A special meeting of the Leesburg Town Council was held on April 1, 1997 at 6:30 p.m., in the second
floor Councilmember's meeting room in the Municipal Government Center, 25 West Market Street,
Leesburg, Virginia. Notice having been delivered to all members of the Leesburg Town Council,
priorthereto. The purpose of the meeting was to discuss the acquisition of real property and barment
notice policy. The meeting was called to order by Vice'Mayor Webb.

Discussion was held by the Deputy Town Attorney, Chief of Police and Captain regarding
barment notice policy.
MOTION:
On motion of, and duly seconded, the following resolution was proposed and adopted.
97-77 - RESOLUTION - SUPPORTING THE TOWN POLICE PRO(3EDURES TO
ISSUE BARMENT NOTI(~E$ IN LEESBURG
WHEREAS, the town police are acting and have acted as agents of private property
owners to issue barment notices to individuals on private property as identified by the
private property owners; and
WHEREAS, the issuance of barment notices by the town police has been a successful
procedure in discouraging criminal and drug related activity especially in the northeast
quadrant; and
WHEREAS, the Town desires to ratify and confn'm the issuance of barment notices
by the town police and to authorize the issuance of barment notices by the town police
throughout the entire town.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
The policy of the town police issuing barment notices on private property to such
individuals as identified by private property owners is hereby ratified and authorized as a
procedure to be utilized by the town police to ensure the health, safety and welfare of all
citizens of the Town of Leesburg throughout the entire town.

Aye: Councilmembers Buttery, Emswiller, Trocino, B. J. Webb, and William F. Webb
Nay: None.
Absent: Mayor Clem and Councilmember Umstattd
MOTION:
On motion of, and duly seconded, the original motion was amended and made.
Pursuant to Section 2.1-344 of the 1950 Code of Virginia, as amended, I move that
the Leesburg Town Council convene in Executive Session. 'The authority for this Executive
Session is found in Section 2.1-344 (a), Subsections (1) and (3) of the 1950 Code of Virginia,
as amended. The purpose of this Executive Session is to consider a personnel issue
regarding Thomas Grey and to consider the acquisition of real property.
The Deputy Town Manager, Deputy Town Attorney, Director of Planning, 'Zoning
and Development, Director of Engineering and Public Works, Chief of Police, Captain Chris
Jones and Assistant Town Manager for Economic Development are requested to remain for
the executive session.

Nay: None.

MOTION:
On motion of, and duly seconded, the following resolution was proposed and adopted.
97-78 - RESOLUTION - CERTIFYING EXECUTIVE SESSION OF APRIL 1, 1997
WHEREAS, the Town Council of the Town of Leesburg, Virginia, has this day
convened in Executive Session in accordance with an affirmative recorded vote of the
Leesburg Town Council and in accordance with the provisions of the Virginia Freedom of
Information Act:
NOW, THEREFORE, BE IT RESOLVED that the Leesburg Town Council does
hereby certify that to the best of each member's knowledge, 1) only public business matters
lawfully exempted from open meeting requirements under the Freedom of Information Act
were discussed in the Executive Session to which this certification applies; and 2) only such
public business matters as were identified in the Motion by which the said Executive
Session was convened were heard, discussed or considered by the Leesburg Town Council.
