A regular meeting of the Leesburg Town Council was held on Tuesday, June 24, 1997, at 7:30
p.m., in the Council Chambers, 25 West Market Street, Leesburg, Virginia. The meeting was
called to order by Mayor Clem.
1. INVOCATION was given by Councilmember B. J. Webb.
2. SALUTE TO THE FLAG was led by Eagle Scout Bryan Smith
3. ROLL CALL: Present were; Councilmembers Buttery, Emswiller, Trocino, Umstattd, B.
J. Webb, William Webb and Mayor Clem.
4. APPROVAL OF MINUTES
MOTION: On motion of Mr. Webb, seconded by Ms. Webb the regular meeting minutes of
May 27, 1997 and June 10, 1997 and the special meeting minutes of June 11, 1997 were
approved as corrected by Councilmember Trocino.

CERTIFICATES OF APPRECIATION Mayor Clem and Mr. Trocino presented
Certificates of Appreciation to Mary Kay Vogric, Vicki Boyer, Mr. Lloyd and Ms. Gillespie
for their work on the Wall of Mayors Exhibit.
6. PETITIONERS
Ms. Becky Ottinger, President of the Loudoun County YMCA, requested funding for the
YMCA Summer Day Camp.
Mr. Sydney Lord, Mr. Scott Sandier and Ms. Robin Hostiloni, residents of Woodlea Manor,
addressed the Council regarding the lack of park facilities in the southwest quadrant of town,
as well as the lack of a pedestrian access for residents of Woodlea and Greenway to get to
downtown Leesburg.
7. COUNCILMEMBER COMMENTS
Ms. Webb stated she met with representatives of Chelsea and attended the grandopening of
the Hilgartner Chiropractic Clinic where she won a free massage.
Ms. Webb stated she is delighted to hear the concerns of the residents of Woodlea Manor.
She thanked Mr. Trocino and the museum's staff for their efforts with the Wall of Mayors
Exhibit.
Ms. Webb stated, she believes very strongly that the Town has a police chief who is in fact a
team player and a team leader. "Chief Stiles has continued to work on behalf of this entire
Town."
Ms. Emswiller stated she met with Mr. Robert Sevila and a representative from HP. Ms.
Emswiller also thanked Mr. Trocino and the Museum's staff for the Wall of Mayors Exhibit.
Ms. Emswiller announced that the Leesburg Famers' Market will open on July 3, 1997 and
encouraged citizens to take advantage of the locally grown produce.
Ms. Emswiller thanked Ms. Ottinger with the YMCA for. addressing the Council.
Ms. Emswiller stated, Emswiller's Pharmacy will not be moving to Landsdowne but will
remain at its present location.
Mr. Trocino stated, there needs to be more advanced planning for park facilities. The Town
needs to work harder at keeping up with the growth of the town and that the town needs to
receive more from Loudoun County.
Ms. Umstattd met with representatives of Chelsea. She is pleased with the caliber of stores
that will be opening in the proposed mall.
Ms. Umstattd attended a steering committee meeting for the upcoming land use conference
hosted by the NVPDC. Ms. Umstattd commended Mr. Mucci on his efforts.
Mr. Buttery commended Eagle Scout Bryan Smith on his accomplishments.
Mr. Buttery stated the first meeting of the Ad Hoc Public Safety Committee will be held
tomorrow at 8:00 a.m.
Mr. Buttery reminded the public of the 4th Of July celebration at Ida Lee Park, stating this is
an alcohol-free family event, encouraging everyone to attend and if possible to walk to the
park instead of driving.
Mr. Webb thanked the Woodlea Manor residents for their comments.
8. MAYOR'S COMMENTS
Mayor Clem thanked the Woodlea Manor residents for their comments. He commended
Eagle Scout Bryan Smith for his accomplishments.
Mayor Clem attended the All-Night Graduation party, stating it was very successful. He
stated, that unfortunately there was an incident after the party where graffiti was painted on
the Ida Lee park's roof, brick walls and pillars. Mayor Clem stated, there is no place in this
Town where this type of activity is needed. He asked that anyone with information of who
did this to please contact the police department.
Mayor Clem attended the opening of the Plaza Street extension. On July 26, 1997, the
Council will dedicate the Water Treatment Plant to former Mayor Kenneth Rollins. He
congratulated Councilmember Buttery for the Father of the Year award.
9. MANGER'SREPORT
Mr. Huff announced a block party will be held at Stoneledge Place, N.E., on July 4, 1997 from
4:00 p.m. to 10:30 p.m.
Mr. Huff reminded the citizens in the NE and SE quadrant of town that recycling will be
picked-up on July 3.
