HomeMy Public PortalAbout108-1984 - ORDINANCE AMENDING SECTION 74.24 TO PERMIT THE BOARD OF PUBLIC WORKS AND SAFETY TO RESTRICT PARKING IN VARIOUS AREAS OF THE CITYORDINANCE NO. 108— 1984 AN ORDINANCE AMENDING SECTION 74.24 (ORDINANCE NO. 1781-1960) TO PERMIT THE BOARD OF PUBLIC WORKS AND SAFETY TO RESTRICT PARKING IN VARIOUS AREAS OF THE CITY AND RATIFYING PRIOR ACTIONS OF THE BOARD OF PUBLIC WORKS AND SAFETY WHEREAS, the Common Council finds it necessary to delegate the responsibility for determining,restrtcted parking areas in the City of Richmond to the Board of Public Works and Safety; WHEREAS, the Board of Public Works an-d'Safety has already restricted parking in various areas of the City; NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond, that: SECTION 74.24 of the Richmond City Code (Ordinance No, 1781-1960) be amended to provide as follows: (A) The Board of Public Works and Safety is authorized to erect signs and place other necessary markings indicating no stopping, standing, or parking in any area of the City of Richmond whenever the Board determines that such stopping, standing, or parking would in its opinion interfere with traffic or create a hazardous situation. Such restrictions may be for a continuous period or may be for a certain time period. Such restrictions must be clearly identified by the signs and/or markings. (B) When signs or other markings are erected or placed in each block giving notice thereof, no person shall stop, stand, or park a vehicle in a manner inconsistent with the signs or markings. (C) The Common Council shall by Ordinance have the right to supercede the Board's determination as to restricted parking in a given area of the City; however, if no Ordinance specifically applies to a given area of the City the Board's determination as to restricted parking shall have the full force and effect of law. (D) The Common Council hereby ratifies all determinations and actions of the Board of Public Works and Safety with respect to restricted parking made prior to this time. (E) Due to the emergency nature of this Ordinance, these provisions shall take effect immediately upon passage by the Common Council and approval of the Mayor. BARDEN CITY ATTORNEY August 23, 1984 Members of Common Council, Dear Members, Ordinance No. 108-1.984 corrects a technical defect in the City Code and brings it into compliance with past and present practice. Under the Code technically the Common Council is to make the determination as to restricted parking areas, except for business districts which the Board of Works would regulate. This ordinance would expand the Board's jurisdiction to include all areas of the City. The practice in past years and this year has been to allow the Board to make that determination. This ordinance merely makes that practice consistent with the Code. In addition, the ordinance ratifies all prior determinations of the Board as to restricted parking. Sincerely, rr7��Q Kenneth E.
