HomeMy Public PortalAbout115-1984 - DEFEATED - VACATION - 15FT UTILITY EASEMENT WITHIN THE HENLEY HILLS SUBDIVISIONORDINANCE N0. 115-1984 AN ORDINANCE VACATING A CERTAIN FIFTEEN (15) FOOT UTILITY EASEMENT WITHIN THE HENLEY HILLS SUBDIVISION, SECTION TWO, IN THE CITY OF RICHMOND, INDIANA, LOCATED BETWEEN LOTS 26, 27 AND 28. WHEREAS, Frank J. and Theresa K. Lavallo desire to make private use of a certain fifteen (15) foot utility easement that is located on their property and situated between Lots 26, 27 and 28 in the Henley Hills Subdivision, Section Two; and, WHEREAS,said easement is not presently being used by any public utility and no objection to vacating said easement has been made by any public utility; and, WHEREAS,the Common Council,, pursuant to the provisions of I.C. 36-7-3-12, conducted a public hearing on said vacation petition on 1984; and, WHEREAS,a study of this Ordinance was conducted by the Richmond City Plan Commission the day of , 1984, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS,the vote of the Richmond City Plan Commission was to in favor of/in opposition to recommending passage of Ordinance No. 115- 1984. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the fifteen (15) foot utility easement described below is hereby vacated: Being all of the fifteen (15) foot utility easement, beginning at the common northwest corner of Lot 26 and the southwest cor- ner of Lot 28 in Henley Hills Subdivision, Section Two, and run- ning thence, from said corner, north eighty-three (83) degrees, thirty-seven (37) minutes and three (03) seconds east, one hun- dred and eighty-five (185) feet to the northeast corner of said Lot 26, also being the northwest corner of Lot 27, thence running north seventy two (72) degrees, six (06) minutes and twenty-three C23) seconds east, one hundred seventy-five (175) to the west right-of-way of Lantern Trail. SECTION 2. This Ordinance shall be in full force and effect from and after the passage and approval as by law required. Lavallo and Theresa R. Lavallo, 3319 Lantern Trail, Richmond, Indiana requesting vacation of a certain utility easement.
