AN ORDINANCE AUTHORIZING A SPECIAL, USE IN A R-3 ONE -TO -EIGHT FAMILY
RESIDENCE DISTRICT FOR. AN ACCESSORY OFF-STREET PARKING FACILITY ON
PROPEVY LOCATED AT 123 SOUTH 7TH STREET, PURSU= TO ARTICLES 48
AND 41.012 OF CHAPTER 22 OF THE , MCTPAL CODE CONDNLY KNOWN AS
THE ZONING ORDINANCE OF THE CITY OF RICIMND, INDIANA.
WdE1iFA3, Article 41.012 of Chapter 22 of the Municipal Code allows
accessory off-street parking facilities in it Districts
which abut directly any C or 11 District by Special Use
authorization as provided in Article 48 of said Chapter;
and,
WHEREAS, a notice was given and a public hearing on this Ordinance
was conducted by t .Richmmd City Planning Conmission the
*+ day of 1980, at which time
remonstrances were heard from all parties interested in or
affected by this Ordinance; and,
WHEUAS, the vote of the Richmond City Planning Crnrmission was ��
to 0 in favor ofJi recornen.ding the
passage of Ordiu%ice No. 25--1980.
NOW THEREFORE BE TT ORDAINED by the Common. Council of the City of Rich-
mond, Indiana, as follows:
SECTION 1. As provided in Article 41.012 of Chapter 22 of the M_u cipal
Code, the following described use of the following described
real estate is allowed as a Special Use for an accessory off-
street parking facility at 123 South 7th Street in. the City of
Richmond, Indiana; more particularly described; to wit:
Being lot Number 28 in Abraham Phillips's
Addition to the City of Richmond, Indiana
SECTION 2. As a condition of the aforesaid Special Use: and as an addi-
tional restriction on said use, the following req irements
shall hereafter and at all times be met by the owner, leasee
or any person, firm or corporation using said real estate.
a. The site plan accompanying the petition be identified as
Exhibit "A" and made a part of Ordinance No. 25-1980,
b. As a condition of being granted the Special Use and
prior to the issuance of an Improvement location Per-
mit, a detailed site drainage plan shall be prepared
and submitted to the City Engineer for approval.
c. The accessory off-street parking facility shall be
developed in accordance with the standards set forth
in Article 41 of Chapter 22 of the Municipal Code
except that a planting area at least three (3) feet
in width of non -deciduous greenery and at least four
(4) feet in height may be substituted along the
southern property line in lieu of a solid .fence or
masonry wall to provide effective and adequate screen-
ing of the parking facility from the adjoining R-District.

SECTION 3. The zoning Administrator of the City of Richwnd, Indiana,
is hereby authorized and directed, upon enactment and publica-
tion of this Ordinance, to record and approve the issuance of
a permit for the establishpent of the use herein allm%ed.
SEMON 4. This Ordinance shall be in fvll force and effect from
and after.its passage and approval by the Mayor, and publi-
cation as by law required.

The Ric =rvd City Fan Cauiu.ssion held a public hearing on lVesday,
March 25, 1980, on the petition of Raymond and Carol Knoll, Karl
and. Beverly Knlger and George and Marilyn ."Dowers; Raymond Knoll,
Agent, requesting Special Use authorisation for a proposed —
off -street parking facility to be accessory to the present Social
Security office located at 123 South 7th Street situated in a
R-3 One -to -Eight Family Residence District.
Fourteen (14) notices of public hearing were sent to adjoining pro-
perty owners with one (1) returned in favor and none returned in
opposition to the request. During the public hearing no ors spoke
in opposition to the request.
The Plan. Commission determined that the request does fulfill the
requirements of Article 48 of the Zoning Ordinance regarding the
granting of a Special Use. Therefore, the Plan Cocmiission voted
seven (7) to zero (0) to reccam mend the Special Use be. authorized.
