HomeMy Public PortalAbout128-1984 - ORDINANCE AUTHORIZING THE POLICE DEPARTMENT OR FIRE DEPARTMENT TO REMOVE AND TOW ANY VEHICLESORDINANCE NO. 1281984 AN ORDINANCE AUTHORIZING THE POLICE DEPARTMENT OR THE FIRE DEPARTMENT TO REMOVE AND TOW ANY VEHICLES WHICH MAY CONSTITUTE AN IMMEDIATE HAZARD BY WAY OF OBSTRUCTION. WHEREAS, it may be necessary at times for the removal of vehicles which constitute an immediate hazard by way of obstruction; NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond that the f o I lowing be added as Section 74.04 to the City Code: Section 74.04 The Richmond Police Department or the Richmond Fire Department may authorize the towing and/or removal of any vehicle or other object which may, in the discretion and judgement of a properly authorized officer, constitute an immediate hazard by way of its obstruction. The owner of such vehicle or object shall be promptly notified of its removal, the method and manner of removal, and the location of the vehicle or object. The owner of the vehicle or other object shall be responsible for any towing, removal, storage or other charges and fees associated with the removal. The City, its departments, agencies, officers, and employees shall not incur any civil liability for expenses or damages incurred as a result of such removal. The removal of any vehicle or object shall not relieve the owner from liability for any fine or penalty assessable due to the location or placement of said vehicle or.object prior to its towing or removal. ORDINANCE NO. 128-1984 - AN ORDINANCE AUTHORIZING THE POLICE DEPARTMENT OR THE FIRE DEPARTMENT TO REMOVE AND TOW ANY VEHICLES WHICH MAY CONSTITUTE AN IMMEDIATE HAZARD BY WAY OF OBSTRUCTION.