LEGISLATION
10. (a)
MOTION On motion of Mr. Webb, seconded by Ms. Umstattd, the following ordinance was
proposed and adopted.
97-0-21 -ORDINANCE -AMENDING CHAPTER 12.1 OF THE TOWN CODE
REGARDING REVISED PAY AND CLASSIFICATION PLAN
WHEREAS, the town's pay and classification plan must be reviewed to be consistent
with the proposed FY 98 Budget; and
WHEREAS, in order to maintain a consistently high level of service the number of
positions should be revised.
THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. Section 12.1-13 of the Town Code, classification of town employees by
occupational group and pay grades, is amended to read as follows:

MOTION: On motion of Ms. Webb, seconded by Ms. Umstattd, the following ordinance was proposed
and adopted.
97-0-22 - ORDINANCE - APPROVING THE VACATION OF PORTIONS OF A SANITARY
SEWER EASEMENT WITHIN SECTIONS 2AB1, 3C, AND 6A OF THE POTOMAC
STATION SUBDIVISION
WHEREAS, Richard A. Lanham of KSI Services, Inc. has requested that the Town
vacate portions of an existing sanitary sewer easement within Sections 2AB1, 3C, and 6A of
the Potomac Station subdivision; and
WHEREAS, the portions of the easement to be vacated will be within public street
right-of-way upon recordation of the associated record plats; and
WHEREAS, the Virginia Department of Transportation (VDOT) will not accept the
right-of-way with easements; and
WHEREAS, the VDOT will allow the Town to enter the right-of-way to maintain the
sanitary sewer, if necessary, in the future.
THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. Those portions of the 15' sanitary sewer easement labeled as "hereby
vacated: within Sections 2AB1, 3C, and 6A on record plats prepared by ATCS, P.L.C. are
hereby vacated.
SECTION II. This ordinance shall be in effect upon the recordation of the
associated record' plats identified above.

CONSENT ITEMS
MOTION: On motion of, and duly seconded, the following resolutions were proposed and adopted.
97-148 - RESOLUTION - AUTHORIZING APPROVAL OF THE IDA LEE PARK MASTER
PLAN
WHERAS, the Parks and Recreation Department proposed a revision to the Ida Lee Park
Master Plan; and
WHEREAS, the Parks and Recreation Advisory Commission held citizen input meetings to
obtain pubhc comments on future development of Ida Lee Park; and
WHEREAS, the Parks and Recreation Advisory commission endorsed the revised Ida Lee Park
Master Plan; and
WHEREAS, the Planning commission recommended the revised Ida Lee Park Master Plan
proposal in special work session; and
WHEREAS, the Town Council has reviewed the revised Ida Lee Park Master Plan proposal in
special work session ;and
WHEREAS, the Town Council Planning and Zoning Committee has recommended the deletion
of the outdoor pool, the street skate area, and one in-line hockey rink from the original proposal; and
WHEREAS, the Planning and Zoning Committee has recommended the addition of an in-line
hockey rink, an expansion of the Ida Lee Recreation Center, a horticultural area, relocation of the
outdoor amphitheater, and revising the football field to a football/lacrosse field; and
WHEREAS, the Master Plan was revised to reflect the Planning and Zoning Committee
recommendations.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
The Ida Lee Park revised Master Plan dated June 13, 1997, is hereby approved.
97-149 - RESOLUTION -AMENDING POSITIONS AND NU1KBERS OF EMPLOYEES IN THE
TOWN'S SERVICE
WHEREAS, the authorized number of positions in the town's service must be reviewed
each year by the Town Manager to be consistent with the proposed FY 98 budget; and
WHEREAS, in order to maintain a consistently high level of service the number of
positions should be revised.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The positions and number of employees in the town service for the fiscal
year 1998 are established as follows:

97-150 - RESOLUTION - AMENDING SECTION 12.1-62 OF THE PERSONNEL MANUAL
WHEREAS, the Personnel Committee and Administration and Pubhc Works
Committee recommend changes to the Personnel Manual:
THEREFORE, RESOLVED by the Town Council of the Town of Leesburg in Virginia as
follows:
Sec. 12.1-62. Tuition Assistance Program
It shall be the policy of the Town of Leesburg to encourage employees to continue
their education whenever possible. It is recommended that employees take advantage of
worthwhile courses at schools and colleges or through correspondence programs to assist
them in doing a better job in theft current classification or to help prepare them for
advancement within the Town.
