HomeMy Public PortalAbout1997_06_03SPECIAL MEETING MINUTES OF JUNE 3, 1997 A special meeting of the Leesburg Town Council was held on June 3, 1997 at 6:30 p.m., in the Council Chambers, 25 West Market Street, Leesburg, Virginia. Notice having been delivered to all members of the Council priorthereW. The purpose of the meeting was to consider the appeal of the Zoning Administrator's issuance of violation notice and correction order to Leesburg Auto Center and to discuss the Kincaid Forest performance guarantee. The meeting was called to order by Mayor Clem. COUNCILMEMBERS PRESENT Frank Buttery, Jr. Jewell M. Emswiller Joseph R. Trocino Kristen C. Umstattd B. J. Webb William F. Webb James E. Clem, Mayor STAFF MEMBERS PRESENT Steven C. Brown, Town Manager Deputy Town Manager Gary A_ Huff Director of Engineering and Public Works Thomas A. Mason Zoning Administrator Brian Boucher Chief of Current Planning Lee Phillips Deputy Town Attorney Deborah Welsh Assistant Town Manager for Economic Development John Henry King Town Clerk Barbara Markland Mr. Boucher provided the staff report regarding the appeal. Ms. Emswiller asked, what will happen if the plants that were planted in the asphalt, die and why a lighting plan was not required? Mr. Boucher stated, the applicant will replace them. Mayor Clem stated, if the plants die then they will be replaced and if the lighting is a problem, staff will notify the applicant and have the direction of the lighting changed. MOTION: On motion of Mr. Webb, seconded Ms. Webb, the following motion was made: I move that the applicant, through efforts that have been put forth since the issuance of the Violation Notice and Correction Order, has sufficiently met the intent of Special Exception #SE96-07 Conditions #3.c., and #6 and such conditions are hereby deemed approved. VOTE: Aye~ Clem Nay: Counci]members Buttery, Trocino, Umstattd, B.J. Webb, Wm. Webb and Mayor Councilmember Emswiller On motion of, and duly seconded, the meeting was adjourned at 6:40 p.m. MOTION: On motion of Ms. Webb, seconded by Mr. Webb, the following motion was made. Pursuant to Section 2.1-344 of the 1950 Code of Virginia, as amended, I move that the Leesburg Town Council convene in Executive Session. The authority for this Executive Session is found in Section 2.1-344 (a), Subsection (7) of the 1950 Code of Virginia, as amended. The purpose of this Executive Session is to consult with the town's legal counsel regarding the performance guarantee for Kincaid Forest Subdivision. The Town Manager, Director of Engineering and Public Works, Deputy Town Attorney and Ken Berg, representing Richmond American, are requested to remain for the Executive Session. VOTE: Aye: Councilmembers Buttery, Umstattd, B.J. Webb, Wm. Webb and Mayor Clem Nay: None Absent: Councilmember Trocino MOTION: On motion of, and duly seconded, the following resolution was proposed and adopted. 97-130 - RESOLUTION - CERTIFYING EXECUTIVE SESSION OF JUNE 3, 1997 WHEREAS, the Town Council of the Town of Leesburg, Virginia, has this day convened in Executive Session in accordance with an affirmative recorded vote of the Leesburg Town Council and in accordance with the provisions of the Virginia Freedom of Information Act.' NOW, THEREFORE, BE IT RESOLVED that the Leesburg Town Council does hereby certify that to the best of each member's knowledge, 1) only public business matters lawfully exempted from open meeting requirements under the Freedom of Information Act were discussed in the Executive Session to which this certification applies; and 2) only such public business matters as were identified in the Motion by which the said Executive Session was convened were heard, discussed or considered by the Leesburg Town Council.
