ORDINANCE NO. 1 - 1980
AN ORDINANCE ALMIORIZING CERTAIN' EXPENDITURES
AND ACTIVITIES OF THE RICVOND POWER & LIGHT
AND MATTERS RELATED THERETO.
iJFREAS, the City of Richmond is the owner of and engaged
in operating an electric utility system supplying said City and the
inhabitants thereof with electricity for public, domestic and industrial
uses under the style of Richmond Power $ Light (R P & L); and
WHEREAS, it has come to the attention of the Common Council
that the Indiana State Board of Accounts has questioned certain
expenditures and activities of R P � L in the audit reports for the
years 1976 and 1977 which expenditures this Council has previously
approved as being appropriate, necessary to the operations of R P & L
and of an ordinary nature consistent with the day to day operations of
a municipal electric utility; and
WHEREAS, this Council has been advised by its attorneys that
the Council has authority to adopt an ordinance permitting and authorizing
expenditures of the nature questioned by the Indiana State Board of
Accounts pursuant to the provisions of IC 18-1-1.5-16 (Indiana Home Rule
Act), IC 8-1-2-100 (Public Service Commission Act) and the residual,
inherent and incidental powers of municipalities in the State of Indiana;
and
IfflERFAS, this Council deems it in the public interest and in
the best interest of R 'P & L to authorize activities and expenditures
related to recreational activities of employees, customer relations
of R P<;1 L, memberships by R P $ L in various civic and professional
organizations, and other expenses of a similar nature all of which were
questioned by the Indiana State Board of Accounts in its audit reports
although, for the most part, these expenditures Mould have been per-
missible for the City of Richmond pursuant to the provisions of
IC 18-6-12-1;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF RIG14OND:
Section 1. That the following activities and expenditures
related thereto are hereby authorized for Richmond Power q Light:
(a) The General Manager is authorized to take out
memberships for R P & L for the Richmond Area Chamber of Commerce,
Ric=ond Area Management Association, National Association of
Accountants, American Society for Personnel Administration and other
organizations of a similar nature which the General Manager deems will
further the objectives and operations of R P F L.
(b) Employees of R P F L who attend., on behalf of
R P $ L, luncheons, dinner meetings, conferences and activities of a
similar nature shall be reimbursed for their meals and incidental
expenses related to such attendance. In addition, guests of R P $ L
attending conferences and meetings on behalf of R P � L, shall have
their meals paid for by R P � L.
(c) R P & L is authorized to pay the entry fees for its
employees in bowling leagues, softball leagues, and is further
authorized to pay for the incidental equipment for its employees
including bowling shirts, softball jerseys, related athletic equipment,
incidental expenses related to such recreational activities and the
rental of facilities.
(d) R P L is authorized to pay for community service
advertising which will further its customer relations and community
standing including holiday greetings, advertisements in Richmond area
publications, and such other advertising expenses of a similar nature.
(e) R P & L is authorized to pay educational and
instructional course expense for its utility employees of a reasonable
nature.
(f) R P & L is authorized to engage in and pay for
civic expenses and activities required by the Common Council or other
governmental officials of a reasonable nature.
(g) R P & L is authorized to pay expenses incurred in
promoting good customer relations with its residential, industrial and
commercial purchasers of power.
(h) R P $ L is authorized to engage in activities and
expenditures of a reasonable nature which will promote good relations

with its employees including but limited to the issuance of award
plaques, the sending of flowers to employees and their families as
occasions warrant, and activities of a similar nature.
(i) R P q L is authorized to advance to its employees
funds that may be required by them to travel on behalf of R P & L.
Section 2. Expenditures and activities of R P $ L in con-
formity with the provisions of Section I herein heretofore made by
R P & L are hereby retroactively approved.
Section 3. If any of the provisions of this ordinance or
the application thereof to any person or circumstances are held invalid,
such invalidity shall not affect other provisions or applications of
this ordinance which can be given effect without the invalid provision
or application, and to this end the provisions of this ordinance are
declared to be severable.
Section 4. All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
Section 5. This ordinance shall be in full force and effect
from and after its passage and signing by the Mayor.
Passed and adopted by the Common Council of the City of
Richwnd on the 1-1-6A day of February,1980•
