HomeMy Public PortalAbout1997_04_29 SPECIAL MEETING MINUTES OF APRIL 29, 1997 A special meeting of the Leesburg Town Council was held on April 29, 1997 at 7:30 p.m., in the First Floor Executive Conference Room. Notice having been delivered to all members of the Leesburg Town Council priorthereto. The purpose of the meeting was to conduct a budget worksession. The meeting was called to order by Mayor Clem. COUNCILMEMBERS PRESENT J. Frank Buttery, Jr. Jewell M. Emswiller Joseph R. Trocino Kristen C. Umstattd (absent) B. J. Webb William F. Webb, Jr. Mayor James E. Clem STAFF MEMBERS PRESENT Town Manager Steven C. Brown Deputy Town Manager Gary A. Huff After discussion on the proposed budget the following actions were taken. MOTION: On motion of, and duly seconded, the following Ordinance was proposed and adopted by a roll call vote: 97-0-11 - ORDINANCE -AMENDING ARTICLE 1 OF CHAPTER 17 OF THE TOWN CODE TO REVISE THE REAL ESTATE TAX RATE FOR 1997 WHEREAS, the proposed budget for fiscal year 1998 is balanced with a real estate tax rate of $0.22 per $100 assessed value for 1997 real estate taxes. THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. Section 17-1 of the Town Code is amended to read as follows: Section 17.1. Annual Levy and Rate of Taxes. Taxes shall be levied and collected as provided by law on taxable real estate, tangible personal property and bank capital in the town for each fiscal year beginning July 1 and ending June 30 for the support of the town government, payment of interest on town debt, and for other town purposes. Every person assessed taxes by the town shall pay them as required by law. (1) Taxes on all real estate and all tangible personal property, except the property of public service corporations, shall be as follows: Classification of Property (a) Real Estate Co) (c) (d) Vehicles uses as mobile homes of offices Aircraft All other tangible personal property Rate of Tax per $100 Assessed Value $9.2! $0.22 $9.2! $0.22 $0.001 $1.00 (2) Taxes on all real estate and all tangible personal property of public service corporations shall be as follows: Classification of Property (a) Real estate (b) Tangible personal property Rate of Tax per $100 Assessed Value $9.2! $1.00 $0.22 SECTION II..4Al prior ordinances ,and resolutions in conflict herewith are repealed. SECTION III. This ordinance shah be in effect upon its passage for tax year 1997. VOTE: Aye: Councilmembers Buttery, Emswiller, Trocino, B. J. Webb, Wm. Webb, Mayor Clem Nay: None Absent: Councilmember Umstattd MOTION: On motion of, and duly seconded, the following Ordinance was proposed and adopted: 97-0-12 - ORDINANCE -AMENDING ARTICLE VII, CHAPTER 17, SECTION 17-147, "CIGARETTE TAX" TO REVISE THE TAX ON CIGARETTES SOLD IN THE TOWN OF LEESBURG WHEREAS, the Town of Leesburg under Section 3-1 of its Charter and Section 15.1- 841 of the Code of Virginia (1950), as amended is authorized to enact taxes on property and other lawful subjects as in the judgment of the Town Council are necessary to pay the debts, defray the expenses, accomplish the purposes and perform the function of the town; and WHEREAS, under Sections 58.1-3840, 58.1-3831 and 58.1-3832 of the Code of Virginia (1950), as amended, and the aforesaid authority, the town is authorized to levy a tax upon cigarettes sold within the town; and WHEREAS, the proposed budget for the fiscal year ending June 30, 1998, contemplates an increase in the cigarette tax from $.20 per pack to $.25 per pack; and WHEREAS, this Council deems the levy of such a tax on cigarettes necessary to pay the debts, defray the expenses, accomplish the purposes and perform the functions of the town; and \¥HEREAS, a public hearing was held on March 25, 1997, as required by the Town Code: THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as lows: SECTION I. The Town Code is amended by revising Section 17-147 of Article VII, of Chapter 17 which reads as follows: Section 17-147. Levv and rate. In addition to all other taxes of every kind now or hereinafter imposed by law, there is hereby levied and imposed by the town upon every person who sells or uses cigarettes within the town from and after the effective date of this Article and excise tax equivalent to twcnty twenty five $.25 cents for each package containing twenty (20) cigarettes and !fr0 12..5 mills for each cigarette contained in packages of fewer or more than twenty (20) cigarettes sold or used within the town. The tax shall be paid and