Regular City Council Meeting

Mayor Royce Phillips called the meeting to order at 6:37pm.
Roll call of City Council members present: Chris Ball, Jim Bartels, and John Wright. Absent Mike Gericke and
Mark Petersen.
Also present Attorney Steve Greenleaf, Engineer Doug Frederick, Public Works Brett Mehmen, Building
Inspector Ed Johnson, City Clerk Ruth Demuth.
Approval of Agenda as printed motion Wright seconded by Jim Bartels. All following actions approved by all
Ayes unless so noted.
Community Forum:
Sheriff Lonnie Pulkrabek presented Johnson County's 2009-2010 Budget request. Pulkrabek explained
various points for the increase in hours of service used by City and the increase in the hourly rate. The Sheriff's
Department asked to be placed on the agenda monthly to allow for discussion of issues affecting Tiffin.
Joe Raso, Iowa City Area Development presented updated information on future plans for Economic
Development in the area and how it affects the future development in Tiffin.
Motion Wright seconded by Bartels for approval of November 12, 2008 and November 17, 2008 City Council
meeting minutes.
Motion Bartels seconded by Wright for approval of receipts and expenditures.
Old Business:
Council members tabled action on awarding contract on Hwy 6 Widening Project until contract issues with Iowa
Department of Transportation resolved. Council members directed Engineer Frederick to proceed with IDOT.
Motion Wright seconded by Ball to read Ordinance 2008-295 Repealing Ordinance 1979-80, Ordinance 1984-
, 125, and Ordinance 1985-136 Establishing Regulations For The Control of All Animals Within The City and
Prescribing a Procedure For Disposition of Dangerous and Vicious Animals by title only. Mayor Phillips having
read Ordinance 2008-295 by title only, a motion made by Ball seconded by Wright to approve the third
reading. Three Council members being present and three Council members having voted aye to approve the
third reading, Mayor Phillips declared Ordinance 2008-295 passed and approved.
A Special Exception Use application for a Day Care Facility on a Residential Zoned lot in Deer View Estates
was presented to City Council. Application had been reviewed by Planning and Zoning Commission and a
recommendation for approval, contingent upon a site plan submitted with Commission's requested parking to
accommodate for employees and parents utilizing facility. Council members discussed approval of Planning
and Zoning Commissions recommendation and forwarded Council's recommendation to Board of Adjustments.
Motion Wright seconded by Bartels to set Public Hearing on Special Exception Use application for January 7,
2008. Motion Ball seconded by Wright to set Board of Adjustments meeting for January 8, 2008.
Motion Wright seconded by,Ball to authorize Councilperson Mark Petersen to work with developer Mike
Roberts Construction to negotiate a land exchange for park land in Woodfield Ridge development. Land
previously approved by Council for park not suitable for park development.
Councilpersons discussed Ordinance 2002-251 An Ordinance Establishing Provisions For the Removal of
Snow and Ice From the City Streets and Establishing an Emergency Route and Prohibiting Parking of Cars on
Certain Streets. When it was determined that this Ordinance was not being enforced, Council members
requested Public Works to designate snow emergency routes and install signs on these designated streets.
The Ordinance will be reviewed at future work session.
Council members discussed briefly future use of city owned farm land. It was suggested that circle of
protected land around Water Treatment Plant be increased as suggested by Iowa Rural Water Association.
No suggestions were presented on use of other city owned land other than present use for crop farming
Council members deferred further discussion on future use of city owned farm land to work session.
Motion Wright seconded by Bartels to approve Resolution 2008-33 Final Acceptance and Approve Final Pay
Estimate to Strep Construction in the amount of$48,711.91, for the completion of the 2007-2008 Roberts
Ferry Road Project.
Motion Wright seconded by Ball to approve Resolution 2008-35 Approve Final Acceptance and Approve Final
Pay Estimate to Freeman Construction in the amount of$15,713.00, for Songbird Drainage Remediation
Project, upon the acceptance of the project by all parties involved in remediation.
Motion Wright seconded by Bartels to approve the appointments of Jon Burzacott and Robert Sentman to the
Tiffin Community Fund.
Motion Wright seconded by Ball to reappoint Steve Berner and Jim Schmidt to the Planning and Zoning
Commission.
Jo New Business.
Attorney Steve Greenleaf reported on delinquent utility account with Clear Creek Mobile Home Park.
Mayor and Clerk are in communication with representative of ABT Water in attempt to resolve account.
Councilpersons directed Attorney not to pursue reimbursement of possible overpayment of entertainment
funds to Jake McVay for TiffnFest.
Engineer Frederick reported that he was not progressing with easements with land owners for Jasper Ave trail
extensions, but was progressing on trail design. Councilpersons directed Frederick to continue working to
obtain easements with landowners. Engineer's Office had not yet received contracts back on 2008 Water Main
Extension Project Phase Two. Lead Remediation at Villages Development not completed, work still ongoing.
Public Works Mehmen reported he was able to purchase additional tons of salt for$60.00 per ton less, than
previous purchase $170.00 per ton.
Mayor Phillips requested a date to,be set for next City Council work session. Motion Wright seconded by Ball
to schedule on January 19, 2008.
Motion Wright seconded by Ball for adjournment at 8:22p.m.