(a)
To assist employees with the financial burden imposed by the tuition, the
Town Manager may authorize reimbursement of a portion of the required
school fees such as tuition and registration subject to the eligibility
requirements. Mileage and optional fees are not reimbursable.
(b)
To participate, employees must be regular, fuLl-time employees. Course
content must relate to the employee's classification and shah lead to
improved job performance.
(c)
Courses must be given by a school or a professional training facility
recognized by the Town as having a quality of instruction. Prehminary
approval for the tuition reimbursement is obtained from the Department
Director and the Personnel Director before the course begins. Class room and
study time are outside of the employee's working hours. The employee must
complete the course with at least a "C" grade or its equivalent or by evidence
of satisfactory completion.
(d)
Tuition refunds for graduate course work must maintain or improve skills
required in the employee's present employment in order to be provided tax-
free. The Department Director shall be responsible for making determination
relative to the job related nature of such courses. Graduate courses that are
not directly related to job skills required for present employment shall be
reported as income on employees' W-2 forms. Employees should consult their
tax advisors regarding proper treatment of tuition refund payment on their
personal income taxes.
97-151 -RESOLUTION- ACCEPTING PUBLIC IMPROVEMENTS, RELEASING
THE PERFORMANCE GUARANTEE AND APPROVING A MAINTENANCE
GUARANTEE FOR PUBLIC IMPROVEMENTS AT TAVISTOCK FARMS SECTION
1
WHEREAS, Arcadia Building Company, the developer of Tavistock Farms Section 1,
has completed the public improvements in accordance with approved plans and town
standards, and these have been inspected and approved.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The corporate surety bond issued by The American Insurance Company in
the amount of $180,000.00 is released, a new security in a form approved by the town attorney
for a maintenance guarantee in the amount of $45,000.00 is approved, and shall be in effect for
a period of one year from the date of this resolution.
SECTION II. This release is contingent upon delivery of a properly executed
instrument conveying unto the town all such improvements and easements free of any liens or
charges.
97-152 - RESOLUTION - ACCEPTING PUBLIC IMPROVEMENTS, RELEASING
THE PERFORMANCE GUARANTEE AND APPROVING A MAINTENANCE
GUARANTEE FOR PUBLIC IMPROVEMENTS AT TAVISTOCK FARMS SECTION

WHEREAS, Arcadia Building Company, the developer of Tavistock Farms Section 3,
has completed the public improvements in accordance with approved, plans and town
standards, and these have been inspected and approved.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The corporate surety bond issued by The American Insurance Company in
the amount of $40,426.00 is released, a new security in a form approved by the town attorney
for a maintenance guarantee in the amount of $10,106.60 is approved, and shall be in effect for
a period of one year from the date of this resolution.
SECTION II. This release is contingent upon delivery of a properly executed
instrument conveying unto the town all such improvements and easements free of any liens or
charges.
97-153 - RESOLUTION - ACCEPTING PUBLIC IMPROVEMENTS, RELEASING
THE PERFORMANCE GUARANTEE AND APPROVING A MAINTENANCE
GUARANTEE FOR PUBLIC IMPROVEMENTS AT TAVISTOCK FARMS SECTION

WHEREAS, Arcadia Building Company, the developer of Tavistock Farms Section 4,
has completed the public improvements in accordance with approved plans and town
standards, and these have been inspected and approved.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virgima as
follows:
SECTION I. The corporate surety bond issued by The American Insurance Company in
the amount of $122,400.00 is released, a new security in a form approved by the town attorney
for a maintenance guarantee in the amount of $30,600.00 is approved, and shall be in effect for
a period of one year from the date of this resolution.
SECTION II. This release is contingent upon delivery of a properly executed
instrument conveying unto the town all such improvements and easements free of any liens or
charges.
97-154 - RESOLUTION - ACCEPTING PUBLIC IMPROVEMENTS, RELEASING
THE PERFORMANCE GUARANTEE AND APPROVING A MAINTENANCE
GUARANTEE FOR PUBLIC IMPROVEMENTS AT TAVISTOCK FARMS SECTION

WHEREAS, Arcadia Building Company, the developer of Tavistock Farms Section 7,
has completed the public improvements in accordance with approved plans and town
standards, and these have been inspected and approved.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The corporate surety bond issued by The American Insurance Company in
the amount of $400,000.00 is released, a new security in a form approved by the town attorney
for a maintenance guarantee in the amount of $100,000.00 is approved, and shall be in effect for
a period of one year from the date of this resolution.
SECTION II. This release is contingent upon delivery of a properly executed
instrument conveying unto the town all such improvements and easements free of any liens or
charges.
