DEVELOPME1E UNIT PROJECT LOCATED AT 422 SOUTH SEVENTH STREET PURSLANT TO ARTICLES 48 AND 45 OF CHAPTER 22 OF THE KMCIPAL CODE, BEING ORDINANCE NO. 2325- 1968 COPM NLY MMN AS THE ZONING ORDINANCE OF THE CITY OF RICH- MOND, INDIANA. iFREAS., pursuant to Article 45 of Chapter 22 of the 11,1micipal Code, the Rickmund City Plan C unission has conducted a public hearing on the preliminary plan of the subject Residential Development [nit Project and made the follow- ing findings: 1. It complies with the Coprehensive Master Plan for the City of Richmond. 2. It will not adversely affect neighboring property. 3. It is at a location ,There traffic congestion does not exist at present on the streets to be utilized in don junctim tizera,7i.th, tmdue congestion is not likely to be created as a result of this project. 4. The site development plan provides for integrated and Im monious design of buildings, and for adequate and properly arranged facilities for internal traffic circulation, off-street parking and loading, land- scaping, and such other features and facilities as may be necessary to make the project attractive and efficient from the standpoint of the developer as well as from the standpoint of the adjoining or surrounding existing or potential developments. 5. The site for the subject Residential Development Unit Project is zoned R-3 One -to -Eight Family Residence District and is appropriate for the development pro- posed. 6. The Richmond City Plan Commission is satisfied the proponents of the development project intend to com- plete the project within a reasonable time. wL21TiAS, Pursuant to Article 45.051 of Chapter 22 of the Municipal Code the developer has requested the following modifications to the requirements and standards relating to a Development - Unit Project be granted. Article 45.032 - Minimum Project Frontage. be reduced from 150 feet to 48.3 feet. 2. Article 45.033 (b) - Minimum Yards: be reduced from 30 feet to S feet for the north yard and 8.5 feet for the south yard. The real estate described below situated in the City of Richmond, Wayne County, Indiana is and the same is hereby authorized a Special Use for a Residential Development Unit Pro j ect. Being Lot Numbered 311, and 6.00 feet off the entire north side of iot Number 310, both being in the Official Map of the City of Riclrwnd, Indiana, and being more particularly described as follows: Beg, rn at an iron pipe set at the northeast corner of lot Number 311 in said Official Map, and running thence, from said beginning point, southgardly, along the east line of said lot, and along the east line of said Lot 310, and along the west line of South 7th Street,.48.80 feet to a solid iron rod set; thence westwardly, parallel to the north line of said lot 310, 275,75 feet to a point on the west line thereof, and on the east line of a 16.50 feet wide public alley; thence nprthwardly, along the east line of said alley, and along the west line of said Lots Numbered 310 and 311., 49.50 feet to an iron pipe set at the northwest corner of said Tot Numbered 311; thence eastwardly, along the north line of said Lot, 269.37 feet to the place of beginning. SUBiECT TO: Any easements of record. SEC110N 2. The minl= project frontage as specified in Article 45.032 of Chapter 22 of the Municipal Code for the subject Residential Development Lint Project is hereby reduced to 48.8 feet. =ION 2.01, The minimuw yards as specified in Article 45.033 relating to the depth from adjoining perimeter property for the subject Residential Development ilnzt Project is hereby reduced to S feet from the northern property line and to 8.5 feet from the southern property line. SECTION 3. As a condition of the aforesaid Special Use and as an addi- tional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate: a, project frontage, side yard widths, and distance between building in the Residential Planned Unit Development shall be in accordance with the. plans and detail sheets attached hereto and made a part hereof and marked Exhibit ''A" and which shall be the Final Plan as defined and described in Article 45 of the Zoning Ordinance of the City of Ridmvnd, Indiana. b. As a condition of being granted the Special Use, and prior to the issuance of an Improvement Location permit, all ease - meets as shown an the site plan, marked EFlhibi_t "X' and made a part hereof, shall be executed for the following purposes and, in the form satisfactory to the City Attorney and properly recorded in the Office of the Wayne County Re- corder. Solar easements fnm the City of Richmond. 4) Parking easanent along the alley. c. Sanitary ,sever plans shall be approved by the Richnond Sanitary District Board of Commissioners. d. As a condition of being ranted the Special Use and prior to the issuance of an improvement Location Permit, a de- tailed site drainage plan shall be prepared and submitted to the City Engineer for approval. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. The petition also requests that modifications to Development Unit Project requirements and standards be granted as follows: 1. minimum project frontage be reduced from 150 feet to 48.8 feet; and, 2. miniT= yards adjoining perimeter property be reduced from 30 feet to 8 feet for the north yard and to 8.5 feet for the south yard. Eighteen (18) notices of public hearing.Wre sent to adjoining property ominers with none returned. No one spoke in opposition to the request the public hearing.
