HomeMy Public PortalAbout04/05/77 CCM1 The Council of the City of Medina met in regualr session on Tuesday, April 5, 1977, at 7:40 P.M. Members present: Mayor, Wayne Neddermeyer; Councilmembers, Arthur Theis, William Reiser Nancy Laurent, Thomas Crosby; Clerk Donna Roehl; Attorney Richard Schieffer; Building Inspector, Russel Bouley Thomas Crosby asked that the minutes of March 15, 1977 be corrected as follows: Item 2, Page 110, add: Thomas Crosby indicated that the issue was whether an employee of the city should be able to establish a rate of pay after the performance of work for the city; which rate varies from the rate previously paid. Also if he were to he called he would be paid at his asking rate. Motion by Arthur Theis, seconded by William Reiser to approve the minutes as corrected. Motion carried unanimously 1. HENNEPIN SOIL AND WATER CONSERVATIONDISTRICT Mahedi Jiwani presented floodway map of Medina explaining that maps are used for land planning. Maps are approved by the Department of Natural Resources and a floodplain map is then prepared. Motion by Thomas Crosby, seconded by Nancy Laurent to give preliminary approval to floodway studies, as presented by Mr. Jiwani. Motion carried unanimously 2. RUSSEL BOULEY, BUILDING INSPECTOR Mr. Bouley reported that he is spending about half a day on building inspecting, each day, paper work is taking much of his time. He cited a need for an assistant and a raise in pay to approximately $5000 per year. He listed the inspections he does during the construction of a building. He discussed the possibility of revising and simplifying the fee schedule as it has not been changed in 5 or 6 years. He also stated that it might be 3 or 4 years before a full time building inspector is needed. Council discussed the need to study fee schedules of neighboring municipalities and salaries of their inspectors. Motion by Thomas Crosby teconded by Arthur Theis to hold a special meeting on Tuesday, May 31, 1977 to discuss building permit fees and status of posistion of building inspector. Motion carried unanimously Each member will contact a neighboring community for information on fees and salaries. Motion by Thomas Crosby, seconded by William Reiser to appoint Russel Bouley as building inspector subject to same conditions as all employees, serving at the pleasure of the Council Motion carried unanimously 3. Attorney Richard Schieffer stated that Council could waive the irregularities. Motion by Nancy Laurent, seconded by Arthur Theis to award Item 1, Class 5 Gravel bid to Anderson Aggregates with the alternate to Buffalo Bituminous at the descretion of Road Sup- ervisor on basis of location of pit to road being graveled. Motion carried unanimously 11.9 Motion by William Reiser, seconded by Nancy Laurent to award Item 2, Mc 30,70,800, bid to Buffalo Bituminous. Motion carried unanimously Motion by Nancy Laurent, seconded1 by Arthur Theis to award Item 3, and 4, AC MC and Fine Mix to C.S. McCrossan and designate Bury and Carlson as alternate, as they can furnish different temperatures of mix, when other companies do not. Motion carried unanimously Discussion of bids eceived on Items 5 and 6, 3/4 " and le Limestone. Mr. Sazama stated that his bid was for delivery of the items only. Motion by Nancy Laurent teconded by Arthur Theis to reject all bids on Items 5 and 6 because of misunderstanding of bid proposal and to readvertize for bids on 3/4" and lam" Limestone on May 3, 1977; bids to be opened at 10:00 A.M. and considered at 8:00 P.M. of same day and authorize the engineer to prepare specifications. Co. and that several areas cannot meet specifications. COMMENTS one yr. warranty $35,900 Syr 5% ck. 3e-45 4,000 5 yr. 1650 bid bd. 90 days 1 yr, warr. 2,500 for 5 yr. warr. did not present equipment for use Nancy Laurent reported the following differences from Transmission does not have diffeerential lock Tires are different sizes Brakes, not self engergizing Electrica1,24 volt instead of 12 Loader, 5800 lift capacity requested Panel, not locking Digging depth, less Representative of Case Co. explained the