AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE
NO. 2325-1968, COMMONLY KN014N AS THE ZONING ORDINANCE OF THE CITY OF
RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF PROPERTY LOCATED IMME-
DIATELY SOUTH OFF OF SOUTHWEST 15TH STREET FROM R-2 SINGLE-FAMILY RESIDENCE
DISTRICT TO R-2 SU SINGLE-FAMILY RESIDENCE SPECIAL USE DISTRICT AND AUTHORIZ-
ING THE SPECIAL USE OF SAID PROPERTY AS A RESIDENTIAL DEVELOPMENT UNIT
PROJECT.
WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968 designates
and describes as R-2 Single -Family Residence District the property
located immediately south off of Southwest 15th Street; and,
WHEREAS, it is the intent and purpose hereof to change the zoning classifica-
tion of said property from R-2 Single -Family Residence District to
R-2 SU Single -Family Residence Special Use District and to authorize
the Special Use of said property as a Residential Development Unit
Project; and,
WHEREAS, pursuant to Articles 45 and 48 of Chapter 154 of the Municipal
Code, the Richmond City Plan Commission has conducted a public
hearing on the preliminary plan of the subject Residential Develop-
ment Unit Project; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan
Commission the day of z2",3� --/- , 1984, at which
time remonstrances were heard from a1' parties interested in or
affected by this Ordinance; and,
WHEREAS, the vote of the Richmond City Plan Commission was _ 1 to p
in favor of/in eppesiDian ee recommending the passage of Ordinance
No. 96-1984.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond,
Indiana as follows:
SECTION 1. That the zoning classification of the property described below
and the same is hereby changed to R-2 SU Single -Family Residence
Special Use District, and that said property be regulated in accord-
ance with the Zoning Ordinance of the City of Richmond, Indiana and
all amendments thereto.
Being a part of the Southwest Quarter of Section 6,
Township 13 North, Range 1 West in the City of Rich-
mond, Wayne County, Indiana, and being more parti-
cularly described as follows:
Beginning at an iron rod found at the southeast cor-
ner of Hidden Valley East, Section Two, as recorded
in Plat.Book 12, page 251 in the office of the Wayne
County Recorder, Wayne County, Indiana, and running
thence, from said beginning point, south 0 degrees,
03 minutes and 45 seconds east, 184.97 feet to an
iron pipe set; thence north 88 degrees, 34 minutes
and 50 seconds west, 184.68 feet to an iron pipe set;
thence north l degree, 25 minutes and 10 seconds east,
55.90 feet to an iron pipe set; thence north 88 degrees,
34 minutes and 50 seconds west, 90.00 feet to an iron
pipe set; thence north 26 degrees, 31 minutes and 00
seconds west, 84.80 feet to an iron pipe set on the
south line of a 0.158 acres tract owned by Gary Ray and
Carolyn Charolette Hubbell, as described in Deed Record
424, page 501 in the office of said Wayne County Recorder;
thence north 87 degrees, 32 minutes and 20 seconds east,
along the south line of said Hubbell tract, 130.00 feet
to an iron pipe found at the southeast corner of said
tract; thence north 1 degree, 25 minutes and 10 seconds
east, along the east line of said tract, 33.09 feet to
the northeast corner thereof, and being an iron pipe
found at the southeast corner of Lot Number 12 in said
Hidden Valley East, Section Two; thence north 87 degrees,
32 minutes and 20 seconds east, along the south line of
said Hidden Valley East, Section Two, 180.32 feet to the

place of beginning, containing an area of 0.951
acres.
SECTION 2. That as provided in Articles 21, 45 and 48 of Chapter 154 of the
Municipal Code, the following described use of the above described
real estate is allowed as a Special Use as a Residential Develop-
ment Unit Project.
SECTION 3. As a condition of the aforesaid Special Use and as an additional
restriction on said sue, the following requirements shall hereafter
and at all times be met by the owner of said real estate:
a. The Site Plan and Subdivision Record Plan accompanying the peti-
tion shall be marked Exhibit A and made a part of the Ordinance.
SECTION 4. This Ordinance shall be in full force and effect from and after
its passage and approval as by law required.

Dear Mr. Elstro, Members of Common Council and Mrs. Merchanthouse:
The Richmond City Plan Commission conducted a public hearing on Tuesday,
August 28, 1984, on the petition of Nicholson Builders requesting a re-
-zoning from the R-2`Single Family Residence District to the R-2 SU Single -
Family Residence Special Use District and requesting that a Special Use
be granted for a Residential Development Unit Project on property located
in the proposed 800 block.of Southwest 15th Street.
The proposed project is a two-family dwelling development consisting of
six (6) dwelling units on three, (3) subdivision lots and is located at
the southern end of. Southwest 15th Street.
During the public hearing, no one spoke in opposition to or in favor of
the request.
The Plan Commission determined the proposed project meets or exceeds all
requirements of the Zoning Ordinance, and, therefore voted nine (9).to .
zero (0) to recommend that Ordinance No. 96-1984 be forwarded to Common
Council with the conditions as written in Section 3 of the Ordinance, and
with a recommendation for approval.
