Eric Hallman Staff Present: Town Manager Eric Peterson, Assistant Town Manager Nicole Ard, Town Clerk/Director of Administration & Human Resources Donna F. Armbrister, Planning Director Margaret Hauth, Town Engineer/Utilities Director Kenny Keel, Finance Director Greg Siler, Police Chief Clarence Birkhead, Budget Analyst Emily Bradford, and Town Attorney Bob Hornik. 11.CLOSED SESSION Heard out of order: Item C heard first A.Closed Session as authorized by North Carolina General Statute Section 143-318.11 (3) to meet with Town Attorney regarding potential Litigation arising from delinquent Food and Beverage Tax Payments and failure to file Food and Beverage Tax Reports Finance Director Greg Siler addressed the Board to seek direction regarding the Blue Bayou being 3 months behind with Food and Beverage Tax Payments and Reports. Town Attorney Hornik has already sent them letters. This entity is a repeat offender for this violation. The last time they were in violation, they asked for some forgiveness in the taxes which was not given. Board discussed giving the business a time frame of Tuesday, December 18th and if they taxes are not paid and reports filed by that time, they will file an injunction to close their business. An Activity History for the Blue Bayou is attached and hereby made a part of these official Minutes. B.Closed Session as authorized by North Carolina General Statute Section 143-318.11 (5) regarding Property Acquisition (Riverwalk) Planning Director Margaret Hauth informed the Board that we have received an appraisal on the Faribault property. She is further investigating the appraisal because it is in an unusual format. A copy of the Appraisal by Douglas Winner is attached and made a part of these official Minutes. She also stated that it may be in the Town’s best interest to have a peer review done of this appraisal or obtain a second appraisal. Mayor Stevens suggested having both done. The Board discussed obtaining a second appraisal as soon as possible. C.Closed Session as authorized by North Carolina General Statute Section 143-318.11 (5) regarding Property Acquisition (Potential Economic Development) George Horton introduced the Item. Jim Parker described the Lunsford property details. The asking price for the building and land is $395,000. There is currently a for sale sign in the window. After talking with the Lunsford’s they have indicated they would sell the property for $150,000. Parker gave the Board a range of Minutes unsealed by town attorney on Feb. 11, 2020 December 10, 2007 Closed Session Approved: January 14, 2008 Page 2 of 2 property values for their consideration. Hauth stated that the State has reports that indicate that there were no environmental issues with the existing gas tanks. A copy of the asking price ad tax values of each property is attached and made part of these official Minutes. Horton suggested doing the transaction in two phases with contingencies. The Board discussed moving ahead with obtaining an appraisal for all three properties. Added Item C.1 Economic Development Commissioner Gering discussed with the Board the Town obtaining the Collin’s ball field Property (12 acres) for municipal purposes. Town Manager Peterson stated that this could be purchased with installment financing for 30 years and make it more affordable. The Board decided to wait until American Asset makes a decision on their plan before making any inquiries. D.Closed Session as authorized by North Carolina General Statute Section 143-318.11 (3) to meet with Town Attorney regarding current Litigation Robins v. Town of Hillsborough (Asphalt Plant) Town Attorney Bob Hornik reported that he heard from Robbins Attorney yesterday and is in the process of setting up a meeting with the attorneys involved, the league, and staff to come up with another settlement amount without additional funds to come from the Town. Upon a motion by Commissioner Lowen, seconded by Commissioner Gering, the Board moved to return to Open Session by a vote of 5-0. The motion was declared passed. Respectfully submitted, Donna F.
