AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.
2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND,
INDIANA, PROVIDING FOR THE REZONING OF THE PROPERTY LOCATED IN THE 3500
BLOCK OF NEW PARIS PIKE FROM A-1 AGRICULTURAL DISTRICT TO M-2 GENERAL
INDUSTRIAL DISTRICT AND TO M-2 SU GENERAL INDUSTRIAL SPECIAL USE DISTRICT,
AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A LANDFILL.
WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates
and describes as A-1 Agricultural District the property located in
the 3500 Block of New Paris Pike; and,
WHEREAS, it is the intent and purpose hereof to change the zoning classifica-
tion of said property from A-1 Agricultural District to M-2 General
Industrial District and then rezone said property from M-2 General
Industrial District to M-2 SU General Industrial Special Use Dis-
trict, and to authorize the Special Use of said property as a land-
fille; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan
Commission the day of , 1984, at which
time remonstrances were heard from all parties interested in or
affected by this Ordinance; and,
WHEREAS, the vote of the Richmond City Plan Commission was to
in favor of/in opposition to recommending the passage of Ordinance
No. 114-1984.
SECTION 1. That the zoning classification of the property described below,
and the same is hereby changed to M-2 General Industrial District,
and that said property be regulated in accordance with the Zoning
Ordinance of the City of Richmond, Indiana and all amendments thereto.
Being a part of the Southeast Quarter of Section 23, a part of
the Southwest Quarter of Section 24, a part of the Northeast
Quarter of Section 26, and part of the Northwest and Southwest
Quarters of Section 25, Township 14 North, Range 1 West, in Wayne
Township, Wayne County, Indiana.
Beginning at the southeast corner of the northeast quarter of
said Section 26 and running thence south 89 degrees 26 minutes
03 seconds east 264.66 feet; thence south 33 degrees 06 minutes
15 seconds east 294.57 feet to the centerline of the New Paris
Pike; thence along said centerline north 71 degrees 47 minutes
55 seconds east 193.21; thence north 1995.71 feet; thence south
89 degrees 14 minutes 39 seconds east 1335.19 feet; thence north
00 degrees 20 minutes 46 seconds east 1631.39 feet; thence north.
88 degrees 59 minutes 36 seconds west 1341.32 feet; thence south
00 degrees 16 minutes 09 seconds west 812.32 feet; thence north
89 degrees 14 minutes 39 seconds west 1096.58 feet; thence south
00 degrees 17 minutes 30 seconds east 2078.42 feet to the north-
wardly right-of-way line of Interstate Highway 70; thence along
said right-of-way line south 39 degrees 14 minutes 56 seconds
east 735.62 feet; thence south 89 degrees 26 minutes 03 seconds
east 620.52 feet to the place of beginning.
ALSO, the following described tract, said tract being the south
half of the southeast quarter of Section 23, Township 14 North,
Range 1 West, in Wayne Township, Wayne County, Indiana; EXCEPT
682 feet off the entire west side of the said south half of the
southeast quarter.
SECTION 2. That the zoning classification of the property described above,
and the same is hereby changed to M-2 SU General Industrial Special
Use District, and that said property be regulated in accordance with
the Zoning Ordinance of the City of Richmond, Indiana and all amend-
ments thereto.

SECTION 3. That as provided in Articles 35 and 48 of Chapter 154 of the
Municipal Code, the following described use of the above described
real estate is allowedlas a Special Use as a landfill.
SECTION 4. As a condition of the aforesaid Special Use and as an additional
restriction on said use, the following requirements shall hereafter
and at all times be met by the owners of said real estate.
a. The Special Use site plan accompanying the petition shall be
marked Exhibit "A" and shall become a part of the Ordinance
authorizing the Special Use.
b. A minimum two -hundred (200) foot setback from the Special Use
property line shall be maintained in its natural state as a
buffer for adjoining property. Within the two -hundred (200)
foot setback area, no landfill operation shall be permitted
to be conducted
C. The landfill shall be operated pursuant to the rules, regula-
tions and requirements of the Indiana State Board of Health.
SECTION 5. This Ordinance shall be in full force and effect from and after its
passage and approval as by law required.