differences Tires, wider that specifications Brakes, spring loaded, which is safety factor Panel, is locking Electrical, generates 700 watts to others 600 watts Digging depth, less than 3" difference Loader 5440 lift capacity Ronald Duran explained that they had used the machine and that it had a tendency to spin when going into a pile of sand; also air brakes can cause problems. Nancy Laurent asked for a report on the availabilty of parts. Mr. Cox of Long Lake Ford reported that they are nearby, have a full line of parts in stock and an exchange machine to use if machine breaks down. J.I: Case representative reported that they have replacement machines, large parts supply in Burnsville. He added that they had bid less on the 5 year warranty than other bidders. Richard Schieffer advised that Council must decide if differences are material differences and if Case machine meets specifications. Motion bylfilAdy Laurent, seconded by Arthur Theis to reject Case bid because it does not meet specifications. It bid specifications of the J.I. Case mach. 12 () Motion carried. Thomas Crosby abstained because he stated that he was not familiar enough with either machine. Motion by Nancy Laurent, seconded by William Reiser to accept bid of Long Lake Ford Tractor for purchase of babkhoe as set forth in specifications, for $30,400, which included a one year warranty. Motion carried. Thomas Crosby abstained for same reason as listed above. Motion by Arthur Theis to add a 5 year w rranty for an additional $5500. Motion not seconded. 5. HAMEL DAIRY QUEEN Bruce Luxford and Emil Jubert, sign administrator explained Mr. Luxford's request to add a reader sign to his present Dairy Queen sign. Emil Jubert explained that the sign would be to large and that Council would need to grant a variance. Richard Schieffer stated that he would read the ordinance to determine if a variance is re- quired and would contact Mr. Luxford. 6. BEECHNUT STREET VACATION William Nelson and Mark-Orth requested vacation of a portion of Beechnut St., Lake Indepen- dence between Lots 8, Block 8 and Lot 1 Block 15. Lyle Swanson, engineer, stated that he would check at the Courthouse to determine the ownership of 15' of beach in front of Mr. Orth's lot. Richard Schieffer stated that Council may be able to vacate the street but an easement may need to be left for that 15' of beach. Motion by Thomas Crosby, seconded by William Reiser to hold a public hearing on May 3, 1977 at MO P.M. to consider the vaction of that portion of Beechnut St. located between Lot 8, Block 8 and Lot 1, Block 15, Independence Beach. Motion carried unanimously 7. B.C. BURDICK Marlon Haugen, attorney, appeared to d iscuss a previous request to divide one lot from acreage owned by Mr. Burdick on Pinto Dr., Hamel, as allowed under Medina Ord. 159. He stated that sewer and water is available and that the prospective purchaser is aware of the sewer and water assessments. Richard Schieffer explained prepared resolution allowing for division, including amount of special assessments. Motion by Thomas Crosby, seconded by William Reiser to adopt Resolution 77-11, regarding division of B.C. Burdick property and subject to apyment of $150 in fees. Motion carried unanimously Thomas Crosby added that t is action shall have no bearing on subsequent development of remaining adjacent property owned by Mr. Burdick. 8. LLOYDHALL Mr. Hall requested to be allowed to divide Lots 19, 20, and 21, Block 21, Independence Beach into 2 sites. Clerk reported that he had combined the 3 lots into one unit at the time of sewer and water assessing and consequently has one unit of assessment on the 3 lots. Motion by Thomas Crosby, seconded by Arthur Theis to authorize attorney to draw up lot div- ision/ combination for Lloyd Hall on Lots 19, 20 and 21, Block 20, Independence Beach and to include means to assess an additional unit. Motion carried unanimously 9. SYCAMORE TRAIL Lyle Swanson presented specifications for 5 ton road as previously discussed. Funds for blacktoppint tole taken from the Independence Beach sewer and water project funds. Motion