97-155 - RESOLUTION - AUTHORIZING A TIME EXTENSION FOR COMPLETION
OF PUBLIC IMPROVEMENTS AND APPROVING A PERFORMANCE
GUARANTEE FOR TAVISTOCK FARMS OFFSITE WATERLINE
WHEREAS, Arcadia Building Company, the developer of Tavistock Farms Offsite
Waterline, has not completed all the required public improvements in accordance with the
approved construction drawings and town standards within the two year period agreed to in
the contract for pubhc improvements and previously approved time extension; and
WHEREAS, the developer has requested a one (1) years time extension to complete
the public improvements; and
WHEREAS, a corporate surety bond in the amount of $50,663.00 from the American
Insurance Company was provided by the developer to guarantee the installation of public
improvements for Tavistock Farms Offsite Waterline; and
WHEREAS, the Director of Engineering and Public Works has approved the amount
of $50,663.00 to guarantee the installation of the remaining public improvements for the
Tavistock Farms Offsite Waterline.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. A one year time extension for the installation of public improvements is
hereby approved for the Tavistock Farms Offsite Water]me.
SECTION II. The corporate surety bond from The American Insurance Company in
the amount of $50,663.00 is approved to guarantee the installation of public improvements for
the Tavistock Farms Offsite Waterline.
97-156 - RESOLUTION - MAKING A REDUCTION OF THE PERFORMANCE
GUARANTEE FOR PUBLIC IMPROVEMENTS INSTALLED IN POTOMAC
STATION SECTION ID
WHEREAS, the town's Director of Engineering and Public Works has reviewed the
public improvements installed to date in Potomac Station Section 1D and certified that the
value of work performed is $28,682.28; and
WHEREAS, a letter of credit in the amount of $31,869.20 from the Mercantile Safe
Deposit & Trust Company was provided by the developer and approved by the Council to
guarantee installation of public improvements for Potomac Station Section ID.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The letter of credit from Mercantile Safe Deposit & Trust Company in the
amount of $31,869.20 is reduced to $3,186.92.
SECTION II. The Town Manager shall notify the developer that liability for the letter
of credit funds has been reduced as outlined in Section I of this resolution and that this
reduction does not constitute acceptance of public improvements by the town or relieve the
developer of responsibilities outlined in the contract for public improvements for Potomac
Station Section ID.
97-157 - RESOLUTION - AUTHORIZING AN AGREEMENT, APPROVING WATER
AND SEWER EXTENSION PERMITS AND WAIVING A PERFORMANCE
GUARANTEE FOR THE POTOMAC STATION (HARPER PARK) MIDDLE SCHOOL
WHEREAS, the Director of Engineering and Public Works and the Planning
Commission have conditionally approved construction drawings and final development plans
for the Potomac Station (Harper Park) Middle School, to be constructed by the Loudoun
County Board of Education (School Board hereafter); and
WHEREAS, it is in the public interest to waive the costs associated with a
performance guarantee for the necessary public improvements.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The Manager shall execute the contract for public improvements in a form
approved by the Deputy Town Attorney with the School Board for the improvements shown on
the plans approved by the Director of Engineering and Public Works for the Potomac Station
(Harper Park) Middle School.
SECTION II. The extension of municipal water and sewer works for the Potomac
Station (Harper Park) Middle School is approved in accordance with Section 15-9 and 19-18 of
the Town Code.
SECTION III. The performance guarantee for the public improvements in the amount
of $447,929.00 is waived, conditioned on the requirement that occupancy of the facility shall not
be permitted until the public improvements are completed to the satisfaction of the town, or a
subsequent performance guarantee is furnished in an amount approved by the Director of
Engineering and Public Works for outstanding punchlist items.
97-158 - RESOLUTION - MAKING A REDUCTION OF THE PERFORMANCE
GUARANTEE FOR PUBLIC IMPROVEMENTS INSTALLED IN POTOMAC
STATION SECTION 1E
WHEREAS, the town's Director of Engineering and Public Works has reviewed the
public improvements installed to date in Potomac Station Section 1E and certified that the
value of work performed is $110,498.85; and
WHEREAS, a letter of credit in the amount of $122,776.50 from the Mercantile Safe
Deposit & Trust Company was provided by the developer and approved by the Council to
guarantee installation of public improvements for Potomac Station Section 1E.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The letter of credit from Mercantile Safe Deposit & Trust Company in the
amount of $122,776.50 is reduced to $12,277.65.
SECTION II. The Town Manager shall notify the developer that liability for the letter
of credit funds has been reduced as outlined in Section I of this resolution and that this
reduction does not constitute acceptance of public improvements by the town or relieve the
developer of responsibilities outlined in the contract for public improvements for Potomac
Station Section 1E.
