WHEREAS, John and Rebecca Lahman and Susan Wilson have petitioned the Common Council of the City of Richmond requesting to vacate a certain twenty (20) foot alley; and, WHEREAS, the Common Council, pursuant to the provisions of I.C. 36-7-3-12, conducted a public hearing on said vacation petition on 10,,E 3 , 1984; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the ?;?a day of , 1984, at which time remonstrances were hearld from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was to O in favor of/in opposition to recommending passage of Ordinance No. 139-1984. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That subject to the preservation of all easements for utilities, the public way described below is hereby vacated: Being all of the twenty (20) foot alley which lies between Lots 69 and 70 in the Earlham Heights Addition, running east and west between a twenty (20) foot north - south alley and the west line of Southwest.14th Street. SECTION 2. This Ordinance shall be in full force and effect from and after the passage and approval as by law required. PETITION FOR VACATION OF A CERTAIN PUBLIC WAY The Petitioners, Susan Wilson, and John and Rebecca Lahrman, pursuant to the provisions of I.C. 36-7-3-12, petition the Common Council of the City of Richmond, Indiana as follows: (1) The Petitioners are owner, occupants of single -.family dwellings in a predominately residential neighborhood. (2) Abutting the Petitioners' property is a twenty (20) foot wide alley that has never been developed andserves no public purpose. (3) The Petitioners are presently maintaining the right-of-way of said alley and desire to have better control over access to their prop- erty for improved security. The Petitioners also desire to utilize said alley right-of-way in conjunction with the use and enjoyment of their single-family dwellings. (4) Therefore, the Petitioners seek to effect the vacation of the public right-of-way described below: Being all of the twenty (20) foot alley which lies between Lots 69 and 70 in the Earlham Heights Addition, running east and west be- tween a twenty{20) foot north -south alley and the west line of Southwest 14th Street (5) The Petitioners, as listed below, own all the land abutting the right-of-way proposed to be vacated. (6) A list of those utility companies who will be contacted to ascertain the effect of the proposed vacation upon the existing utility services is set forth in the attached Exhibit "B", made a part hereof, and in- corporated herein. It is acknowledged by the Petitioners that the vacation herein requested should be conditioned upon the preservation of presently existing utility easements and rights -of -way. WHEREFORE, the Petitioners, Susan Wilson, John and Rebecca Lahrman, respectfully request that a public hearing be conducted on their petition for the vacation of the above described public way in accordance with the provisions of IC 36-7-3-12 and IC 5-3-1-1, et seq.