by William Reiser, seconded by Nancy Laurent to authorize engineer to advertize for bids for blacktopping of Sycamore Trail for May 3, 1977 at 10:00 A.M. Motion carried unanimously 10. UTILITY BUILDING Ron Duran presented two quotes on construction of a water line to the utility buildin1 21 Day and Sons, $1000; Steve Schmidt, $725. Quotes include all plumbing and pipe. City will dig and cover trench and jack -hammer cement. Motion by William Reiser, seconded by Arthur Theis to have Steve Schmidt install water line for $/25.00. Motion ccarried unanimously 11. STREET SWEEPER Ron Duran presented one quote for $26.50 per hour for street sweeping or 5700 per week rental of a machine. He also stated that he would get additional quotes per hour for sweeping, also that it would cost $3400 to repair the city owned machine. Motion by Thomas Crosby, seconded by William Reiser to authorize Ron Duran to arrange for the sale of street sweeper at Hennepin County auction. Motion carried unanimously 12. STREET SIGNS Ron Duran presented 2 types of street sign poles that may b e purchased to replace those thpt have been destroyed or that may b e needed for new streets. Poles are round, 10 ft. long. Quote from Lyle Sign Co. $9.33 for pole and $9.00 for brackets. Gopher Sign Co. $8.50 each for pole and bracket. Motion by Thomas Crosby, seconded by Arthur Theis to purdhase poles and brackets from Gopher Sign Co. Motion carried unanimously 13. DRIVEWAY PERMITS Discussion of Russel Bouley issuing a driveway permit and collecting the fee and it becomes necessary for an additional fee to be charged because the engineer must be consulted. Richard Schief'er stated that the ordinance stated that fee is to be collected by the road supervisor. 14. METRO SYSTEMS STATEMENT Thomas Crosby presented Metro Systems Statement for Medina and stated that he would make a report as to its contents at a later late. 15. BILLS Motion by Thomas Crosby, seconded by William Reiser to pay the bills; Order checks # 6601- 6675 in the amount of $26,701.02 and Payroll #4443-4467 in the amount of 56799.57; check to Leonard Lauer to include $60.00 as opposed to $75.00 for training sessions because Ken Volkenant did not report for training. Motion carried unanimously 16. EMPLOYEE BARGAINING LAW Motion by Nancy Laurent, seconded by Thomas Crosby to authorize Bill Clelland to provide a letter of explanation relating to public employees bargaining laws and how they effect Medina for a cost of $60.00. Motion carried unanimously 17. ROGER SCHMIDT William Reiser reported that Mr. Schmidt had used in access of 108,000 gallons of water due to excessive loss of water in his apartment house and had asked for an adjustment on his bill. Consensus of the Council was not to make an adjustment because the problem existed in his building and was not the fault of the city. 18. FIRE CALLS Discussion of outstanding uncollected fire call mills. Motion by Thomas Crosby, seconded by Arthur Theis to refer unpaid auto fire bills to a collection agency. Motion carried unanimously 1 219. PLANNING AND ZONING WORK Discussion of who would do the work of planning and zoning that Jean Mabusth is not familar with. Donna Roehl stated that she has spent a great deal of time on that workra.eh is taking time away from her regular work and has had to spend extra hours at her job. Council agreed to refer questions to the attorney because he is familar with the zoning codes of the city. 20. COLONIAL DRIVE IN Discussion of the representative of the theatre not signing the performance agreement and paying fees as determined by the attorney. Council felt that the theatre was operating without a license because the work had not been approved by the City engineer and the agreement had not been signed. Clerk was advised to notify owners of the discussion and that they are considered as ope ating without a license which is being taken under advisement. If not resolved by April 19, 1977 meeting a complaint will be issued. Motion by Thomas Crosby, seconded by Arthur Theis to adopt Resolution 77-12 approving expenses of Colonial Drive In.
