Salt and Sand Structure (Subject to Approval) + City of Tiffin Special City Council Meeting October 13, 2008 Grace United Methodist Church Mayor Royce Phillips called meeting to order at 6:30pm. Roll call of members present: Chris Ball, Jim Bartels, Mike Gericke, Mark Petersen Absent:John Wright. Also present: Building Inspector Ed Johnson, City Clerk Ruth Demuth. Motion Bartels seconded by Gericke to approve Agenda as printed. Council members discussed future use of city property at 301 W Marengo Rd. Action will be taken at regular November 12, 2008 City Council meeting. Council members discussed duties of Building Official. Suggested to expand duties to include annual rental property inspections. Members will review procedures in surrounding communities. Building Official will receive $80.00 per week for services performed aside from Building Inspections. Council members further discussed recouping fees from Builders for re-inspections and possible fees or fines for individuals out of compliance. Suggested that$50.00 fine be levied on owner or contractor if fail to obtain permit within 24 hour notice by Building Official. Council members concerned of Safety for Residents. Discussion held on residential and commercial occupancy limits. Numerous complaints received from neighbors of residences occupied with numerous inhabitants. Suggested that Ordinance be passed to allow Fire Department to issue commercial and industrial occupancy permits. Ordinance 2008-297 addressing, An Ordinance Amending Zoning Ordinance 2007-287 by Establishing a Limit to the Number of Permanent Inhabitants of a Dwelling Located in Any Residential Zone and in C-1 B Zones,was further discussed regarding,limits on permanent inhabitants and limits of immediate family members allowed to occupy any residence. Procedures were discussed on methods needed to enforce ordinance once approved. Ordinance 2008-297 allows three persons to each bedroom, suggested adding clause that ordinance allows special review by Council members if leaseholder or owner needs to allow more inhabitants in-residence. Suggested to instruct Attorney to revise language of Ordinance 2008-297 as passed at October 8, 2008 regular City Council meeting. Council members discussed need to amend Zoning Ordinance regarding'procedure to issue Utility Permits within the boundaries of city. Suggested that Public Works and'Building Official jointly review and issue Utility Permits on City Right-of—Way and private property. Exceptions allowed for emergency work. Suggested costs discussed for permits to be charged to cover base services for Building Official and Public Works. Mayor Phillips will review suggestions with Attorney to prepare Zoning Ordinance change. Discussions held regarding landscaping completion on occupied lots. Suggested that builder or homeowner escrow landscaping costs oryprovide proof of escrow account when building permit is issued. Zoning Ordinance change suggested to set thirty day time limit on temporary occupancy permit to finish landscaping unless weather prohibits. Failure to comply will be municipal infraction. Council members discussed need to change Zoning Ordinance regarding Day Care Facilities on Residential Zoned lots. Day Care Facilities must follow State Guidelines. Suggested that Zoning Ordinance be reviewed to address other special exceptions in Residential Zones. Erosion Control issues addressed to better monitor control of erosion on new building sites. Questions raised on best methods to monitor erosion. Suggested to instruct Public Works to indentify problems and City will notify developers of problem. Upon continued problems, City will notify DNR of noncompliance. Multiple bids presented by Public Works for Salt and Sand Storage Structure. Council members reviewed and suggested using TEK Supply for Storage Cover. Action will be taken at November 12, 2008 regular City Council meeting.
