AN ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-3 ONE -TO -EIGHT FAI=
RESIDENCE DISTRICT FOR A MEDICAL AND/OR DENTAI, OFFICE ON PROPERTY TD-
CATED AT 1921 CHESTER BOLI.EtTARD, PURS= TO ARTICLE 48 OF CHAPTER. 22
OF THE I[MCIPAL CODE CM9]NLY KNOWN AS THE ZONING ORDINANCE Or UZ
CITY OF RTGMND, TNDIANA.
WHEFT-AS, Article 21 of Chapter 22 of the Municipal Code allows medical
and/or dental offices by Special Use authorization as provided
in Article 48 of said Chapter; and,
WHEREAS, a notice was given and a public hearing on this Ordinance was
conducted y the Richmond City Plarrdng Caunission the IA "OL
day of , 1980, at which time remonstrances
were heard all p ties interested in or affected by this
Ordinance; and,
WHEREAS, the vote of the Richmond Planning Commission was to

NO6d THEREFORE BE IT ORDAINED by the Corr m Council of the City of Richmond,
Indiana, as follows:
SECTION 1. As provided in Article 21 of C€iapter 22 of the Municipal Code,
the following described use of the following described real estate
is allowed as a Special Use for a medical and/or dental office at
1921 Chester Boulevard in the City of Richmond, Indiana; more parti-
cularly described; to wit:
A part of the Southwest quarter of Section 21, and part of
the Northwest Quarter of Section 28, both in Township 14
North, Range 1 West, in the City of Richmond, Wayne County,
Indiana., and being more particularly described as follows:
BeginniT g at a point 165 feet north, and 264 feet east of
the southwest corner of the Southwest Quarter of Section 21,
and running thence, from said beg;,,,; g point, east, a
measured and deed distance of 50 feet; thence north, a
measured distance of 72.27 feet (68.66' by deed)to an
established fence line, being Alexander's north line; thence
east, and along said fence line, a measured distance of 490
feet (508.36' by deed) to an established fence line; thence
south, and along said established fence, a measured distance
of 243.45 feet (233.66' by deed) to a marked stone in the
south line of the southwest quarter of said Section 21; thence
east, along the south line of Southwest quarter of said Section
21, a measured distance of 283.10 feet (271.26 by deed); thence
south, parallel to the west line of the Northwest Quarter of
said Section 28, a distance of 165 feet; thence west, parallel
to the north line of said Northwest Quarter, a mna cured and
deed distance of 829.62 feet; thence north., parallel to the
viest lines of said Northwest Quarter of Section 28 and the
southwest Quarter of Section 21, a measured distance of 330
feet to the place of beginning, containing a total area of
6.09 acres, more or less, there being 2.95 acres, more or
less, in the soutN-nst Quarter of- said Section 21, and 3.14
acres, more ar less in the NortlTaest Quarter of said Section
28; and being and including all the land owned by Van C.
Alexander and Helen Alexander, Husband and Wife, in the North-
west Quarter of Section 28, and in the Southwest Chuarter of
Section 21, except a tract in the No-thwest corner of Grantor's
said land, which tract contains Grantor's dwelling house front-
ing on United States Highway No. 27 and which tract is approxi-
nately 68.66 feet North and South, and 314 feet east and west
and which tract lies in the Southwest Quarter of Section 21.

ALSO: Part of the southwest quarter of Section Twenty-one
(21), and part of the northwest quarter of Section Twenty-
eight (28), all in Township fourteen (14), Range one(I)
west, bounded and described as follows, to -wit: Begirniing
at the southwest corner of said Section Twenty-one (21)
at a marked stone in the Richrnond and Fountain City Turnpike;
thence north 10 rods to a marked stone; thence east 16 rods
to a marked stone; thence south 20 rods to a marked stone in
Section M,7enty-eight (28), thence vest 16 rods to the crest
line of Section Ttgenty-eight (28); thence north 10 rods to
the place of bed ing, containing; two (2) acres, more or
less.
SECTION 2. As a condition of the aforesaid Special Use and as an additional
restriction on said use, the following requirenents shall hereafter
and at all times be met by the comer, leasee or any person, firm or
corporation using, said real estate.
a. The site plan which is made a part of the Ordinance should
be dated, marked Exhibit "A" oC Ordinance No. 2-1980.
b. The Special Use authorization shall be considered mull
and void should the Special Use cease for a period of
one (1) year or more.
c. As a condition of being granted the Special Use and prior
to the issuance of an Tmprovement Location Permit, a 50
foot easement- along the south property line shall be granted
to the City of Richmond until such time as a street is con-
structed, and said street is dedicated and accepted by the
Citv.
d. As a condition of being granted the Special Use, an access
drive shall be constructed within easement rmntioned in
"c" above. Said access drive shall have a ndnimm width
of 24 feet and shall be constructed to be compatible with
city street standards.
e. As a condition of being granted the Special Use and prior
to the issuance of an Improvement Location Permit, a detailed
site drainage shall be prepared and submitted to the City
Engineer for approval.
f. As a condition of being granted the Special Use, the northern
most curb cut on the property shall be closed.
SECTION 3. The Zoning Administrator of the City of Richmond, Indiana, is
hereby authorized and directed, upon enactment and publication
of this Ordinance, to record and approve the issuance of a permit
for the establistment of the use herein allowed.
SECTT_0N 4. This Ordinance shall be in full force and effect from and after
its passage and approval by the Mayor, and publication as by law
required.
