Regular City Council Meeting
July 9, 2008

Mayor Royce Phillips called meeting to order at 6:32p.m.
Roll call of Council members present; Chris Ball, Jim Bartels, Mike Gericke, John Wright. Absent Mark Petersen.
Also present Attorney Steve Greenleaf, Engineer Mike Hart, Building Inspector Ed Johnson, City Clerk Ruth
Demuth.
Community Forum: Jennifer Jordan, with Iowa City Solid Waste, representing Eastern Iowa Council of
Governments regarding the renewal of the DNR mandated 28E agreement to continue the with the Solid Waste
Reduction Plan. Motion Wright seconded Bartels to add Resolution and 28E agreement approval to August regular
City Council agenda. All actions approved by all unless so noted.
Ted and Tim Spivey presented additional questions on Ireland Ave extension. Questions ranged from offers to
purchase property from residents on College St to dead-ending Railroad St, and status of railroad property between
Railroad St and railroad to west of county facility. City Council members approved Engineer's office to produce
additional maps for the public of Ireland Ave Extension concept designs.
Motion Wright seconded Gericke to approve minutes for June 11, 23, and 30, 2008 City Council meetings.
Motion Wright seconded Gericke to approve receipts and expenditures including approval of$3,915.00 to AR
Fence for fencing installed'on Roberts Ferry Rd. Project.
Mayor Phillips updated council members on progress of purchase of Johnson County facility south of Railroad St..
Johnson County Supervisors and attorneys finalizing agreement on purchase.
Motion Wright seconded Gericke to accept work completed by LL Pelling on street repairs and approve payment.
Council members reviewed update Planning and Zoning recommendations to Future Land Use Map. Motion
Wright seconded Ball to table approval. Motion Ball seconded Wright to hold joint meeting with P&Z on August 6,
2008 to discuss and further review Future Land Use Plan and Map. Attorney Greenleaf reminded council members
changes to current zoning map will require amendment to Zoning Ordinance and update written Future Land Use
Plan. Attorney Greenleaf also suggested that Fringe Area agreements be reviewed with neighboring cities. Mayor
Phillips suggested maps be produced for all P&Z and Council members prior to meeting. Mayor Phillips reminded
Council members of meeting with Johnson County Planning and neighboring cities to be held at Johnson County
Administrative Building on July 15, 2008.
Discussion held by Council members on new commercial building permits and fees. Motion Wright seconded
Gericke to read by title only Resolution 2008-15 Establishing New Building Permit Fees and Inspection Fee For All
Commercial and Industrial Zoned Properties. Motion Wright seconded Gericke to approve Resolution 2008-15.
Motion Wright seconded Gericke to read by title only Resolution 2008-16 Approving Entering into the Amendment
and Extension of the Contract With Johnson County Refuse for Trash Collection and Recycling Services. Recycle.
rates approved $5.00 per month and $2.50 for seniors per month.
Discussion held by council members on Timber Ridge View punch list items yet to be resolved. Attorney Greenleaf
reported that owners will forward $115,000 owed to City to be escrowed until completion of punch list items.
Ownership of development has changed and feels City of Tiffin protected by sub-dividers agreement and by lien on
sale of lots in subdivision. Council members agreed to take no action on releasing lien on property until later date.
Engineer Hart still has not been able to contact homeowners to obtain easement for drainage correction in Song •
Bird.
Gericke obtained a bid for concrete work which includes accessible parking on Second Street in front of City Hall.
Motion Wright seconded by Ball to approve$5,516.55 bid for from Poured Walls of Iowa.
Review of Ordinances on Animals discussed by Council members. Discussion covered need for adding to
"dangerous animal" listing of certain breeds of dogs, procedures for picking up and handling stray animals, and
possibly increasing number of allowable animals on property. Attorney Greenleaf advised Council members to
consider obtaining additional training for city employees regarding the handling of stray animals. Council members
agreed to further review additional information on Animal Ordinance.
Discussion on Peddlers and Solicitors Ordinance held. Council members discussed need to include enforcement
penalties for municipal infractions regarding Peddlers and Solicitors in violation of City Ordinance governing such
individuals. Discussion held on increasing required Surety Bond to$1000.00.
Council members asked Attorney Greenleaf to develop'amendment to Ordinance for Council approval at August
13, 2008 regular City Council meeting.
Motion Wright seconded Ball to approve 2006 Residential International Building Codes. Ed Johnson, Building
Inspector explained to Council members need for better enforcement of building codes, questionable practices by
builders in past regarding inspection procedures, and enforcing penalty enforcement in future. Gericke suggests
educating builders on new building codes. Attorney Greenleaf will review Ordinances regarding inspection
enforcement and penalties, and research setting up Building Plan Review Board. Engineer Hart suggests including
additional improvements to inspection procedures.
Council requested Attorney Greenleaf to draft an amendment to Ordinance to include penalty enforcement for
August 13, 2008 regular City Council meeting.
Motion Bartels seconded Ball to approve Alcohol License for TiffnFest.
Motion Bartels seconded Wright after Council discussion to approve Resolution 2008-18 Approval of Alliant
Energy to install two Town and Country Street Lights on Hickory Ct in Woodfield Ridge sub-division for security
lighting.
Motion Wright seconded Ball to set Public Hearing for regular City Council meeting August 13, 2008 regarding
Ireland Avenue Extension. Council members asked Mayor Phillips to limit speakers at Public Hearings to five
minutes. Council members requested Clerk to mail copy of Public Hearing notice to all residents affected by
Ireland Avenue Extension.
Motion Wright seconded Gericke to approve Engineer Hart to proceed with Villages water main extension design
project.
Motion Wright seconded Gericke to set date for Villages Water Main Extension Public Hearing for regular City
Council meeting for August 13, 2008.
Motion Wright seconded Gericke to approve Mayor Phillips to secure financing for water main extension.
Motion Wright seconded Bartels to approve purchase of Oxygen Sensor Probe for sewer plant at cost of$3,320.00.
Motion Wright seconded Bartels to approve purchase Trash Pump to replace broken pump that failed during
excessive rain that threatened sewer plant. Council members amended motion to allow Mayor Phillips to further
investigate possible repairs to old pump versus purchase of new pump.
Discussion held on vacancies on Board of Adjustments, Community Foundation, and TiffinFest Committee.
Council members requested Work Session to plan for future trails on Wednesday July 16, 2008. Mayor Phillips
reported to Council members of Parks Survey will be sent out to residents for future planning of parks in Tiffin.
Engineer Hart reported on Hwy 6 Widening Project in draft planning phase. Gericke will do walk through with
Engineers on punch list for Roberts Ferry Rd Project. Sanitary Sewer Televising Project delayed one week.
Council members asked Deer View park plan item put on Agenda for joint P&Z and City Council meeting for August
6, 2008.
