IZME EAS, Article 21 of Chapter 22 of the Nnmicipal Code allows medical and/or dental offices by Special Use authorization as provided in Article 48 of said Chapter; and, WHEREAS, a notice was given and a public hearing on this Ordinance was conducted by he Richmond City Planning Commission. the day of c 1980, at which time remron strances were heard from 1 parties interested in or affected by this Ordinance; and, WHEREAS the vote of the Richnond Planning Commission was / 0 to p in favor ofJ' reconmeamding the passage of Ordinance No. 10-1980. NOW nERE ME BE IT ORDAINED by the Cameron COUnci1 of the City of Rich- m nd, Indiana, as follows: SECTION 1. As provided.in Article 21 of Chapter 22 of the nmiicipal Code, the following described use of the following described real estate is allowed as a Special Use for . medicaL and/or dental offices at 1915 Chester Boulevard in the City of Rich- mond, Indiana; more particularly described; to wit: Being a part of the northwest quarter of Section 28, Township 14 north, Range 1 west, in Wayne Township, Iaayne County, Indiana, and being, nore particularly described as follows: Beginning at a point in the west line of the northwest quarter of said Section 28, said point being 165 feet south of the northwest corner of said quarter, and running thence from said beginning point, east, parallel to the north line of said quarter, 1093.62 feet; thence south, parallel to the west line of said quarter, 146 feet; thence west parallel to the north line of said quarter, 1093.62 feet to a point in the west line of said quarter; thence north, along said west line, 146 feet to the place of beginning, containing an area of 3.67 acres, nnre or less, nosy a part of the City of Riclunond. SECTION 2. As a condition of the aforesaid Special Ilse and as an addi- tional restriction on said use, the following requirements shall hereafter and at all tunes be rmt by the owner, leasee or any person, firm or corporation using said real estate. a. The site plan accmpanying the petition be identified as Exhibit "A" and made a part of Ordinance No. 10-1980. b, The Special Use authorization shall be considered mll and void should the Special Use cease for a period of one (1) year or more. c. As a_ccomid t4on df being granted the Special Use and prior to the issuance of an Improvement Location Per- mit, a detailed site drainage plan shall be prepared and submitted to the City Engineer for approval. d. In order to promote the general health, safety and welfare and alleviate potential traffic safety hazards on Chester Boulevard caused as a result of the subject Special Use being granted, the owners, leasees or any person, firm or corporation using said real estate agree as a condition of being granted the Special Use, and as an additional restriction on said use, to construct on the subject property at 1915 Chester Boulevard an access drive and curb cut on to Chester Boulevard to be compatible with City standards. However, in the event of Special Ordinance No. 2-1980 being approved, the owners shall close ;A u­cc eii i­ and rimh rhif- rm to and ORDINANM NO. 10-1980 Page Two (1) To share a ccumon access on Chester Boulevard with the property imwdiately adjoining to the north; and, (2) To construct an moved access drive compatible with city street standard to be located in the 50' right-of-way easmmt granted to the City of Richmond by Dr. Gerald Ackerman. Said access drive shall be the sole means of ingress and egress serving the subject Special Use preclud- ing any further access from Chester Boulevard; and, (3) To cost share in the construction of said access drive with the comer of the property adjoining iumediately north in accordance with a formula derived and agreed upon by the property* owners involved. SECTION 3. The Zoning Administrator of the City of Ricbmond, Indiana, is hereby authorized and directed, upon enactzyient and publication of this Ordinance, to record and approve the issuance of a per- mit for the establishment of the use herein. allo-rmd. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval by the Aayor, and publication as by law required.