97-159 - RESOLUTION - MAKING A REDUCTION OF THE PERFORMANCE
GUARANTEE FOR PUBLIC IMPROVEMENTS INSTALLED IN POTOMAC
STATION SECTION 2AB
WHEREAS, the town's Director of Engineering and Public Works has reviewed the
public improvements installed to date in Potomac Station Section 2AB and certified that the
value of work performed is $184,951.80; and
WHEREAS, a letter of credit in the amount of $205,502.00 from the Mercantile Safe
Deposit & Trust Company was provided by the developer and approved by the Council to
guarantee installation of public improvements for Potomac Station Section AB.
THEREFORE, RESOLVED by the Council of.the Town of Leesburg in Virginia as
follows:
SECTION I. The letter of credit from Mercantile Safe Deposit & Trust Company in the
amount of $205,502.00 is reduced to $20,550.20.
SECTION II. The Town Manager shall notify the developer that liability for the letter
of credit funds has been reduced as outlined in Section I of this resolution and that this
reduction does not constitute acceptance of public improvements by the town or relieve the
developer of responsibilities outlined in the contract for public improvements for Potomac
Station Section 2AB.
97-160 - RESOLUTION - MAKING A REDUCTION OF THE PERFORMANCE
GUARANTEE FOR PUBLIC IMPROVEMENTS INSTALLED IN POTOMAC
STATION SECTION 2GH
WHEREAS, the town's Director of Engineering and Public Works has reviewed the
public improvements installed to date in Potomac Station Section 2GH and certified that the
value of work performed is $106,120.08; and
WHEREAS, a letter of credit in the amount of $117,911.20 from the Mercantile Safe
Deposit & Trust Company was provided by the developer and approved by the Council to
guarantee installation of public improvements for Potomac Station Section 2GH.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The letter of credit from Mercantile Safe Deposit & Trust Company in the
amount of $117,911.20 is reduced to $11,791.12.
SECTION II. The Town Manager shall notify the developer that liability for the letter
of credit funds has been reduced as outlined in Section I of this resolution and that this
reduction does not constitute acceptance of public improvements by the town or relieve the
developer of responsibilities outlined in the contract for public improvements for Potomac
Station Section 2GH.
97-161 o RESOLUTION - MAKING A REDUCTION OF THE PERFORMANCE
GUARANTEE FOR PUBLIC IMPROVEMENTS INSTALLED IN EXETER HILLS
SECTION 5B
WHEREAS, the town's Director of Engineering and Public Works has reviewed the
public improvements installed to date in Exeter Hills Section 5B and certified that the value
of work performed is $815,197.62; and
WHEREAS, a corporate surety bond in the amount of $938,537.00 from The
American Insurance Company was provided by the developer and approved by the Council to
guarantee installation of public improvements for Exeter Hills Section 5B.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The corporate surety bond issued by The American Insurance Company in
the amount of $938,527.00 is reduced to $123,339.38.
SECTION II. The Town Manager shall notify the developer that liability for the letter
of credit funds has been reduced as outlined in Section I of this resolution and that this
reduction does not constitute acceptance of public improvements by the town or reheve the
developer of responsibilities outlined in the contract for public improvements for Exeter Hills
Section 5B.
97-162 - RESOLUTION o ADOPTING A ROOM RENTAL POLICY
RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
The application and grant of privileges for community use of public space, buildings
and grounds for non-governmental purposes is hereby adopted.
97-163 - RESOLUTION - AWARDING AN ANNUAL CONTRACT FOR
COMPREHENSIVE CONSUTLING ENGINEERING SERVICES
WHEREAS, the town has a contract for comprehensive consulting engineering
services which is renewed on an annual basis; and
WHEREAS, this contract helps reduce administrative costs by providing a ready
source for having engineering studies performed, having small projects designed and
responding to council and citizen inquiries in a timely manner; and
WHEREAS, a request for proposals was issued by the town for these services; and
WHEREAS, seven engineering firms submitted proposals; and
WHEREAS, a selection committee reviewed the proposals based upon the selection
criteria and ranked the firm of Paciulh, Simmons & Associates, Ltd. as best qualified; and
WHEREAS, in accordance with the town Purchasing Policy, no task estimated to cost
in excess of $15,000 will be assigned to the consultant without prior approval of Mayor and
Council.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
The Town Manager is authorized to execute a contract on behalf of the Town with
Paciulli, Simmons and Associates, Ltd. for comprehensive consulting engineering services as
required by the Town of Leesburg.
