AN ORDINANCE ALTDRIZING AND APPROVING THE SALE
OF CERTAIN ININTROVED REAL ESTATE IN THE CITY
OF RICBUZ, INDIMA.
WHEREAS, a certain area, described in the attached Exhibit "A", is
needed by the Department of Energy of the City of Richmond
to construct solar homes; and
WHEREAS, the area, referred to above, is not now used or in the fore-
seeable future needed for park and recreation purposes as
evidenced by two resolutions passed and adopted by the Board
of Parks and Recreation of the City of Richmond, Indiana,
attached hereto and marked as Exhibit "Y ; and
WHEREAS, the Board of Parks and Recreation by said resolution has
deemed it desirable to sell said real estate as described
in Exhibit "A referred to above, to Malcolm Miles to enable
such purchaser to build solar homes thereon; and
WHEREAS, the Board of Parks and Recreation having adopted resolutions
approving the sale and said resolutions being Exhibit "B"
hereto were presented to the City Clerk for presentation
to the Common Council of the City of Richmond and were so
presented; and
M1EREAS, the Board of Public Works and Safety has approved such offer
and sale as evidenced by its resolution attached hereto and
marked as Exhibit "C"; and
WHEREAS, the sale of the area, referred to above, for the purpose
requested, is in the best intent of and the general welfare
of the people of Richmond, Indiana.
NOW, THEREPORE, BE IT ORDAINED by the Common Council of the City of
Richmond, Indiana, as follows:
Section 1. It is hereby found advisable to sell the real estate described
in. Exhibit "A" hereof.
Section 2. It is hereby found that the utilization of such real estate
for the building of solar homes will serve the public purpose and will
be of benefit to the health and welfare of the City of Richmond.
Section 3. The offer to purchase approved by the Board of Parks and
Recreation and the Board of Public Works and. Safety is hereby approved
and such offer shall be incorporated herein by reference and shall be
entered in the: minutes of the Common Council and kept on file by the
City Clerk.
Section 4. The Mayor and City Clerk are authorized to execute any and
all documents on behalf of the City of Richmond which may be necessary
or desirable to complete the transaction.
Section S. The Mayor and City Clerk, acting upon the advice of the
City Attorney, are authorized to make any revisions in the documents
which may be deemed necessary or desirable to more fully accomplish
the purposes of the transaction and to execute such document or
documents as revised without further submission of such revised docu-
ments to the Common Council.
Section 6. This ordinance shall be in full force and effect from and
after its passage and signing by the Mayor.
