is on the site plan and there is no intent to change, but at any time it should occur that the plat would have to come back before Council. Youmans moved to accept the site plan. Anderson seconded. Pearce moved for a two -part amendment; to protect the City from liability and green space protection. Monaghan seconded the amendment. Youmans said that he would not accept the amendment. Hughes said that all this does is give notice to the purchasers but it is not really protecting the City from any lawsuits. Council vote on the amendment was 4 in favor (Monaghan, Anderson, Hosti, Pearce); 1 opposed (Youmans). Council vote on the main motion to accept the site plan was unanimous. Pearce questioned extending the demolition permit. Byers said that the permit is good for six month from the date of issuance. Hughes asked when the permit had been issued. Byers said about six weeks ago. City Manager Bill Farmer presented Council with a proposal from Hussey, Gay, Bell and DeYoung for the Inlet Avenue Storm Drainage Engineering. The amount of this contract is not to exceed $15,500. Farmer explained that the design would place the drainage pipe out into the river so that it would stay there through storms. Pearce moved to accept the proposal. Monaghan seconded. Vote by Council was 3 in favor (Youmans, Monaghan, Pearce); 2 opposed (Anderson, Hosti). Hosti stated that H,G,B & DeY are 1 1 1 killing us with money for designs and such and is all of it necessary. Farmer answered that the City could lay the pipe into the river and run the risk of it washing away. Mayor Parker adjourned the meeting at 8 P.M. ayor Walter W. Box 2749 Tybee Island, Georgia 31328 -2749 RE: INLET AVENUE STORM WATER DISCHARGE PIPE ENGINEERING SERVICES PROPOSAL ESTABLISHED 1958 We appreciate this opportunity to present our proposal for engineering services required to replace the storm water discharge pipe at Inlet Avenue. Our services will include the following: Item A. Support Services 1. Permitting - We will prepare Corps of Engineers Application and the required exhibits to obtain Corps approval of the installation. 2. Survey - We will prepare topographic and hydrographic surveys necessary for our design. 3. Geotechnical - We will have soil borings taken, analyze the boring data and use this data in our engineering analysis and design. Item B. Design We will design the storm drain outlet pipe including a pile system and necessary tie -downs to keep the pipe stationary. Our design will include the preparation of plans, specifications and contract documents suitable for public bidding. Item C. Contract Administration and Construction Observation We will assist the City in advertising for bids, review all bids and make a recommendation of award. In addition, we will prepare a contract for execution by the City and the selected contractor, review necessary shop drawings submitted by the contractor, review periodic pay estimates and prepare as -built drawings based on information provided by the contractor. 329 COMMERCIAL DRIVE (31406) • P.O. Our fee for the above tasks will be on an hourly basis in accordance with the attached Schedule of Hourly Rates. Fees for Items 1 and 2 will not exceed $15,500 without prior approval by the City. Fees for Item 3 will be on an hourly basis. We appreciate the opportunity to present this proposal and will use a signed copy as our Notice to Proceed. Please retain a copy for your records.
