HomeMy Public PortalAbout1999_01_19SPECIAL MEETING MINUTES OF THE TOWN COUNCIL JANUARY 19, 1999 A special meeting of the Leesburg Town Council was held on Tuesday, January 19, 1999, immediately following the Administration and Public Works Committee meeting, in the Second Floor Councilmember's Meeting Room of the Municipal Government Center, 25 West Market Street, Leesburg, Virginia 20178. Notice having been delivered to all members of the Leesburg Town Council prior thereto. The purposes of the meeting were to discuss the acquisition of land regarding the Rehau Agreement and to conduct interviews of candidates for the Airport Commission and Environmental Advisory Commission. The meeting was called to order by Mayor James E. Clem. COUNCILMEMBERS PRESENT Frank Buttery Leonard McDonald Joseph R. Trocino Kristen C. Umstattd (absent) B. J. Webb Bob Zoldos (absent) Mayor James E. Clem STAFF MEMBERS PRESENT Town Manager Steven C. Brown Chief of Plan Review Paul Gauthier Assistant Town Manager for Economic Development John Henry King Deputy Town Attorney Deborah Welsh MOTION: On motion of, and duly seconded, the following motion was made: Pursuant to Section 2.1-344 of the 1950 Code of Virginia, as amended, I move that the Leesburg Town Council convene in Executive Session. The authority for this Executive Session is found in Section 2.1-344 (a), Subsections (3) and (1), respectively, of the 1950 Code of Virginia, as amended. The purpose of this Executive Session is to discuss the acquisition of land regarding the Rehau Agreement and to conduct interviews of candidates for the Airport Commission and Environmental Advisory Commission. VOTE: Aye: Councilmembers Buttery, McDonald, Trocino, B.J. Webb, Mayor Clem Nay: None Absent: Councilmembers Umstattd and Zoldos The Council recessed from Executive Session to adopt the following motions: MOTION: On motion of, and duly seconded, a motion was made to amend the agreement with Rehau to delete provisions for credit for frontage improvements along Edwards Ferry Road on Parcel Tax Map #49-13-G. VOTE: Aye: Councilmembers Buttery, McDonald, Trocino, B.J. Webb, Mayor Clem Nay: None Absent: Councilmembers Umstattd and Zoldos MOTION: On motion of, and duly seconded, a motion was made to reject revisions of the Fort Evans Road Agreement as requested in a letter from Mr. Michael Giguere of KSI dated January 13, 1999. VOTE: Aye: Councilmembers Buttery, McDonald, Trocino, B.J. Webb, Mayor Clem Nay: None Absent: Councilmembers Umstattd and Zoldos The Council reconvened it's Executive Session to conduct interviews of candidates for the Airport Commission and Environmental Advisory Commission. -2- MOTION: On motion of, and duly seconded, the following resolution was proposed and adopted. 99-8-A - RESOLUTION: CERTIFYING EXECUTIVE SESSION OF JANUARY 19, 1999 WHEREAS, the Town Council of the Town of Leesburg, Virginia, has this day convened in Executive Session in accordance with an affh-mative recorded vote of the Leesburg Town Council and in accordance with the provisions of the Virginia Freedom of Information Act: NOW, THEREFORE, BE 1T RESOLVED that the Leesburg Town Council does hereby certify that to the best of each member's knowledge, 1) only public business matters lawfully exempted from open meeting requirements under the Freedom of Information Act were discussed in the Executive Session to which this certification applies; and 2) only such public business matters as were identified in the Motion by which the said Executive Session was convened were heard, discussed or considered by the Leesburg Town Council.- VOTE: Aye: Councilmembers Buttery, McDonald, Trocino, Umstattd, Webb, Zoldos and Mayor Clem Nay: None Absent: Councilmembers Umstattd and Zoldos On motion of, and duly seconded, the meeting was adjourned.