collected in the manner and at the time hereinafter prescribed; provided, that the tax payable for each cigarette or cigarette package sold or used within the town shall be paid but once. The tax hereby levied shah not apply to free distribution of sample cigarettes in packages containing five (5) or fewer cigarettes. SECTION II. All prior ordinances and resolutions in conflict herewith are repealed. SECTION II. This ordinance shall be in effect on July 1, 1997. VOTE: Ave: Councilmembers Buttery, Emswiller, Trocino, B. J. Webb, Mayor Clem Nny; None Absent: Couneilmember Umstattd MOTION: On motion of, and duly seconded, the following Resolution was proposed and adopted by a roll call vote: 97-98 - RESOLUTION - APPROVING THE BUDGET AND MAKING APPROPRIATIONS FOR THE FISCAL YEAR ENDING JUNE 30, 1998 WHEREAS, the budget and tax rates for the fmcal year ending June 30, 1998, have been presented and reviewed by this Council in accordance with Section 4-2. l:l(b) of the Town Code and Section 15.1-160 of the 1950 Code of Virginia, as amended; and WHERE.AS, a public hearing on the proposed budget and tax rates was held on March 25, 1997; and WHEREAS, Council met in budget workshop sessions in February, March and April, 1997; and WHEREAS, the tax rate for 1997 real estate taxes will increase from $0.21 to $0.22 and personal property taxes will remain unchanged at $1.00 per $100 of assessed valuation. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The manager's proposed budget, as amended, to include the adjustments proposed in the General Fund is adopted and appropriations are made for the fiscal year ending June 30, 1998, in the amounts shown to the categories and accounts for the general fund $16,423,619, utility fund $12,301,249, airport fund $2,512,997 and capital projects funds $3,923,559, provided that capital projects funds appropriations shall remain in effect until the projects are completed. SECTION II. The manager is authorized to transfer appropriations made herein to accounts within the same departmental budget as long as the total appropriation for the departments is not adjusted. Webb, Mayor Clem Nay: None Absent: Councilmember Umstattd MOTION: On motion of, and duly seconded, the following Resolution was proposed and adopted: 97-99 - RESOLUTION - ADOPTING THE FISCAL YEARS 1998-2002 CAPITAL IMPROVEMENT PROGRAM WHEREAS, Section 15.1-464 of the 1950 Code of Virginia, as amended, authorizes thc preparation and annual review of a Capital Improvement Program (CIP); and WHEREAS, the town manager submitted a proposed Capital Improvement Program to the To~vn Council and Planning Commission on March 13, 1997; and WHEREAS, the Planning Commission held a public hearing on the proposed CIP on March 20, 1997; and WHEREAS, the Planning Commission has reviewed the CIP for compliance with the Town Plan and on April 3, 1997 approved a motion to recommend the CIP for adoption by the Town Council; and WHEREAS, the CIP provides a long-term plan for the £mancing, acquisition and construction of capital facilities, projects and equipment in the amount of $65,621,641 over the next five years. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: The proposed Capital Improvement Program for fiscal years 1998-2002 is hereby approved. Webb, Mayor Clem Nay: None Absent: Councilmember Umstattd MOTION: On motion of, and duly seconded, the following Ordinance was proposed and adopted: 97-0-13 ORDINANCE -AMENDING CHAPTER 12.1 OF THE TOWN CODE REGARDING REVISED PAY AND CLASSIFICATION PLAN WHEREAS, the town's pay and classification plan must be reviewed to be consistent with the proposed FY 98 Budget; and WHEREA~., in order to maintain a consistently high level of service the number of positions should be revised. THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. Section 12.1-13 of the Town Code, classification of town employees by occupational group and pay grades, is amended to read as follows: Sec. 12.1-13. Adootion. Webb, Mayor Clem Nay: None Absent: Councilmember Umstattd MOTION: On motion of, and duly seconded, the following Resolution was proposed and adopted: 97-100 RESOLUTION - AMENDING POSITIONS AND NUMBERS OF EMPLOYEES IN THE TOWN'S SERVICE WHEREAS, the authorized number of positions in the town's service must be reviewed each year by the Town Manager to be consistent with the proposed FY 98 budget; and WHEREAS, in order to maintain a consistently high level of service the number of positions should be revised.
